I am owed over $25,000 in back child support for my 16 year old son ... his father hasn't paid in YEARS but is working now. ASSUMING that he's getting a stimulus check, will it come to me instead of him? Or does anyone know where to find out?

Have you received any tax refunds from the IRS on his behalf already? If the IRS is snatching his refunds b/c he owes child support and is paying you these items, then chances are they will also tax his stimulus check and forward that to you.

If the IRS has not ever sent you his tax refunds, then you probably won't get his stimulus check.

It all depends if it is set up in their system.

I would encourage you to contact Child Services in your state. They have the resournces to locate and go after him and the expenses will be paid by him. The State will go after him even if he lives in another state. I don't understand those fathers who just believe that they can ignore the children. It's very sad! but they should never get away with it. CALL CHILD SERVICES - PLEASE!

Funny this is brought up again, as I have just gotten more papers from his state trying to establish a new support order where I pay HIM. They don't seem to care that he owes me for 13 years of unpaid support?

I have, submitted all the papers, called the other state AGAIN, resubmitted all of those papers, he changed jobs, submitted everything to both states again, waited, submitted again, he changed jobs etc etc etc. He's been doing this since my son was young, I made the mistake of not filing as soon as my son was born because he didn't want any part of his life so I was happy to just have him out of MY life. As soon as he started demanding to see our son when he was about 2 years old, I filed, and he has hardly been forced to pay a dime. He was only supposed to pay $209 a month starting about 13 years ago, and now owes just under $25,000 ... that should tell you how much he has actually paid towards his sons support.

To be fair, I have only given my son spending money and have paid nothing towards his support since he has been living at his dads.

This whole thing depresses me!

The father of my child has been living off of me and his child. He claimed her on his taxes for three years but i amended them. He does not pay child support but i have filed now. So what i was wondering since the child is three now does he have to pay child support for the first three years of her life or does the process start now since i just filed for it.

WOW I knew I wasn't the only one out there who has a dead beat for my daughter's sperm donor... He often works under the table too just so that he doesn't have to pay. Right now he is $12,000 behind... not as bad as some of you, but I'm sure that I will be up there too someday. My daughter is only 7. The sad thing is that he keeps having more children and she is his oldest... he can't even take care of her! He doesn't even call.. well twice a month maybe.. he doesn't take her for his scheduled visitations... and yet the courts won't do anything to help out us moms who are busting our azz'z to make ends meet. Shout the courts won't even allow them to sign over all parental rights without someone else to adopt the child! My husband would... but he says he doesn't want the sperm donor to get off that easy. I do get his tax returns... when he files.. didn't file this year because he couldn't pay his tax guy the money he owed him either... so guess what that ment.. no stimulous check and no refund for my daughter!! Jerk... we should send all these guys out to war to fight the other jerks just like them....

My husband owes 15000 in back child support...NOT BECAUSE HE IS A DEAD BEAT!! The mother came forward after SEVEN years to say the child was his! he PROVED HE WASN"T HIS....YET THEY ARE STILL SUCKING US of our tax refunds and child support each month!!!!! SO not all cases are the SAME! I have a child who is from a former marriage and my ex has not paid in YEARS but was not forced to pay back support!

You would not believe the headaches that I've incured as a result of my child support case. My ex likes to work under the table therefore "untraceable" by the courts. He also skips from job to job when they are taxable. Granted he only owes a little more than $6,000 (my daughter is 8). I receive, then don't, ect. It is very unreliable, and very frustrateing. The fact that he has escaped jail time is beyond me, but at the same time, how can I get the money that I need if he is in jail? All the assets that he has privilege to are in his girlfriends name, yet anouther dead end. The best bet that any of us has is if "God forbid" they die, or we win the lottery. It's a sad, sad world we live in, but, hey, keep your head up, God sees. Revenge is mine sayeth the Lord. He's the only one who can do anything. P.U.S.H. (pray untill something happens)

