Usually, creditors are not much interested to settle the debts unless you are delinquent on the accounts be few months.
You can also enroll in a debt consolidation program. This program will help you merge all your debts into a low single monthly payment. Check out the following page to know more about debt consolidation:

Hi,
Yes, you have to be delinquent on your accounts in order to get them settled through a professional company but you always have an option to settle your debts on your own. Tell your creditors about your financial hardship and the exact reason that is keeping you from making timely payments. If they seem convinced, they can alter the principal balance and make repayment simpler for you. As a part of your debt is forgiven, you just have to repay the remaining amount in monthly installments or as a lump sum, depending on your present financial state.

Balance transfer method when the OP owes 40k??? Get real!! No one is going to open additional credit lines sufficient to transfer this amount!! They are already a bankruptcy waiting to happen.
debt relief programs
I finished a debt relief program six months ago. It is important to know that the longer it takes to pay off your debt the more money they will make. I had to constantly push them to settle my debts. Also if they settle a debt the amount of money they save you is taxable as income if you are considered solvent. Check IRS.gov. I had no choice but to go that route however it was not easy. If you are eligible I would go with Bankruptcy. It is not the kiss of death some think. Especially if you are young...you will have time to come back and believe me you will get credit back. I am hounded constantly by Cap One to take a credit card and I settled two accounts with them. I get offers for credit all the time and I just finished this program AND some years ago had a bankruptcy. I am debt free and i do not use credit cards, period.
Debt Settlement
Yes, your accounts will need to be delinquent. Not necessarily to qualify for a debt settlement program, but to qualify to reach settlement agreements with your creditors.
As you've been warned, please be careful when seeking out the services of a debt settlement company. Don't sign up with a company that charges any fees up front, or per month - this is not legal. If they're willing to break the law, what are the chances that they'll treat their customers right?
Do ample research, and you'll find an honest and ethical debt settlement company.
Best of luck to you!
