I just recieved a letter in the mail from an Attorney(that I have never heard of) stating that I am facing a lawsuit by Asset Acceptance LLC. I have no idea who this company is, and I have never recieved a call from them. I have no idea what it is about because noone will answer when I try to call and get information. What can I do? The letter says I can try to file bankruptcy but I have no idea how or even if I should. Please help me, I am very confused.


It seems you don't know this company (Asset Acceptance LLC) since they're not your original creditor. Probably they've purchased your debt (your account may have been charged-off). Check if you got any debt validation notice from them. Irrespective of whether you got the notice, you can send in your letter to get your debt validated within a period of 30 days.

Apart from that, ask the collection agency to validate the debt. If they don't send a validation letter to you, then send a cease and desist letter to Asset Acceptance. Contact an attorney. If they really file a lawsuit against you, then he can help you fight the case. You should not pay a penny to Asset Acceptance if you don't owe the money to them. Send a certified, return receipt requested letter to the attorney requesting that they validate the debt under the FDCA regulations. Also, state that until the debt is validated you do not want any telephone contact. Under FDCA they are supposed to send you information within 5 days of contact anyway. Make sure your letter is certified so that you have proof.

Once you receive validation you can decide how to handle the debt. Many people receive these letters from attorneys/collection agencies to scare them into paying immediately. Often when validation is requested, they never contact you again, and sometimes it goes to another collection agency. If that happens, you do the same thing - send certified RR letter requesting validation.

Hi Sick & Tired,

The way I read your post is that an attorney is soliciting you to provide you assistance because a court action has been filed against you with Asset Acceptance as plaintiff that you are unaware of and have not been served yet.

Check out the record at the court, confirm there is an action filed and let us know what you find.

I settled all of my accounts for less than 35 cents on the dollar using a company that I can't name and that included there fee which was paid after I received the settlement letter from the creditor in which I paid directly. All they did was negotiate the terms and I was debt free. I would give them a call no soliciting
