I think you need to maliciously write a check to go to jail for it, otherwise everyone who overdraws on their check card would be in prison. If you're worried, ask this for his name/address as well as if he knows that threatening BS criminal charges is much more illegal than writing a bad check.

Anyway, they said I was in serious trouble. I asked them for documentation and they would not send it to me. The company is Fast Cash International and the two gentlemen are foreigners. Can they do anything. If I owe, I will pay but I need proof.

They can not charge you criminal charges for a debt. They owe you proof of your debt. First off you need to start filing complaints with the BBB, Attorney General, FTC, and www.ic3.gov. What ever you do, do not agrue with them. Just hang up. I would also suggest keep a log of the calls. If you can find the address, email or fax do a Cease and Desist letter and get it out to them. Might not stop them but you never know

I received a call yesterday from a company working for CheckN go where myself and my husband took out payday loans. They told me that it was a felony for a husband and wife to take out a loan with the same company. I live in FL, they told me that if I didn't make any payment that they where going to arrest us both and not ask for bail. Since the two loans together equal $1100.00 they would also charge us with grand larceny. My husband just started working after being laid off for two years. I don't know if this was a scam but if it was illegal to give a husband and wife loans, then why did they do that? When I called the number this moring all I get is a recorded message but it doesn't give the companies name, what do I do? They told me if I missed a payment good luck.

I had a collector contact me today trying to collect on a payday loan. I believe the initial loan was $300 & they want to collect over $500. After some dialogue w/ the collector he became rude and said the option to pay $500 is now waived and he is now goin to collect a total amount of over $1000. He proceeded to call me broke and ask why I got the loan if I cldnt repay it. I asked him for original documents and he basically danced around it. After he hung up I called back a couple times attempting to get contact info to send a certified letter and neither rep wanted to give me an address. Eventually a rep put a supervisor on the line who also declined to give me an address. The funny thing is when I became aggressive and started asking the questions they suddenly didn't want to talk anymore and even asked why I kept calling back.lol. I also recorded the convo and he said I had to have permission to do so. Who cares...

They aren't worth getting upset over, if they refuse to give you an address to send payments, it's their problem.

I have been threatened that I would be seved at work with papers. I have even had them tell me I needed to appear in court the next day with my lawyer. Every payday loan that I have had I paid off. How can I stop them from callin.g I have already changed my cell number but the keep calling me at work but the refuse to leave a message.

I really doubt if you can actually stop them from calling, however, if you refuse to talk to them and simply hang up they will tire sooner of talking to thin air rather then someone to argue with.

I have dealt with "Roger" and "Jason Fox" at this 646-736-0577. Roger says it's Cox Inc (a conveniently ambiguous name...as are the American names these scammers use). When I received a threatening voice mail message, I could hear others in the background leaving the exact same message to others! They claim to be filing a lawsuit with Payday US or USA Payday...they can't make up their mind. They use a lame script that refers to my location at "the state you are in". I actually questioned Roger if he knew what state I was in. He got so flustered because he didn't speak English well enough to understand the the question, that he had to hand the phone to Jason Fox.
Bottom line...NEVER give (or confirm) information over the phone. File an Identity Theft complaint with the FTC and your state's Attorney General's office. The phone numbers are fake and purchased by bulk from major phone companies. The numbers can't be tracked because the phone companies won't demand verifiable information and most of the numbers are actually attached to phones located in the West Indies (via phone cards) and are most likely in the Bahamas where there is little financial regulation. If they have your bank info, talk to the bank manager about the ID theft and close your account. Tell your phone company the same thing and they may wave the phone number changing fee. Once you get a file number with the FTC complaint, make sure your local police department has it too.
If enough people put pressure on their State Representatives, we can gets laws to force phone companies to verify the phone numbers sales and put a stop to the scamming. It's sad to think how many people pay these criminals because they are scared and don't know any better.

The problem occurred when I attempted to contacted companies that were drawing automatically from my account. Contacting my utility company was easy, but when I tried to track the payday loan companies that I was paying back I had a time, since most of the payday loans have similiar names and I had about 2 or 3 going at one time. I have been using payday loans for years prior to this incident and never had a problem paying them back. In October I started receiving call from a company- persons calling with a accent and addressing themselves as sargeants and tellling me the same as the posts above. "You are going to be served with court papers if you do not pay this loan, you will never be able to write checks again,court papers are going to be filed tomorrow". I have cussed a plenty of these people out. I think since October I have paid a total of $4000 to these companies. It's like as soon as a pay one off, another calls immediately after. I just finished paying 976.00 to a company last week and yesterday another company called with the same line,"this is regarding a legal matter, court papers are getting ready to be filed in your state". The part that gets me is that when I ask them for something in writing, they cannot provide me with anything, but yet I am required to write them a letter authorizing them to take my money. What kind of mess is that? A company that cannot even provide a standard letter to the consumer? These payloans need to be put out of business. Further more, I do not beleive these companies that they are using to collect the debt are even in the US even if they do provide a number that is in the states. And what is the chance of all these companies all having employees, including the directors or managers and everyone speaks broken english????

