Can online payday loan companies garnish your paycheck. I have 7 outstanding and want to get out of them and the only way is to close my account, call them and set up payment arrangements.They say that if you signed you are bound by the laws in their state. They don't say they will garnish my check but I was wondering if they would. Please let me know what I can do.

I have a loan with Cash Net and they have sent it to collecgtions now with Tri Financial whom keeps calling me at work, they want $350.00 now or they will be taking me to court for $650.00, I live in Minnesota, can they take me to court for this?

I have several online and store front loans..PLS, Check into Cash, Check n Go, Cashnet USA, Cash Transfer, and 1000 cash. I live in WI. I am thinking of doing a paydayloan debt consolidaiton with Destination Debt SOlutions? Anyone heard of them? I have also signed a wage assigment with Cash Transfer. 200 loan paid 312 then have the 200 again and I am affriad this time they will do a wage assignment since I did not have money to pay them last week? Any thoughts...feeling desperate..hate the phone calls but want to get all of these behind me soon....

First, revoke the wage assignment ASAP!. You can do that with your HR/payroll dept. The assignment is voluntary and can be revoked at anytime.

CashNet USA, Check into cash and Check n go are legal.

Cash Transfer is not.

My best advice is to close you checking account and then contact the legal lenders and make payment arrangments.

Does anyone know if PayDay One is legal I am in Texas.
Also what about CashNet USA I know you said its legal. I just can't handle this anymore.
I am closing my checking account on Friday and canceling my direct deposit.
I will also be faxing a Wage Assignment thingy to revoke.
What is my next step??
I want to do this right

This company does business as L&M Financial..International Payment services based in maryland as well in Virgin nIslands.. I borrowed 300 and have paid back over 800 so far.. I have closed my checking account and they have placed a wage assignment with my employer.. I live in NY .. my emp,oyer has started deducting 25% of my pay.. I found out the nt. rate465%... does nay one know if this is legal and do I have any legal recourse.. can any one provide any laws pertaining to pdl in NY

pdl's are prohibited in NY and this is an illegal pdl.if your employer granted a wage assignment let them know this is an illegal pdl lender.wgae asdsignments require an actual signature.not an e-sign.let your HR person know this.

I took out eight pdl's. I live in new york and i recently found out they are illegal in ny. I was wondering what should be my next step. The companies i took out the loans with were:
Sandpoint capital
Paycheck today
Webpay day
Impact USA
midland financial
cash advance network
tremont financial

Hey everyone, I have the following loans

WebPayDay
Loan Shop
National Pay Day Loan
Sandpoint Capital
SSM Group LLC
US Fast Cash
United Cash Loans
High Country Loans

I know that PDLs are prohibited in NC but I was wondering if any of these are actually legal. I am going to be doing a letter for revoking any wage garnishment plus phone calls shortly. Is there any other advice you can give me?

How the heck can they do that if they are illegal? What is likelihood of them trying this if you call them out when you stop paying them on their illegal status and have paid back exactly what you borrowed or more? This is the stuff that scares the cr*p out of me..... I want to fight them but though heck if they are illegal they'd never contact my employer about wage garnishment if I fight them up front? Any experiences / advice?

One last question....If you don't have wage assignments but are worried about them trying it (as EDT329's post has scared bjeezy out of me) -

should you contact payroll or if in your letter you said you are revoking their right ot call you or contact your employer, yadayadayada....is that prob enough?

i had a loan from 11 months ago that i was making payments on and had to close my bank acct. i haven't made any payments for over 6 months. do they then send it over to collections? i tried to cash a money order from usps there yesterday and they refused to give it back and took 25% of it to go towards them and took half of my $ against my will. they didnt give me any receipt or paperwork showing a payment towards the loan, just a regular check cashing receipt that shows the money order and a returned item payment. is this even legal? i live in tucson az?

