I live in Texas and received a phone call from NES this morning about about a $3233 debt from a credit card company (Sears). I do owe the debt b/c I forgot about it (I have clinical depression and forget to pay bills sometimes...(an excuse, I know, but it's true.) I have not received any notification about this collection agency, but the person I talked to said they've been sending me stuff in the mail. They also called a work phone # that I haven't had in 3 years. Anyway, the person I talked to threatened me with a lawsuit, asked if I had legal representation, and threatened wage garnishment, etc. I asked them many times to set up a payment plan, but they said that wasn't possible. The whole amount had to be paid now, or I would be sued. I panicked, and after the "supervisor" demanded a lump sum be paid today, I stupidly gave him my bank account info. and told him I could pay $200 today. I should know better, but was caught up in the emotion of the situation. I did call my bank today and put a stop payment on the $200 draft. On Tuesday, I plan to close that checking account & set up a new one b/c I've read that NES tends to take out more $ than was agreed upon...well, I'll close the account once some other items have cleared. He badgered me into getting a loan, asking relatives (which is NOT possible) for the money. When I started crying, he asked me in a very rude way, "Why are you crying?" I told him this was very upsetting to me. He had no sympathy. NES called several hours later with a "deal" that the credit card company would let me settle for something like $2500. I told her I couldn't pay that. They expect me to call them on Tuesday with a solution. Can anyone help? Can a collection agency take a person to court? I'm on meds now & am trying to get my finances in order, by the way. But, this NES business is really stressing me out. What should I do??

Do not get upset! Like it was posted above, nothing is worth damaging your already fragile emotions. I, too, suffer from depression and have my whole adult life. When I am going through a rough time regarding whatever---I like to have someone actually tell me or show me what to do. Here is what I would suggest and you can do what you wish obviously.

1.---Do not even answer your phone until you speak to the debt counselor from this site. If you forget and answer anyway and it is them, just say you aren't there and take a message.

2.---On Tuesday, if you haven't yet talked to the debt counselor, don't call the collector. Let them call you.

3.---I repeat, DON'T let this get you down. I had a similiar experience last summer and it made me so ill and depressed that I was off of work for a month. So take it from me---

Please keep us posted. There are lots of helpful, knowledgable and sympathetic people on here.

Thank you, Lorri, for the great advice. I'm sorry that you've gone through similar circumstances. Depression sucks. I'm trying to remain calm about the whole thing. From what the posts I've read on this site, I am learning that I have rights (for ex: NES threatened to garnish my wages, but under Texas law, they can't do that). So, I'm not feeling as panicky as I did yesterday. I'm still worried about my bank account though. I can't believe I gave the guy my info. I know better than that (am also preaching that to my mom), but he intimidated me so that I thought if I gave him some $, he'd be more willing to negotiate with me. It's pathetic that there are people in this world who take advantage of people who are already having problems.

I spoke with another collector about another unpaid bill and she was great! She was perfectly willing to work with me. I told her what happened with NES and she said what he did was illegal. So, I really believe the law is on my side, and that with some advice from a debt counselor, I will be able to pay this off. Thanks again. I'll keep you posted.

If anyone has experience dealing with NES, please let me know how you handled it. Thanks.

I have recently been dealing with NES. I just registered with this site after reading all the posts about NES. The man I spoke to told me I had emotional problems because I asked him to treat me like a human being. There really is no talking to these people. As of yesterday I filed a complaint with the BBB of Ohio and the FTC. After my argument with them I am still getting calls. I am ignoring them until I am able to speak with a debt counselor.
I also called the President of NES--I doubt I will get a call back, but I will keep trying until I do.

:shock: :shock: I hope you did not admit to oweing debt just because they said so. Since when did we as a consumer start believing what dirtbags(oops,collection agencies) said. The first thing to do is either close or freeze that account. Next send out a debt validation letter. Include a clause in letter that you want to be contacted by letter only.

Make them prove 100% that debt is yours. If they prove this,then we can start talking about a payment plan!

I had a similar experience today and I gave them my account information also. I was caught up in the moment and certainly did not want to have a "federal indictment" filed against me. I have requested a letter stating account has been paid in full and a settlement letter. I'm thinking about closing my checking account before they can get the money on Monday.

This particular collection agency uses strong scare tactics. I was petrified by the first few calls I received because instead of talking to me about a payment plan they automatically started talking about garnishing my wages and informing my employer of my debt (which I know is illegal). I spoke to a few reps there and they were all the same. Rude, ruthless, and insulting. The last rep I spoke to was interesting. I told him what I could afford to pay on an installment basis...then I said "You can work with me or work against me", his response was "I'm going to work against you". When he first picked up the phone he went into this tirade about just coming from speaking with a bailiff about getting my case to the court sooner than normal....they are just trying to scare me. I don't doubt that I owe the debt and I want to make good on it, but if I pay them what they want up front, I won't be able to pay my rent. I tried to explain my situation and they don't want to listen.....I'm at a loss right now...

