Well to say the least i am ticked as i write this, i had gotten a call from ccoa after registering with this sight last month, and i was going to use them. In the end i decided not to because i was able to work out a settlement with one of my major creditors. Well when i got the paper work in the mail from ccoa it had law offices of richard a brennan all over it, and when i conntacted ccoa to tell them i was not going to use there services they told me they were going to still debit my account for the first payment. They stated i was told this was non refundable. I went to the bank and filled out the paper work to have this stopped for the amount of $417 for this is the amount i set up with ccoa, well i called my bank a little while ago and they debited my account for $416 i spoke to a rep at the bank and she stated the paper work had to be for the exact amount $417 or the stop payment would not work. Well i went back over my paper work and the exact payment was for $417 so ccoa or r a b who ever the heck they are took less out and must have know they could do this so they the money. Now i am minus almost $500 in my bank account. I have to go do a disput with the bank, but it does not help me right this minute. I know this post is long, but i am hurting here, these people were supposed to help me and they are hurting me more. I am at my wits end to what to do and i really feel they broke the law. I wrote ccoa/law offices of r a brennon a letter and faxed it to them after i made stop payment to let them know what i was doing and they still took the money out of the bank. How can they do this? I did not sign or send any forms back to them, so they did not have a signed contract with me. Ugh!!!!!! This is so messed up. I also know sometimes we get post from them on this site, and they will read this and turn it all around to make themselves look good. Well they will not look good in my eyes no matter what. Okay like i said i know this was long, and i am sorry but i had to vent, for i have been crying and not sure what to do next. :(


I feel for you so much. The other day when you posted your concern here, people from CCCA said that nothing is going to be debited from your account unless you sign for it. And I understood in one of their posts that even if a person doesn't take their program, they charge a fee because of the time invested on negotiations with the creditors. Well, if they have done any negotiations for which they charged a fee, then ask them for the updates on your accounts and how far it reached. You are spending your money for a cause. I only feel that you should talk with the company and involve an attorney in this matter. There may be something missing somewhere and it can be sorted out. From your post, I understand that you are facing a problem and lost money without a valid cause. You must call them and ask for a very good reason why they have debited from your account, when they earlier said they won't

I am going to contact them, but my thing is they did not negotiate with any of my
creditors. I never sent the paper work back to them, with the info they needed. So really they Have done NOTHING for me but take the money out of my account. I have faith that it will all work out, but right now it just seems as if the light at the end of the tunnel is attached to a freight train.
I am also just really shocked they did this after I stopped the payment and also faxed and e-mailed them a long detailed letter of informing them of what I did. :shock:

Reading in the forums I see alot of info about the Law offices of Richard Brennan, I'm not seeing anything positve: http://www.debtconsolidationcare.com/forums/about8206-11.html
There was a recent post which I can't find(my computer is being real slow) it was within this last week, but I'm sure someone will come up with it, in which CCOA representative logged on and gave her phone number promising refund to someone else who got debited for $417-same amount right.

I had a message on my home phone today from a gentleman with CCOA/Law Offices of RAB today stating they got my faxed/e-mailed letter of my stopping them from taking this payment from my bank. He stated that they have not taken any money from my account,and wanted to know why I was sending a letter/filing a complaint to the BBB. Well a sum of $416 has been debited from my account, and the only place this could have been if from CCOA/Law Offices of RAB. I called this gentleman back from CCCOA but just got his voice mail. I did leave him a message. I told him money was taken out of my account and the reason I was going to and am going to file a complaint with the BBB is because money has now been drafted from my account for services that I did not even use. Plus now I also have the check charges for insf funds. It is a mess, but am trying real hard to keep the faith that all will work out in the end.

nas866, i had the same problem too. CCOA refers me to RAB but after i saw all the negative feedbacks in this forum i decide not to go with him. This morning i check my bank and $257 was deducted. I did not signed any paper work and he hasn't done anything for me. Do you have their phone number NAS???? I called my bank today and hopefully i can get it back.

