Hello and hope all are well. I am in a 100% commision job before the economy hit the fan, I was doing allright. I took on two credit cards about three years ago. I have racked up $17K in debt between the two of them. Recentley I have been backed into a corner when it comes to paying those cc's because my income is based soley off of what I make for my company and since I am not doing the type of buisness I was a couple of years ago it has been hard to pay my bills on time. Those two cc's are now in collection they are the only two debts that i have ever paid late on in my whole life, I would love to pay them off but I dont have the means to do so. My bank account is basicly at zero and anytime I deposit a paycheck it all the funds are gone within a week to pay my other bills. Collection agencys are now contacting me and my question to anyone that could help is, if I can't pay that debt even if I settled what should I do? What are my options? If that debt does go to a judgement and I still cant pay the debt what happens then. I know I should get a new job and I have looked very hard but the only jobs I seem to get an interview for are commision jobs. Sorry for the long rant but any help with my situation would be greatly appreciated.

Hi there.
Well first of all know that you are not alone! So many people are in your situation and have been able to find a way out. In my opinion, you have only a few options. If your 2 accounts had not yet gone to an outside collection agency I would suggest you seek a debt mgmt plan. However, since they are already in collections, I would contact a bankruptcy attorney. I only say this because you mentioned that you don't have any money to save for settlement, or for any other means of paying back the debt. You would probably qualify for a chapter 13, which would mean the court would give you 3-5 years to repay a percentage of the debt. They will not make you pay a higher percentage than you can afford. The judge will take into consideration all of your monthly bills plus money you should be putting into savings plus additional expenses you never would imagine they would include. The amount you may be ordered to repay to your creditors could be really small depending on your financial specifics. Yes your credit will obviously take a huge hit. The other option would be to wait it out...it is possible that your creditors will not sue you, and that you will simply have to endure the phone calls and letters. Lastly, have you thought about getting a part time job instead of switching jobs all together? Sometimes just a 15 hour a week job is enough to get by, to get back on track. Just a thought.
