I am trying to help out a neighbor who is a senior citizen and a victim of id theft. We have run a copy of his credit report and there is about $20,000 of debt that is not his. This all came to his attention because of a summons to court to pay a gas and elec bill ($2000+) from an area of our state where he does NOT live. I am working on Fraudulent Account Statements for each company on the credit report and we have filed a report with the state police. I stumbled on your site while trying to get mailing addresses for the credit card companies and see that you recommend sending a certified validation letter. Can you tell me exactly what this should contain and is it something I just type or is there a standard form?

Credit card companies are not required by laws to validate the debt. This is applicable on collection agencies only as per the fdcpa laws. If you are seeing incorrect information in your neighbor's credit report, the items must be disputed with the CRA reporting it. Highlight each of them and request the bureau to verify it with the companies. If the companies don't have any records in their system, your dispute will be proven correct and the incorrect entries will be removed from the file. You can dispute the item with the bureau online as well as send letter through certified mail also.
