What happens if I don't pay the payday loans

i have 3 payday loans of 600 each I have been paying on them for 1 year 400 per month of interest. I cant see to ever have money to pay them off. what happens if i dont pay them and then just start making payments? Will I go to jail? I live in Houston TX


Ok well those stroefronts registered as CSOs in Texas. Which means they are Legal and can take you to small claims court for the balance owed.

You can try going to each store and speak to the manager explaining the situation. Since you have no bank account you can maybe set up a small repayment plan untill the loan is paid off.

If that does not work google their corporate headquaters of each store. Speak to a representative their and see what your options are.

Yes, they are Legal in Texas.

You may be able to go into both stores and request and extended payment plan. Speedy cash is a member of the CFSA which allows the EPP. You can find out more about the EPP here.


You listed Speedy Cash. What is the name of the other PDL company. You can check to see if they are CFSA members HERE.

These stores are everywhere in Texas, they prey on low income people and get away with USERY! You can force them to settle, I had four storefront loans, I was very foolish and blame myself, I payed them as long as I could but hit a brick wall when I had a sudden car repair. I called the Texas AG and was told although loans are legal it is not illegal to close bank account and force loan companies to settle for reasonable payoff of debt, I also however checked with the county hot check dept. to be assured I could not be prosecuted. I closed the account the stores called and I was able to set up repayment of all loans. Be Cool.

I applied for ssd, but no word yet, I get $837.00 in social security...I don't own anything, but I can't pay my bills...too many medical bills/scripts...none will take payments...if I go to court, and still can't pay, will I be in contempt of court and go to jail?

Yes, Pay day loans are prohibited in New York period.

If this is a LEGAL/LICENSED lender, then you can be sued in civil court for nonpayment. This usually is their last resort after many attempts to collect the loan.

If this is a ILLEGAL/UNLICENSED lender then absolutely no legal action can be taken against you. They will threaten and try to intimidate you into paying, but they have no Legal recourse without a valid license to lend. Some Illegal lenders will report you to teletrack and possibly try to report you to the credit bureaus. You are morally obligated to pay what you borrowed, meaning the principal only.

Whatever you do please show up in court when being sued by a creditor. If you are a no show the other party will get a default judgment against you. You cannot go to jail over a debt.

I have a payday loan with ace that I was not able to pay back for 376.00 they call me at work and talk to my boss to tell her about my loan with theme and told me that they was going on my job. Can they do this can they come on my job like that

I live in Texas. I presently have 2 loans: Zip 19-$1000,
Cash Net-$800. I am going through some really hard times. I am trying to pay but it seems, I can't even keep up with the fees my bank is charging me every time for ACH fees.
Help can they garnish my wages? I am really do want to pay, I am just in a bad situation right now. Any suggestions.

it is not a felony!! this is a scare tactic! dont be fooled. tell them you are willing to make arrangements. if they refuse, close your checking account and open another for your every day business before this company does any damage to your account and/or finances by trying to deposit those checks.

Most of the PDL companies are unwilling to make any type of arrangements if you are current on your loan. Only when in default are willing to make extended payment plans.

I would check on the PDL laws for the state you are in. If there is nothing in law reguarding criminal prosecution for closing your checking account due to PDL, then I would close the account.

The first thing to keep in mind is to protect the funds you have! And the money you are paying each and every time for NSFs could be well used.

If there is a law reguarding criminal prosecution due to closed account, I would draft copies of "revoke ach transaction agreement" letters and send one to the PDL companies. Also, go to your bank and talk to the mananger, explain your situation. Give the manager a copy of the revoke ach transaction agreement. Tell them to put a hard block on your account not allowing ANY debits or deposits. Basically freezes the account as it will be unuseable.

It is your right under federal law to revoke an ach transaction agreement at any time you wish. So know your rights! The PDL companies will try and tell you that you cant revoke the agreement because you signed a legal binding contract. Well, you actually did, and at the time of signing the contract you did agree. However, circumstances with your funds has made you change your mind.

Go to another bank and open a new account. Do NOT give out any information about the new account.

Once the PDL companies are unable to hit your account via ach transactions, the calls will START.

Now is when you can try making payment arrangements, and begin settlement. Make sure all of the PDL companies are "legal & licensed" to lend in your state. If not you only owe the original amount borrowed, and nothing more!

They are not allowed to harass or threaten you! You can not be arrested for a PDL, it is a civil matter, not criminal. If they harass and threaten you send them cease and distist letters.

I have 3 payday loans that I have been paying for the past 3x already. I'm not able to pay the high interest anymore and I dont know what to do. I have a loan with Ace Cash of $1000 with $204.00 of interest and have $1500 with EZ money with $305.00 of interest and The cash Store=$1000 with interest of $204.50. I live in Houston, Tx. What can I do and what do you advice me? Thank You

iworked for a company under a two year contract and was offered a much bigger pay through an branch off the first job after 3months employment. i took the contract checked to make sure the first one was voided and all the paperwork was properly delivered that i had changed jobs. in the mean time i kept receiving pay checks from the first company. i sent the money back and called them.they sent me back th money and said they were paying off my contract that i signed with them.after a year they came backa nd said they screwed up and now wanted their money back.i could not pay all at once so i sent payments that i was able to make they said they wanted higher payments that that wasnt good enough..then i lost my job and have been on unemployment which only pays 50 % of what i made and i pay all bills,house car,insurance,groceries and raising two kids. they just served me court papers and are sueing me for the $2,000.00 because i couldnt make any more payments due to not enough money.what do i do and what can happen to me?

I have gotten a loan from Cash NEt which was obviously funded from First Bank of Deleware. They have looked up info on me and have now contact my father in law and told him that they are trying to serve me court papers. I tried to contact them and they said that the only plan they could put into place was to take $896 from me today well of course I can't do that. What will happen in court?
Also, they say that I have committed fraud because the account was closed before they could collect the funds because my account was negative for too long.

How do you know it's been turned over to collections? What is the name of the collection agency? Have you received a letter of collection in the mail? If so, you should send them a debt validation letter.

Now that your PDLs have been turned over to a CA, at least with me, the calls increased, they called my place of employment and my sister who lives 50 miles from me. I kept a log of every call. Time, date, who and a brief summary of what was said. Your may want to read the Fair Debt Collection Pratices Act (FDCPA),

So i have a payday loan out at Ace Cash Express In Nebraska for 352.00 (thats what i owe) I have some company from New York calling me called Advance credit recovery. They told me that I need to pay or Ace is taking me to court for writing a bad check. I'm pretty sure my bank account was open when i wrote that check but i'm not 100 percent sure. What is the worst thing that could happen if they did take me to court. Could i go to jail?? I tried making arrangements but they won't let me.

i answered your other post.in short no you can't go to jail,and this place sounds like a typical bottomfeeding collector.file AG complaints against this bottomfeeder,and tell them you won't speak to them again without details in writing.then hang up.

One Thing
I received a call from an "Unkown" Caller. They said they were with with a legal office trying to collect my debt from a payday loan i never paid. They said i can either settle outside court for 930 Dollars i took a 120 dollar loan out. They want me to write some stuff down on a paper and put my credit card number on the sheet and fax it? They did not speak english well at all. If i dont pay it they said they are going to have an officer to come over and pick me up. What should i do??? Is it a scam???? Im from minnesota!! Any help would be great!

It's a scam, file complaints with the FTC, BBB and your AG (link for the FTC in my signature). Next time they call, hang up immediately.
