In most states real estate and personal property is considered jointly owned and a lien can be put on it regardless of which spouse holds the card. The same with a joint checking or savings account.

Is your spouse an authorized user? If not, I don't see how they can hold him responsible. I settled all my credit card debt which was in my name only, and no one came after my husband or even called him. Also, we have separate checking accounts, and don't have a joint account (second marriage, smarter). The house is in both our names and if I hadn't settled, they could have either garnished my pay or levied a lien against the property. I live in New Jersey.