I'm in a complete disaster because of my wife (who I am now divorcing) and a series of financial mishaps. Since September I have to repeatedly take out between one and three pdls. The companies are:

CashNetUSA ($300)
MyPayDayLoan.com ($600)
East Side Lenders ($1000)

I have every intention of paying these off, but I can't have them keep taking the money out of my bank account. I'm in CA.

My questions are:

1) Even if the contract states that I can't revoke the ACH authorization, can I still do so?

2) My understanding is that I revoke the ACH authorization, close the bank account and reopen a new one? Is that correct?

3) What are the possible consequences of doing so? Just collections? How can I tell if they can (or will) garnish my wages?

Took out a loan with Ace Cash Express in TX, and for certaqin reason have been unable to pay off the entire loan and have fallen behind on payments,can an ace credit services in TX garnish my wages? They call and say that if I dont pay them by a certain date that they will garnish my wages.What can I do,please help

lisha-MyCashNow is not a legal licensed company-so they can call you but thats about it-that can't sue you. My best advice is don't answer the phone when they call. The more you talk with them the more they will call you.

Guest-storefronts are going to be legal. Please list what internet pdl you have and we can help you sort which ones are legal, if any.

I'm looking for help in TEXAS. i have three payday loans - two of which are the same company and they are threatening to garnish wages - to serve me at work. i don't know what a wage assignment is. the only thing i signed was the payment agreement. i couldn't close my bank account because it had already started bouncing my account. i need to pay the bank back. but i can't until they stop trying to contact the bank. i've had this happen to me once before, but they just sent collections after me and it wasn't bad at all. this time they are getting ugly. please help. what can i do?

I have about 7 loans here all payday loans from companies here in LV.

Rapid cash.
Money Tree.
Check city.
Ace cash express.
Cash 1.
Payday Ave.
Cash Land.

I need to know what i can do to work with them. & can they garnish my check?
I have told a couple of these companies to stop calling my work.. did some reading & saw that maybe i should do it by writing? I need them to stop calling my work, it is very embarrassing & also the few friends. I have a $565.00 loan with rapid cash & I've paid them 8 times at 100.00 each time & that was just interest alone, nothing went to the principle. Please help!!! =]

yes, i did ask them to stop calling my work & some of them are still calling. this one loan i just recently talked to.. i told her to stop calling my work, because she can get me fired. & she told me that if she can't get ahold of me she has to call me at work. i told her i would call her but still haven't. tomorrow i will call each one & ask them how much was borrowed & how much have i paid back so you can help me better. thank you so much! i really appreciate it. i will break you off a lil some some if they go to far & i have to file a case l0l. =]

I am currently having the same problems, pls keeps calling me, my family and friends! They said they were going to turn in my settlement to garnish if I don't pay off or make any payments soon. But they lady said that it was going to be $399 to get me back on track and to not be garnished if this was paid by the end of the month. But then I told her I only can come up with about 200 and then she said great! lets do 200......now the question is, is this lady lying or is she serious because if 399 will get me out the whole, then they wouldnt be accepting anything less. Right? What I want to know is, can the state of Illinois garnish income tax refunds? Because I have been waiting and waiting for my refund and it hasnt come yet. It has never taken this long and the irs told me that I wasnt having any problems, everything is still processing. I dont know if to believe them or not, will they tell you if you are being garnished? And will Pls garnish my refunds/payments without me signing anything? I need answers, Im worrying myself to death!

pdl's can't garnish without a court order.they especially can't garnish tax refunds.since internet pdl's need a license to lend in illinois was this an internet pdl?if so how much was borrowed,and how much was debited total.you might owe little if anything.please answer those questions,but know this a pdl has to get a court order.that means they take you to court,sue and win.anyplace that says otherwise is lying.i personally wouldn't agree to anything over the phone.get it in writing first.that is if you owe them anything.

since all pdl's are prohibited in NC.there is not alot they can,or will do.did you receive a dunning letter?if not what number comes up on caller id?it could be a scam that got your info illegaly.i'm stating the first part as even if you did get a loan and indeed had 6 nsf's from ACH.they can't do squat as pdl's are prohibited in NC.