Sammi613 I got a call from Mike Yesterday who is supposed to be from CCOA the phone number he left is
800-336-9811 ext 104. Good luck, I left him a voice message yesterday but I am sure he was already gone for the day.
I am in such a mess right now it is not funny. I have had trouble with my finances for a while but never this bad. I got paid this past Thrusday and my bank account is already back in the negitve for 500 plus dollars. Because this place took out money they should not have, and now I have had other checks bounce. I do not know what I am going to do. I feel hopless.I do not get paid again until the second of November. My elec bill is due by this Monday and I do not know how I am going to pay it. I have no cash, it is a mess. I am trying really, really hard to keep the faith, but am struggling....... :cry:

It takes us a few business days to cancel an eft transaction and by the time we knew your name it was too late. We are not disagreeing with you about $416 being a lot of money, it is! We usually round the dollar amount down vs up if change was involved. We are not going to keep this money from you!!!!!!! I promise when you speak with me that you will be happy. We have 1000's of very happy clients and I will make sure to call you immediately after receiving your email. Please give me the chance to correct this for you right now. From time to time our company makes a mistake and it is my job to fix it for you.

The reason we start working on accounts after the initial day a consumer signs up is to benefit our clients. We like to get a head start on your accounts while you are working on gathering statements etc. It works both ways, we would have clients furious with us if their file just sat on someones desk until their statements are all together and forms are mailed into our office. We promise clients the day after they sign up that we will start working on their accounts. By doing this it has saved countless consumers from getting sued because their creditors were being worked with 1-3 weeks quicker. That being said, no matter what work has been done on your account we are still not charging you a penny. Please contact me asap to fix this for you.

I just e-mailed you a email it will be coming from my screen name on here and it is a yahoo address. In the subject line I put ON BEHALF OF CCCA.
My thing is I did give your company plenty of notice not to draft my account. I spoke to Tara on the 10th of Oct, and my account was not to be drafted until the 20th, but Tara told me the transaction could not be stopped, it was non refundable, so I had to try and stop it myself with my bank. No change was involved so it should not have been rounded down my payment was to be $417 a month and your company drafted out $416 so the stop payment info I gave the bank could not be used. I have left a voice message with Mike ext 104 at your company on Friday, but have not heard back from him. As I stated in my e-mail I am going to my bank Monday morning to file a dispute about this transaction. When all is said and done, if things do not get straight, I will be contacting the BBB on the not so lucky behalf of CCCOA and Law Offices of RA Brennon. I am usally a laid back person, but I have to stand up for myself when I feel if I have been done wrong. Right now I do feel as if I have been done very, very wrong.

I myself entered in with CCOA, i never signed or sent them their paper work back. I called Tara and explained to her the money was not going to be in my account, i was a little low on funds this week. Plus i never signed and mailed anything back. She told me the transaction is already in queue and theres nothing she can do and she also stated even though i didn't sign anything it didn't matter because they did the taped conversation. I have pretty much always lived paycheck to paycheck and this time just gotten really financially screwed and these people aren't helping their putting us in deeper debt..

I found this little bit of tidbit information in the bowels of the internet, I would take it with a grain of salt but it is interesting information


ACH Authorization

To debit a consumer's checking or savings account you need their permission to do so. Failure to produce proof of the authorization either by voice recording (one-time payments) or an ACH Authorization form can have consequences.

If a customer disputes the debit and performs a chargeback the authorization can be shown to the consumer's bank and the bank should reverse the chargeback. If the merchant does not produce the proof the consumer's chargeback will be upheld.

For one-time check by phone payments you should either record the consumer's assent or send a confirmation email, postcard or alternative "receipt". For recurring debits you MUST have a signed form.

Did you have recorded authorization for CCCA to debit your account? If the debit was in the process of being processed why is that negative? They need to pull money in order to pay bills etc.

I have been with Brennan for over two years and they pull debits to pay my bills. They are not going to just steal your money!

i think it was recorded, what does that mean. I am all new to this and any help would be appreciated. I understand that they re not trying to steal from me. The problem was i didn't have the funds in my account for them to pull and asked them to stop it and they said it was to late that there is nothing i can do. They didn't even have any of my paper work back yet to see who the creditors were..

In loan agreements with pdls, installment loans or pdls the ACH is voluntary, can you revoke this since it is voluntary. This would force them to deal with you through money gram or western union right? I would much rather take the money and pay western union or money gram than have these guys ach ing the heck out of my account for all their ridiculous fees. Is this possible?

I also originally enrolled with this company, but called back 45 minutes later to cancel. They were going to charge me almost $500 a month and I just cant afford that right now. I called a few times to make sure that the money would not be deducted and when I called today, i spoke to Mike. He said that there was not a debit to my account, but I think there was. It hasn't showed up on my account, but I just got paid yesterday and my account is already negative $500! If you are looking for a good credit counseing company, I use Delray credit counseling. They are very nice and will roll in your payday loans if you let them go to collections. I have all my credit cards managed by them and I only pay $175 a month.
