Have sent out 5 Validation letters since December.
They are:
allied interstate - No calls. No written contact.
FMS Inc - No calls. Said they would send requested info. Haven't yet!
ERSolutions - No calls. No written contact.
arrow financial services - No calls. No written contact.
Credit Management Control - No calls. No written contact.
Don't know if I should contact them again, requesting information, or contact Credit Reporting Agencies telling them said accounts have NOT been validated.
Paid next week, so I can send out a few more letters then, if needed. Comments most welcome!

Great progress Keith! I guess you can send a follow-up letter to each one, I think there might be a sample one here somewhere. Keep us posted, it's nice to hear from you again :)

Hey Keith--hope you don't mind me saying something. I have spent months and months--almost a year now--sending out validation letters- I have yet to receive one back. Just a couple of weeks ago, I sent out the THIRD request to every one--still haven't heard anything. Also, my phone USED to ring off the hook so I wrote everyone-both original creditors and collections and told them to stop calling my house and to use WRITTEN correspondence only. I've spent almost a year trying to get wells fargo to talk to me. I sent all corporate offices, letters certified return receipt. I just recently learned that the reason they haven't answered any of my letters is due to the fact that they took what I said (DO NOT CALL/WRITTEN correspondence only) and turned it around on me. said it was a cease and desist and refused to speak to me. Another account I had with BP gas CITI card, refused to talk to me when I called them due to them also having a cease and desist on my account. so some of the creditors and collection agencies are taking this and playing games with us, using it against us.
On the other hand, I sent OXFORD a letter telling them not to call me and they call me twice a day every day for seven days a week. So it really just depends on how they want to use it or ignore it.
I'm just wondering if we ask for validation but in the same letter we say do not call written correspondence only, if they're turning that into a cease and desist and using it against us.
It makes me mad because we tell them that they are free to write JUST NO PHONE CALLS--and suddenly its a cease and desist. just food for thought.

Shirley,
I've read the many threads etc......on your various problems. Hope your able to get the last of the problems solved pretty quick!
As for those NOT willing to follow up, in any way:
Take 'em and shoot 'em!
Think many of these folks NEED to be shot, for actions/practices etc.....
Can sell tickets to the event(s) even, using the money from ticket sales to pay off remaining bills :!: :!:
A wicked thought for this time of night.
Just after 9PM btw.
Going to search for more letter ideas and send out a few more sometime next week. After payday that is!
Think I'd best go to bed before I think of much more to do to these "people". A term to use lightly, IMO.

Keith, you can also send a letter to the credit bureau explaining the failure of the collection agency to validate the debt. They will verify the item with your information providers and if your dispute is found correct, the items will be removed from the file. You must send the letters through certified mail with return receipt requested for having proofs.

Shirley
Have you sent letters to the credit bureaus explaining the response you've been getting from the collection agencies? You're next step would probably be to write one more letter expressing legal action if the debt isn't removed from your credit file.

Mike
David, I'm planning on sending letter(s) to the Credit Bureaus
David,
I'm planning on sending letter(s) to the Credit Bureaus next week. Just waiting on payday now!
Can I request that they check into 4 of 5 CA's that have not bothered to reply to my request for information?
Should I include copies of the Validation letter(s) sent to each CA?
Information, as always, greatly appreciated!

Yes Keith, you can request the information from the bureau that you have posted here. Send copies, not the original documents. I hope that this matter gets resolved soon.

Credit Management Control. Sent them a DV on March 2.
Recieved and signed for on March 7. I specifically stated that phone calls were NOT acceptable and contact be in writing only, via USPS.
Since then, I have recieved 2 phone calls from said company!! At this point, what would my next step be?
And who would I have to contact, for taking possible action(s)?
Thanks,

Keith,
Next time if they call you, tell them clearly that you are going to record the call because they have violated fdcpa laws by calling you after receiving cease comm letter. Also inform them that you would be reporting against them with BBB, FTC and AG's office. Then file your complaint with above mentioned places.
They cannot proceed with collection activities unless they validate the debt. So wait for debt validation. Keep us posted.

Problem is, they have called during the middle of the day, when I'm not home. And as always, they don't bother to leave a message containing any sort of useful information!
Number shows as Long distance, which I no longer have with my phone service. Wasn't gonna pay for I wasn't using!

Send them another letter informing them that they are in violation of your Cease and Desist letter that you sent out earlier in the month...
I believe there is one in the "letters" section of this website if you need a template.
