They bought them another house and my dad is not making payments and my mom found out about this when
she received a foreclose notice at her post office (because he hides and steals the mail at the their house and she found out about that too.)
Ok, my moms name is on the house and since it has not been 7 years since they bankrupted....what is the worst that could happen to them? I don't care about what happens to him, just her. Can she go to jail or can he go to jail?

Because your dad refused to make the house payments, and left your mom's credit hanging, this will but a HUGE stain on her credit. Your parents are pretty much $hit out of luck now. No, they won't go to jail, but they'll never be able to get another place to live for a very long time. They will be turned down for apartments and mortgages.
I don't mean to be harsh, but your old man's a moron, and I pity your mom for having such a commitment to that clown. My ex-husband used to throw bills away and hide them, thinking it makes them go away, when it comes to "adults" I just have nothing but disdain for that behavior.
Your mom will not go to jail, but she may need to bunk with you for a while. Maybe you could help her out with getting a divorce. From a man like that, it could be quite liberating. She can do better.

Phonguy just made me remember something, look into a "reversed mortgage" where the house is sold to the bank and owned by it, but the residents are still allowed to live in it until they pass on. Although I still think the old man should be sent packing for such selfish, lazy, stupid, inconsiderate, and irresponsible behavior.

Before you're poor momma gets into it with your dad, she needs to call her mortgage company pronto!
The amount of time for the actual "auction" depends on how many months your payments are in default.
Sometimes the mortgage company may offer a loss mitigation where they will help catch you up by refinancing the default payments back into the mortgage...you'd better call them asap and find out the info!
It was about 9months before the mortgage company actually set a date for the sale..so there may still be time!
