OK, for those who haven't been following, NES has been calling my house since the first of the month. To make a long story short, here are the fdcpa violations they have racked up just between 2/1 and today:
1--failure to disclose consumer rights within 5 days of initial communication
2--failure to state mini-miranda at start of calls
3--claimed that my wife was being charged with crimes of bank fraud, bank thef, and intent to defraud a financial institution(on two separate calls)
4--harassing and completely inappropriate comments made during conversation
5--refusal to validate the debt upon request and refusal to provide address so that I can send a DV letter
6--misrepresentation of the actual amount of the debt
7--misrepresenting the origination of the debt--one collector told me it is a Discover card and another told me it was a jewelry store account
8--claimed that they were suing my wife right now when they are not
9--refusal to identify company when asked during a phone conversation
There are probably one or two more that I have forgotten, but when I review the recordings I will be making more detailed notes....
All of that for a $548 debt(one of their collectors simply said "your wife's in big trouble because she owes us over $700....") that we cant even get validated...looks like they have had a busy week!! They called this morning but I didnt bother calling them back this time, I think I have had enough FDCPA violations for one week.....and yes, there will be a lawsuit filed on this. NES, if you frequent our fine forum, thanks for the payday!! We're gonna take a nice vacation on your dime!!

National Enterprise Systems
I recently worked at this horrible place. National Enterprise Systems is the collection agency from hell. It's the devil's worst nightmare. Employees are trained to collect according to the Fair Debt Collections Practices Act but once on the floor in their respective departments collectors are told to forget everything they learned.
My supervisor, Bryan Howard under the alias of Paul Stevens, regularly provided a second voice to collectors having trouble closing collections. This idiot would identify himself to callers as a federal agent, an NES attorney, etc., anything to try to scare the debtor into paying. He would actually tell debtors and their spouses that a lawsuit had been filed and if the account is not paid by postdated check by a certain time that day a deputy of the court was coming to serve the debtor on his job. I witness this on a daily basis all day long. B. Howard is neither a federal agent, attorney nor any of the other things he claims to be and NES don't sue debtors. All are clear violations of the Fair Debt Collections Practices Act.
Debtors are talked to as if they're inhuman. Even when the debtor is not home the person taking the message is treated like dirt. I will never forgot my supervisor shouting at an 81 year old African-American woman for not getting a pen and paper to take the message. "I DON'T CARE IF YOU ARE 81 YEARS OLD HE SCREAMED AT THE WOMAN." I've witness collectors hollering at kids "GO GET YOUR FATHER."
You are not supposed to talk to spouses????????in certain states--about their significant others???????? debt unless given permission by the spouse to do so. This rule is ignored at NES. In fact when I left training I put the document about the spouse rule on my cubicle wall to reference only to have it snatched and trashed by Bryan Howard who said I wouldn????????t need it.
The owners Ernest Pollack, his wife, and two sons: Scott and pie-faced Chris are well aware of what is going on. These people are hands on owners. They constantly walk the call room floors, note the individual collectors and group collection sales and hear all the violations first hand. The more a collector screams at a debtor the more they like it. People actually clap and cheer when a collector goes off on a debtor. All that concerns these greedy money grabbers is how much money they are collecting at any given time.
Payments are demanded in full although they do offer settlements that are too demanded in full. Money orders and mail-in payments are not accepted, only postdated checks over-the-phone or Western Union Transfers for Citi Bank accounts. Some other creditors do allow NES to also take payment by credit card. For the postdated checks debtors are asked to give their accounting and routing numbers. NES, the scumbags they are, attempts to take the money out before the postdate. Nice company huh!
Collectors and supervisors once provided with bank info by the debtor call banks automated customer service numbers to obtain how much money they have in their accounts. We have their social security numbers so getting info this way is like taking candy from a baby. Some banks have safeguards against this and required you talk to a live person. They also work this wickedness on debtors???????? credit card accounts or the credit card accounts of the debtors???????? spouse, mother, father, etc. I remember one collector on the phone with a debtor saying ???????Your Mother Has $7,000 On Her Card She Can Use;??????? She Can Pay This Debt For You!???????
If anyone needs someone who's "been there" in any of their legal actions against this despicable company I????????m your guy.

A man contacted my mother in law stating if she did not pay she would have to go to court next week. He then stated she had to pay $500.00 that friday then 900.00 the next friday. She explained she has been in and out of the hospital and lost her husband last year sha is trying to get everything together. Offered to make a 50.00 payment he said that was not enough so she told him she caould'nt pay 400.00 and that she would have to look at her budget and he would have to call back in a coupl of days. He then asked for her bank inforamtion so that he could get eveything ready for her so on friday when he called back all he had to do is get a dolloar amount. This monday they took 400.00 out of her account. Now she can't afford to by her med's. I did call them today and explained that it is not a choice if she takes her med's her life depends onit and to put the money back into her account. She did not give them autorization. And the lady stated well she gave him her account info. I told yes because she took him at his word that he would call back. I am filling out a complaint to the Att. General's office. I aso told them if the money is not put back into her account so that she can get her med's I will get a lawyer and they will pay for what ever happens to her because of there actions. Wish me luck.

Close this account and open a new one. Tell your mother in law to NEVER give her bank account to a CA. She also needs to send them a DV letter.