My story is pretty much the same. My husband owed about 26,000 to his daughter. The first year we were married all of our state and federal refunds were sent to her. At first I was a very very upset. Then we finally discussed it, because I knew he had a daughter, but I did not know that he was that far behind. So anyway, to make a long story short, it took us 7 years of having our state and federal refunds to pay all of that money to his daughter. She definitely deserved it and now it is all paid off. My question is, if anybody can direct me in the right way, my question is, now that his arrearages are all paid off, there is actually a difference in our favor. She received our federal refund of about 6,000 and there was only 4,900 and some change owed on his arrearages. Does anyone know if we get that money back or what? I am sorry to hear about everyone elses child support problems, that is a shame when a man can't step up to his responsibilities, they are definitely cowards and selfish. Any help from anyone would be great!
Thanks,
Debbie

a guy shouldnt go to jail because he isnt paying child support!... whats he gonna do pay it from jail? umm not... i went throguth this with my mom and dad.. and putting him in jail only hurts the child. But since the kid is living with his father now he wont have to pay child supprt but he will still owe back child support 2 the state.

Some of these men are a trip . They go years without taking responsibility of the kids they have and get married and start another family and the first thing they say is the ex is mad.
Well, maybe i should have not taken my kids to dinner with me and i would be married with kids too. This is sick. Alot of times men try to lock down the ex with the kids because they still want them and they hide behind the other women to make you look like the hater. These sorry m#@##$$F@@@@ need to take their responsibilities with them when they do there shit and maybe CS wouldnt be on their ass.

I wans't aware of the felony part either. I know that they will put you in jail if you refuse long enough to pay. My daughter-in-law is still fighting them. Her ex finally got on disability-he did this to avoid child support originally.

The courts said that when he did and got his back pay, that she would get a good part for the kids. Well, he not only got it and back pay, but came by her house and gloated about it and wha all he brought. The child Enforcement agency just says, we are checking on it and there's nothing you can do.. even though he is several thousand behind

Thanks. I know from my oldest son being disabled that if they over pay you or shouldn't have paid you, that on your next few checks they will take it out of that.

What a jerk- to come by and let your kids hear you say that you got new tires for your truck, went on a spending spree, but can't help put food in their mouths or clothes on their back--or even buy them anything!

I know how that feels.

My ex always claimed he did not have the money but he still bought comics for his collection. He was literally buying comics until the day he died but had not paid any support in his own in almost a year. He died a month after our youngest turned 18 owing over $2000.

At least our kids got his collection. We are going through it now and it is going to take months to sort out but I hope eventually they can sell it for something and they can each get a nice nest egg to put away in the bank.

He had many debts, much more than any assests so the collection and some personal belongings were all they got from him.

When I filled for child support on my son back in 2007 diidnt get started in till 2008. I got back child support for threes years which was like $12,000 dollars and he has to pay me $400 a month. I tried to do it the easy way and asked him to just give me a hundred dollars a week for him. He didnt want to do it that way so it went through child support now he owes more then he would of just giveing me what I asked for. I pay his doctor bills carry his insurance he still doesnt do nothing for him.

I think they meant the child.
??
I was in a similar situation. I paid for it all too.
??
He stopped paying at the beggining of 2008. They took his refund and his stimulus check for the back support he owed.
??
I never got any more money after that.
??
He died in November of 2008 oweing me over two grand.

I think the guest is reffering to her child's bills and insurance. What she needs to do is go to court for a garnishment order if the biological father is unwilling to pay.

However if the father is not working at the present moment they may not get anything. The government will take the father's stimulus and any income tax untill that child support is brought up to date.

My childs father does not live in the state as us. Nor does he support his daughter. Our daughter is 10 years old and I filed for child support Sept. 2008. He underminded me and filed her on his taxes. How is this possible? What can I do?

That is ok I am owed over 34,000 in child support but, no one can find these fathers and now I have to give my car back and my kids are suffering because I can not pay my bills. They do not put these fathers in Jail. The one father has not paid in 9 years. I just want what my kids deserve.