I just had the same experience you had. I was called about 7 times a day, 7 days a week. I knew i owed Citibank the money and i also asked for a payment plan and they refused saying i must come up with the money by 6 pm otherwise face legal action.

I explained to them that if i had all the money to pay it, i would have, and i wouldnt be in the situation to begin with.

They were very rude, one women even said to me "even the poor people in Puerto Rico pay their debt when we go after them, so if you wanted to pay it you would." First of all, I am Puerto Rican and i wanted to tell the women to "F" off.

i got off the phone with her and ignored the calls until i could think of a solution to come up with the money. I got another call this week by a man who said he has "no respect for me" because of my problem. So we argued and on the phone and i demaned to speak to a supervisor, who did nothing for me.

I panicked and thought of any way to come up with the money. I eventually asked my boss who's an attorney for the money and told him he could take it out of my paycheck. Being the wonderful person he is, he called the company on my behalf and they reduced my balance even more through his negotiation.

My advise to you, if you have a friend who is an attorney or any attorney you know that can call for you to negotiate the balance you owe, it will make a difference. If you are working maybe you can do what i do?? I know everyone's situations is different but i'm telling you at least i can sleep at night. Good Luck!

I recently worked at this horrible place. National Enterprise Systems is the collection agency from hell. It's the devil's worst nightmare. Employees are trained to collect according to the Fair Debt Collections Practices Act but once on the floor in their respective departments collectors are told to forget everything they learned.

My supervisor, Bryan Howard under the alias of Paul Stevens, regularly provided a second voice to collectors having trouble closing collections. This idiot would identify himself to callers as a federal agent, an NES attorney, etc., anything to try to scare the debtor into paying. He would actually tell debtors and their spouses that a lawsuit had been filed and if the account is not paid by postdated check by a certain time that day a deputy of the court was coming to serve the debtor on his job. I witness this on a daily basis all day long. B. Howard is neither a federal agent, attorney nor any of the other things he claims to be and NES don't sue debtors. All are clear violations of the Fair Debt Collections Practices Act.

Debtors are talked to as if they're inhuman. Even when the debtor is not home the person taking the message is treated like dirt. I will never forgot my supervisor shouting at an 81 year old African-American woman for not getting a pen and paper to take the message. "I DON'T CARE IF YOU ARE 81 YEARS OLD HE SCREAMED AT THE WOMAN." I've witness collectors hollering at kids "GO GET YOUR FATHER."

You are not supposed to talk to spouses????????in certain states--about their significant others???????? debt unless given permission by the spouse to do so. This rule is ignored at NES. In fact when I left training I put the document about the spouse rule on my cubicle wall to reference only to have it snatched and trashed by Bryan Howard who said I wouldn????????t need it.

The owners Ernest Pollack, his wife, and two sons: Scott and pie-faced Chris are well aware of what is going on. These people are hands on owners. They constantly walk the call room floors, note the individual collectors and group collection sales and hear all the violations first hand. The more a collector screams at a debtor the more they like it. People actually clap and cheer when a collector goes off on a debtor. All that concerns these greedy money grabbers is how much money they are collecting at any given time.

Payments are demanded in full although they do offer settlements that are too demanded in full. Money orders and mail-in payments are not accepted, only postdated checks over-the-phone or Western Union Transfers for Citi Bank accounts. Some other creditors do allow NES to also take payment by credit card. For the postdated checks debtors are asked to give their accounting and routing numbers. NES, the scumbags they are, attempts to take the money out before the postdate. Nice company huh!

Collectors and supervisors once provided with bank info by the debtor call banks automated customer service numbers to obtain how much money they have in their accounts. We have their social security numbers so getting info this way is like taking candy from a baby. Some banks have safeguards against this and required you talk to a live person. They also work this wickedness on debtors???????? credit card accounts or the credit card accounts of the debtors???????? spouse, mother, father, etc. I remember one collector on the phone with a debtor saying ???????Your Mother Has $7,000 On Her Card She Can Use;??????? She Can Pay This Debt For You!???????

If anyone needs someone who's "been there" in any of their legal actions against this despicable company I????????m your guy.

You are in Texas so you have some teeth when dealing with these scum. For one, they CANT garnish your wages! This is not allowed in Texas. :) Not for a credit card debt.

Your DV should be a little different, you need to cite Texas Finance Code, Its the law of Texas that any CA MUST validate the debt within 30 days or they have to remove the aqccount from your credit report. They also MUST stop all collection until the debt can be validated. Next you want to include a written notice of inspection according to the business and commerce code letting them know that if they DONT validate, or if they violate in any way, you will sue them for treble damages. This method works wonders and you could very well end up with THEM paying YOU over these unlawful tactics.

I have been getting harrassing phone calls at work from these idiots and they make the same threats. I am sending them a Cease and Desist letter this weekend. What else should I be doing. I know the debt that I have with Bank of America is legitimate, so can I then call Bank of America and ask them to make a payment arrangement? Do you think Bank of America knows just how illegal NES's practices are? Is there a sample Cease and Desist letter that someone can send me? I cannot have these idiots contacting me at work already.

Any help anyone can give would be greatly appreciated.
