I just received a call from a Mr. Robert Beckner calling about my LVNV funding account. I received a call last month from Northstar Group which is a collection agency that refuses to state they are. I requested validation from them and it was reassigned to this law office. They have threatened to sue me. Guess it's time for my to get a attorney on retain. Kinda worried but I think I got this in the bag. In late April this year I called requesting validation and told them I would pay it in full upon receipt of validation, I had more than enough at the time to do so. If they couldn't validate then when they had someone that could pay in full they won't be able to do it in discovery.

Time to arm my legal anti air guns and go hunting for wabbits.


Any legal advice will be nice too, the more information I have going into this the better. Information is ammunition.

Also I am going to check with my state Bar association to see if this Mr. Beckner is licensed to practice law here. They also have 30 days to follow through and 5 days to send me a dunning letter.

Law student is right- WW&r usually handle it. I dealt with them-wrote them a debt validation request, along with the many regualtions that LVNV funding has broken--and they passed it to another agency!

You said they have 30 days--do you live in Texas or one of the other states that limit this to 30 days?

If they do sent you a DV, it will probably be a computer generated paper saying when the last payment was, the balance and they own it--nothing more--I told them a 3rd grader could have written that up fro all I knew!!

You are right- they don't like you to be educated in the area of debt or know your rights!

Sorry bud, but that's just too funny. Sounds to me like it sucks to be them. Keep us posted, please. I and others are following this thread closely.

Look at your states legislation website. You have to go through each of the chapter titles to find the one concerning consumer law. Then you have to go through that chapters headers to find the one that corresponds to what your searching for.

I got their dunning letter in the mail today, it had a list of their attorneys. None of which are licensed to practice law in my state. Uh oh, for them that is. lol The reason that is, is thus: When you are a attorney specializing in debt collection and are acting as a debt collector and you contact a person by mail using your firms letter head or contact a debtor by phone using your firms name. You are practicing law, in order for you to practice law in a state you must be licensed to do so. They are not.

Here is an email that I just sent resurgent:

I have already requested validation of this account through Weltman Weinberg and Reis, through LVNV funding previously, through Northstar group, and now through Hannah and associates.

Continue to play these shell games with me and I will have no recourse but to file complaints with the Federal Trade Commission, the Attorney General's offices of the respected states in which each of these agencies are located in as well as state/county Bar Associations where applicable. In addition I have also noted several purposely misreported entries on my credit report. I have full intent to pursue civil suit for each of these if you continue these blatant violations of state and federal law.

All I can say is if they want to file suit against me, bring it on! I'll get it dismissed because they will not be able to show cause when I request validation during discovery and I'll counter sue for $15,000 in statutory damages plus punitive damages, attorney fees, and court costs.
