The Modoc Tribal offices.
Could this business be assocaited and/or housed with the Modoc Tribe of Indians?
The address is also listed for Miami Nation Cultural Preservation! This is starting to piece togerther.

Items to note:

'Oklahoma credit regulators have also issued a cease and desist order against the company. The lender reportedly claims that it is operated by the Modoc Indian Tribe, and is therefore sovereign and exempt from the consumer protection laws of any state.'

The next paragraph explains why they cant claim sovereign state: although they are an Indian tribe; they entered into these contracts with us knowing we live in other states and then arranged to deduct funds from our banking accounts in other states.

The payday lenders claimed that they are subdivisions of a federally recognized Indian tribe and, therefore, have sovereign immunity. However, they never provided any documents to show any affiliation with Indian tribes. The trial court rejected their claim of sovereign immunity and ordered them to produce the documents. The payday lenders appealed.

Nope, not a word about "Indians", "Modoc", or "Sovereign" anything!!!

I talked to Brad at the Oklahoma AG's office today and he said they're so full of it about the Indian thing. That only applies if you loan to other Indian/Tribal Members ON your land. If you loan to NON-Indian/Tribal members (and they are out of the state especially) then you give up any Sovereignty (sp?) and are gonna be nailed as an Unlicensed Company in violation of STATE laws!

I have a PDL with MTE Financial dba Quickest-Cash-Advance. I went to the website and found the Legal Disclosures.

What I get out of this, is they have to follow Federal Laws and the laws of where they are located. If they are located in OK, shouldn't they have to follow OK's laws? I didn't read anything about the Modoc Indian Tribe. This is soooo Confusing.

This is actually ON their Account Summary papers, the ones they send you whenever you pay down or "renew" your Loan.

Ive been researching a few things - curiosity more then anything.

There was a posting in an Indian law review on line. There was a sentence that read 'sovereign immunity is not always a blessing. When seeking non-tribal business, contract must explicitly address the question of immunity'.
I dont see any mention of that above - do you?!

Another item:
In Kiowa Tribe of Oklahoma v. Manufacturing Technologies, Inc. the (US) Supreme Court decided for soverign to be invalid (the) Tribe has to waive its immunity. In the contract that existed between this company & the Kiowa Tribe there was an arbitration clause. The Supreme Court decided by signing a contract containing an arbitration clause, the tribe clearly waived its immunity.
Arbitration clause = waiver of sovereign immunity.
Refer them to item # 8 of their own contract !

Let us not forget that THEY drafted the agreement not us.

Thru various posts on this forum the state of OK is all over them. However the more we educate ourselves the less likely we are to get rattled when they fire off their vile thru calls & emails. And we can help newbies to the site.

As I stumble across this info - Im amusing myself! Ive had some pretty good laughs at their expense.

I recently got a loan from mte financial and have ready some pretty scary things about them. I would like to know if there is anything i can do about the loan i got that is about to come due the 12th of this month to stop them from taking extra money from my account. Thanks i have no information for these people , i was told i would get that all via email and got nothing.
