I am tring to work with merrick bank (hooters) and I have made arragements with them to pay $250. on the 6th of Feb .that went through , again on the 20th of feb. and again on the 20th of march they contine to call every day or 2 and give me the whole story about my payment being late .I tell them i already talked and set up payments and they still call looking for more money . what else can i do yesterday they called me twice,i told them i had talked to someone already and they called me a liar! The total i am behind is 587.00 ,they told me until it is totally current they can call as much as they want. They go from the house phone to the cell phone like I would know they just called and talked to them.

if they are the original creditor.they can call more than once a day.i got the same thing with CHASE before i paid them off.

Hi RJB, Im sorry to say they can call as much as they want. Have you tried sending them a letter or fax stating that you would like them to stop calling? And i dont understand that they still call after you already setup a payment plan to give them there money. Im guessing they will keep harrasing till they get all there money back.

if you enter a payment arrangement.once you make that first payment the calls should stop.at least that's what happened with my chase card, but it depends on the bank i guess.

Have you officially setup a payment "plan" with them? If you are just telling them when you are going to send money, pretty much they will keep calling until the account is current.

I had a bout like this with Discover several years ago. They would call me, I would make a small $50 payment over the phone, then they'd be calling the next day wanting more. I finally snapped and told a lady "I am trying to pay. The amount I paid yesterday was acceptable then, so why is it not acceptable now? If you're going to be calling me every day for money I don't have, you may as well charge it off and sue me." After that, she got a manager, who I explained my frustrations to. The manager set me up on an actual payment plan for $115/month and lowered the interest. After that, we were all good. Discover even re-aged my credit report and removed the delinquency as long as I was making those payment.

The moral of my story is that maybe you should ask for a manager and request to be setup on an actual payment plan.