I was sold on the opportunity that people were making lots of money with this company and it turns out that the consumer is not the only ones being shafted so are the employees. Every check that I recieved was short. This last check was short 615.25 and I was told that they made a decision mid pay period that they could no longer pay me at the rate we agreed. THEY ARE COLLECTORS THAT WORK FROM HOME WITH NO TRAINING ON WHAT THEY ARE CALLING YOU ABOUT AND AND VIOLATING JUST ABOUT EVERY STATUE OF THE FDCPA. I really need help and advice! I do not know what to do!!!

I had payday loans with:
Nationwide Cash
Vince Enterprises
Loan Shop
Hushawk Group
SDS

I live in NC.
I was tired of loosing my every paycheck just for the rollover fees, so I closed my account and started over. I have not paid these loans.

Now I am getting calls from I think so-called lawyers, collection agencies, threatning me with all kinds of stuff, told my boss they were on the way to pick me up to take me to jail, all the way to calling my grandfather and telling him they were going to take him to court and get the money from him. It drives me crazy, they are rude and will not work! they say pay or you are going to jail. I get like 10 calls a day. It worries me to almost getting sick. I dont know what to do anymore. Do I call them back and pay or do I ignore them. Advice please!!! What can they do to me?

I have 9payday loans out. No one has garnished yet,but they are threatening me and harrassing me all types of the night(well until9). however, before they send any judgement against me should I type a letter stating I revoke any wage assignment or should I wait until further action is taken?

I'm being contacted from Cambridge and Huxley on a payday loan I took out with CashNetUSA. I'm from Colorado by the way. I took the loan out on June of 09. They are calling stating they are filing a petition against me in my county if I don't pay. I gave them my debit card information, but after reading about these tactics I didn't put money on my card. I called the company that bought the loan from CashNetUSA and left a message. Can I get some advice here. I did not sign a wage assignment agreement.

My first bit of advice is; NEVER NEVER admit to owing a debt to a voice on the phone, it could be ANYone! I am glad that you stopped the payment to them, because they are obviously a 3rd party collector and that means the FDCPA applies to them, so, they are required to follow the FDCPA but obviously they aren't. You can google FDCPA for a better understanding of it.

Per the FDCPA, this collection agency is required (this is a federal law) to send you a letter of collection via the mail within 5 days of their first initial contact with you, when and IF you receive this letter of collection via the mail you will have 30 days to request they validate this debt (sample debt validation letters are on this website), to be sent to them certified mail with a return receipt requested (no other way will do). But for now, I would tell them you can NOT and WILL not discuss an alleged debt over the phone, then quote the FDCPA to them as stated above and hang up. If they continue to call you, file a complaint with the FTC (a link is in my signature). Keep us posted!

I live in IL and have outstanding payday loans with the following companies:
ZipPayday
Magnum
Ameriloan
CashNetUSA
SpeedyCash.

Do any of these companies use the wage garnishment thing and how long does it take before it happens? I just closed my bank accts from then 2 weeks ago!! AM I too late to send them a letter? I'll get the one sent to my HR and Payroll dept.

If I live in Michigan and work in Indiana. I have several payday loans out and have signed up with a company called Pay Day loan Debt Solutions, Inc. They were supposed to contact all my lenders but I am still getting calls at work. Do you know anything about this company? They have taken 2 payments out of my checking account.

It depends on the payday lenders you have, if they are Internet lenders they are most likely not even legal, which means illegal lenders do not negotiate.

I had 8 internet payday loans and 2 storefront loans. I checked into a couple of Payday debt solution companies to help me. One company wanted $1,600 in fees alone and the other $1,800 in fees. Why pay someone to do something you can do yourself? The $1,600-$1,800 that I would have paid a company to help me, I have put toward paying off my loans. Through research, advice from this forum, I am now down to 3 internet loans and 2 storefronts. By February 2011, I will be completely out of this mess.
