The CA is also bound to follow the fdcpa laws. Once they receive your dispute letter and the cease and desist request, they are not allowed to call you anymore. The debt will be reported negatively in your credit but they can't sue you for not paying it.

Being beyond the SOL simply means that you can no longer be sued or threatened with suit regarding this account. If they should file suit, your defense in court is simply that the account is beyond the SOL. Case dismissed. You can confirm the date of last activity from your credit report, or, if you feel they have reported an incorrect date, send a DV letter (certified, return receipt). Collection activity must be halted until they provide verification of the debt. If it is beyond the SOL, tell them so, then tell them to go away and leave you alone. They may sell the account to another CA and you'll go through the same thing again.

AMP not being courteous - they're awful. Tried to collect $7,000.00 from me on a debt actually owed of $2,152.00. Offered to settle for $5,000.00. When I said I would not oay more than I owed I was told they would "begin the process we must do at our office". Then they put Helen DeColon on the phone who screamed at me and called me names for 10 minutes. I hung up on her without getting a word in edgewise.

I knew I did not owe them anything and I contacted the BBB and today I got a reply from Capital One saying they had no accounts in my name and that I owe them nothing. This company threatened to report me to the Credit Reporting companies, but I pulled up all 3 of my reports and they show no negative reports and no delinquent payments. All accounts say open/never late. This is another scam outfit. Go to the BBB if you are sure that you owe nothing, and report violations to the FTC immediately.

This company repeatedly calls my number asking for someone I've never heard of. This is not merely someone not at the number, it's someone I've never heard of. I've had the phone number over five years, so it's not as though a previous person who had my number should be the one getting the calls. They always play a recording, there's never a human being when the call starts to get my permission to play a recording. The recording says that the person named should call (888) 355-7515 but they give no option for anyone else. It's been call after call after call from them -- what should they care, it costs practically nothing to place a call.

Cease and desist
Write them a cease and desist letter....they are a 3'rd party collection agency that probably bought the debt from the bank. I have used this successfully in the past with collection agency's and even Attorney's who act as collection agency's. If you google -search "Cease and Desist" letter's you will get samples of these letters which you then send to the agency certified with a return-receipt. If the letter is worded correctly they can't even put anything negative on your credit history. Under Federal Law you don't have to work with collection agency's. Your business is with the original creditor in your case the bank.
