Thanks for your help Steelers1. They already have my information I think. They called me at work. I called the Dept. of Ed tonight and they refered me back to allied interstate. They told me they were Dept. of Education. She said she was faxing me something to sign at work tommorrow. She said that I had to pay them now or be garnished immediately. Can I tell her she must document the amount owed to stall them till I call Federal Direct Consolidation Loan. It's 10:00 pm in NC where I'm at....I feel like I'm about to be in a whole lot of trouble...

I would call that number first before they have a chance to call you first to find out if you can put these into rehabilitation. Or if the lady contacts you first inquire about loan rehablitation and that you want to look into that option. I believe that if this is the first time you defaulted that is an option you have prior to them going straight into garnishment. I had my student loans default and I was about to get my check garnished and I was able to rehabilitate them before that next step. Tell her you want that option.

She said the $425 that I have to pay her immediatley is for Rehabilitation. She said I have no choice on the amount, that it is .076 % of the outstanding amount and if I don't begin paying it immediately it goes to garnishment without hearing. Do I have grounds to ask for validation?

Call that number and see if you can consolidate the loans and with student loans and child support they don't need to have a hearing to garnish. If you qualify for consolidation it will take a couple of months to get everything completed but in the mean time you will be garnished 10% of your take home pay if you don't pay the $425 a month, so I guess it comes down to if the 10% a pay is less than the $425 a month payment.
