My husband and I have approx $40,000 of debt from Credit Cards, Medical Expenses, a student loan (already in deferment), and suppliers we personally garunteed for our failed business. We have already had a bankruptcy and have not been able to pay on this debt for approx 6mo. We finacially are in a position to start paying the debt off but the minimums are several hundered dollars higher than we can afford. In the meantime several of the creditors are still charging finace/over the limit/and late fees. What money I do have to pay each month wouldn't even come close to covering these. Because of our credit score we can not refinace for a rate lower than 12% and no one will provide us a personal or HELOC because of the previous bankruptcy. Credit counceling angency's won't touch most of the large debt since it was obtained through the business even though were are personally responsible for it. Where can I go and what can I do. I want to do the right thing but none of the debtors are willing to work with us in a way that we can handle....


Can you call your creditors and arrange a payment plan with them? They might be willing to work with you since you are ready to pay what you can afford. In case, if they are not willing to help, speak to a counselor who can assist you in paying your debts with the creditors. There are different debt management companies who can negotiate with your creditors and arrange a lower repayment plan and reduce the interest rates. You may be able to file for a Chapter ll bankruptcy - there are three kinds of Bankruptcy - Chapter 7 which is personal bankruptcy with liquidation, Chapter 13 bankruptcy with reorganization and a repayment plan to the trustee of the court and Chapter 11 which is business bankruptcy. You should probably consult with a bankruptcy attorney if those are valid business debts.