The problem is that in a effort to avoid going into a storefront PDL or due to the legality of PDL's in your state, you went online. Borrowing from a PDL online opens up an enprmous amount of issues as you are now aware. This is like the Wild West, no regulations or responsibility. Based on what you have stated, it sounds like you had loans with companies that did not carry a license in your state and then sold your past due account to a collection agency that was not licensed in your state. The issue is that you can report this to anyone and everyone, but they will not be able to help you because of the inability to locate the anonymous company or if they can find them, jurisdiction issues with them being based outside of the USA.
Unfortunately, hindsight is 20/20 and you cannot change what took place in the past. You must formulate a plan to move forward and there are many on here that can assist.
Regarding your last comment about putting all PDL's out of business, that would be a mistake. All that eliminating the legal lenders will do is to drive more good people to the very ones on the internet that are harassing you. Would you wish this on your worst enemy knowing what you know now?

I had also done some research on the company, (after agreeing to the loan) and noticed quite a few rip off reports about their bad debt collection practices and ridiculous fees. They continued to debit my bank account, which eventually got charged off. Now, a year later (or all year long, should I say), they've been sending me threatening emails. They never agree to send anything through regular mail, and the most recent email I received says my balance is now $652 and if I don't pay, they will use an "E-Check Recovery" service, which scans my social security number for ANY United States bank account, and that they will go in without my permission to debit the full balance of the loan. First, I live in PA, and I know that a debt collector can't charge me more than a certain percentage in interest. But can they legally do this e-check thing?

right on target ohiogal1.in fact the law requires that once initial contact is complete.a dunning letter must be sent within 5 days.again it is part of the FDCPA.as far as validation.only in texas has a hard deadline of 30days.if the collector can't or doesn't validate in that time.they must cease all collection efforts entirely.

I too am like the many on hear who have made the mistake of borrowing from payday loans by both storefronts and internet. My last was in 2006. I have paid most of them back and the few left are really harrassing me. I would like to take care of the rest but these collection folks will not work with me. I will try what has been mentioned in the forum by contacting an attorney. I don't mind them calling my cell but to call my job and leave embarrassing messages is another thing. They also use an automated service to do this. Can I file these messages with the attorney general? If they are calling my friends and family they have been kind enough to ignore them and not let me know. I have learned a good although I must say that those who let me pay them back were very nice and took my monthly payments with no other harrassments. One even said I paid them too much back. But again this was back in 2007.

I have dealt with a man calling from Ace Cash threatening to "proceed with the necessary action" and refusing to accept my payments even though I told him of a job loss and decreased household income. They are not nice at the corporate level either. All of my other creditors are working with me under the circumstances but not ACE. I will continue to make payments online to try to remedy this situation but is there anything else I can do in the mean time?

Once I told them that I have never heard of this company she asked could someone else have used my info, I told her, that might be possible. First of all, NEVER admit to owing a debt to a voice on the phone! I wouldn't do anything until I received a letter of collection via the mail. A process server just shows up at your door with a summons, they certainly wouldn't call in advance. It sound very scammy to me.

I actually got the same type of call this week. I decided to have some fun with it as I could tell it was one of these calls.
Call kind of goes like this... I get a call from someone with a heavy middle eastern accent... His name is Dan Richardson.. (really, that is a first for me. ) So he says something that I can barely understand and then tells me to hold. So i hold. then a guy named Adam Chandler gets on the phone and claims to be a Senior Attorney from some place called Federal something or other.
He tells me that I am being investigated for four counts of federal wire fraud due to not paying back my Payday loan and that the Marshall's will be coming to get me if I don't take care of this. So I then inform him that if the Marshall's were already coming to get me than this conversation is a moot point because once an arrest warrant has been issued it can only be retracted by a judge. So he then tells me I need to pay this or i will get sued on my original $350 and it will balloon to $5,210. So I then told him that $350 in MD was a small claims court case and the fees would never go that high. I guess now he is getting flustered and asks for someone named Eric who has been listening on the line. He tells eric to get the investigators out to my house. I aksed him if they could come soon as I was leaving on vacation. He didnt' like that.
So I decided to do some research of my own while he was on the phone. I asked for his name again. He told me. Adam Chandler. Then I asked what his position was he told me Sr. Attorney. So I then asked what state he was in. He told me Texas, which was weird cause he called from a California number. I went to the Texas Bar website and looked him up. He wasn't there. .I told him that and he said it was because he was really in CA and was just visiting an office in TX. I then looked him up in CA. Not there either. I told him this and then informed him that it was against the law to pretend to be an attorney to collect a debt. He then hung up on me...
I did get a call back a day later from the middle eastern guy saying that I needed to call them back or all he could tell me was good luck for what was about to happen.
Had they called me a few years ago, they may have gotten me. But I have seen way to many scams out there now.
Also what I thought was weird is when I asked the name of the PayDay Loan company. He said he could not give that to me until I had paid the money. And he could not give me written confirmation of the debt. But since he gave me the original amount I knew what company it was. And I had just worked out a payment to the original company to pay back the loan amount without fees or interest a few days before they called.

I advised him I could pay the loan in a few weeks, he said it was today or he was moving forward with this 'process'. He mentioned garnishing wages. I checked and it looks like in TX he will not be able to do this. I He scared the crap out of my mother and she will be giving me the money to pay but that won't be until next week. Does anyone have any additional information that I need to know. I mean if I wait till next week to make this payment, can he still file civil charges? If payment is made that won't hold up in court right? These people just want there money right, so court is a last resort? How long before I get a hit on my telecheck status, as I have been told this is really the main repercussion? I was also advised to advise him I can only pay a certain portion of loan, and see if he will settle other wise he will have to wait for full payment. Will that be sufficient?