These jerks called me today at work and refused to give a name and number. I explanined I was in a meeting and the creditor started screaming on the phone. Everyone in y office heard her voice. I finally hung up and recalled the company and asked for a supervisor and got the same woman who started her screaming. A man got on the phone and claimed to be the supervisor but right away I knew he was not. He called me every name in the book and wold not let me get a word in. This creditor needs to be closed down.

All of yesterday I was on the phone with these people about how come Monday I will be served my papers to appear in court to settle my debt. They call me everyday of the week. Sometimes 6+ times a day. I had stopped answering the phone because it was ridiculous. Yesterday as I'm leaving my apt my landlord stopped me and said a lady by the name of "Rebecca" had called him and asked him if I was there. She was apparently very snappy and rude with him and even told him she needed to get a hold of me in regards of a lawsuit (hello breach of confidentiality) I called Rebecca back who told me I was being sued by them for this unpaid debt. She tried to get me to pay 14000 but later on in the conversation said I could settle right now for 7200. I told her I didnt have that kind of money and she asked if I could borrow it, I told her I couldnt. I told her I would call around and see if there was something I could do and I would call her back. I later called back after doing some research online and asked them for their address so I could sent them a debt verification letter. She said "oh you didnt get that? I can get that to you right now" I told her that would be good and if I could still have the address in case I needed to mail them something. She seemed to be dodging giving me the address because she never did instead she asked me to hold and then transfered me to someone else. I then talk to a man who told me the only payment plan they could work with me is if I paid them 3700 (25%) on the phone right now and then set up payments of $400 a month after that. I told him I couldnt do that but asked how much time I had and he said until the end of the day. I told him I was waiting for someone to call me back in regards of helping me take care of this bill and the NES rep kept saying he could conference call them in. I told him I left messages on both their phones and they would call me back as soon as they got the message. I continued to ask him if there was someway for us to work out a payment plan that I could afford but he said it was to late for that. I said that I couldnt do anything else and he then said " We'll be contacting your employer" and then hung up. Has anyone here been taken to court by NES? If they call me back I'm going to make sure to tell them I wont be saying anything until I talk to a lawyer.

NES is being sued by the Ohio Attorney General. It was just filed. Don't worry, clients are already starting to pull thier business and when the big clients do, NES will be out of business and they will be bankrupt! I am sure they will not want to be associated with a company with such a bad reputation, especially after them being sued by the state attorney general. They are being sued for $25,000 per complaint and there were over 200 to the AG!

In a perfect world, you would be correct. However, reality is different. As long as they make lots of money, the government doesn't really care. As long as they collect money, the big clients will love them.
Mann Bracken is exponentially *far* worse, and they are still in business!
While I always like to think of things turning out for the best, reality often dishes out a hard slap in the face instead.
And even when they *do* go down, they come right back again under a different name.
If they violate the FDCPA whilst collecting, you need to sue them and collect your $1,000. Even that may not slow them down. Mann Bracken has been paying out $1,000 to hundreds of wronged debtors and yet they march on. The money's too big to let a lawsuit now and then stop them.
Taking advantage of people when they're down is pure *evil*.

At first i was doubtful to deal with a collection agency but she was very helpful not rude at all I got done what I needed to do and actually paid alot less than what the balance was! I beleive her ext was 1287 so if u do have to deal with this company call her ext maybe she can help. dont know if that was maybe an alias or not but give it a try!! GOOD LUCK

hello, I have come across this website and I to have become a victim. This company called me one time and would not accept any payment terms I offered. The said if I don't pay them the amount owed, "which is not the true amount",that she would be taking me to court. She just said she was from NES appeared as if she was a lawyer. She gave me an incorrect amount which I owed to the client. I told her I did not have the amount of money she was saying I need to settle on and threatened she will be taking me to courst since I can not satisfy this. Is there anything I can do?

next time she calls tell you that until she sends something in writing that you will not talk to her again.this is a bottomfeeder that thrives on threats.this entire thread has stories sinilar to yours,and nothin was done to them.do that,and keep track of the number they call from.makes it easier to know when to do the pick up/hang up on them.

When somebody chimes in with something like that, which is totally counter not only to every honest post in the thread, but personal experiences of people I've known for years (and trust implicitly), and my own personal experience gained from helping others in this community, something ain't right. However, during that time of the threat she gave me, I ended up contacting an Attorney who handles these cases when debt collectors violate the FAIR debt collection laws. They were very interested in hearing my story. She told me they already knew about this company's practices and have been gathering complaints to file against them. The question is, can anyone give any advice if I should jump on the bandwagon. I have no idea what is going on w/NES (are they filing paper work to take me court) since they have not contacted me since the first intial contact. Any advice?

please state the validation.if it wasn't on the original creditors stationary with their logo.then they validated nothing.you can always keep tabs with your court clerk to see if any actions were filed,but again just a letter on their stationary or a letter in general doesn't cut it.

I understand this company doesn't follow all the legal rules in place that protect debtors. However, I also believe in the fact that if you can't afford it, don't buy it. Consumers are so reliant on credit and borrowing that it's replaced simple values in life like saving. I know it's rough, specially in terrible economic times but what we need to do is stop letting these credit card companys / collection agencies control our lives. I've never had a single bill put into collections and I hope to never have one.
