I read the USFastCash 'contract'...guess what. It isn't a contract, its an application. What is signed electronically is the 'privacy policy and authorization agreement. No where on the pp & ag does it state the application is part of the application..which I think the pdl feels is their contract. I work in a field where applications warrenty the contract...no verbage to that effect on their paperwork. I do see where the pp & ag paperwork does give them the right to prepare & submit a paper check..I think revocation of the paper check right should be added to the revocation of ach.
Which by the way, page 1 & 2 of the pp & ag states 'authorization becomes effective at the time we make you the loan for which you are applying and will remain in full force and effect until we have received notice of revocation from you'. This is referring to the ach debit.
Anyway..what I have here from USFastCash is an application, not a contract...I don't think the two can are combinable. Maybe someone with a law background can address this...

goudah. . I believe you are right about that. I know I did a search on the legallity of electronic signatures and they are just as valid as a written signature, BUT, most reputable businesses will require a written signature as well. I suppose one could argue the legallity of it if they only had an electronic signature.

Am I special or what I am sitting here at work and I get a call from Payday Services thanking me for being such a great customer and they would like to extend there services to me. How nice huh? so I said you must be out of your mind if you think I am going to get back into that and I politely hung up. Give me a break, they are lucky they got there money because that was one of the highest most expensive payday loans I had.

Does anyone have a way of contacting these people? The email address I used last time now says it has failed to deliver. I cannot find a phone number or anything. I borrowed $200.00 They have taken $315.00 and that does not include extention fees...

I was reading this post and was interested because it involved one of my PDL's, US Fast Cash. It seemed when the processor was involved some people were able to get PIF from US Fast Cash. Anything on this post that anyone can share? Thanks BPMQuote:

I don't argue the point, I respect what the poster had to say and I respect the poster themselves for taking the time to share. I had something to say and I said it. I really didn't need to be put down for believing what I did. There are many people on here who have "alternate" views and perspectives. It doesn't make then right or wrong, just different. They also offer different solutions. I have taken what I have read, filtered through it, decided who I would believe in and went from there. When I came here in early February I had 5 PDLs. Through the wisdom and advice on this board, I have been able to resolve 4 of them at the original amount of the loan, and as of today one below what they deposited into my account. And that my friend, was with the advice of James. I have read each and every one of James' posts, I have read and commented on his own board and I decided to "try it his way". I used his info and within less than 48 hours I have received an email from UsFastCash stating the following:

Your account is closed, your balance zero.

Subject: Intercept EFT/authorization revocation

Attached is a copy of a recent communication which has been sent to Intercept EFT regarding my account and your continued attempts to collect on an illegal loan. At this point in time, I feel that it is necessary to go beyond the boundaries of your organization to assist me in getting this resolved. I have also sent a copy of this communication to Bremer Bank, identified as the originator of the funding source. They have been notified via telephone that the communication/complaint is in the process of being delivered to their financial institution. Thank you for your attention to this matter.

I have recently spoken with your organization regarding an ACH/EFT revocation with USFastCash. I have also been in contact with Bremer Bank, which is the originator or their loans. I believe I spoke with Cindy. She was extremely helpful, sending an email to UsFastCash, as we spoke. I have not heard from them, as she indicated I would but that in it self is not a concern. They never answer requests. However, I have sent them an authorization revocation but they do not seem to be honoring that request. According to their website, they have a payment scheduled for April 30, 2008, in the amount of $90.00 I am now revoking any ACH/EFT withdrawals generated by UsFastCash, directly to you, as the third party processor. Please see the attached letter which has been sent to them repeatedly. Thank you for all your help.

So,in a nutshell, I hit them where they live and I suggest that anyone dealing with USFastCash do the same. Vist James' website, take his advice. I do believe that one by one, these theifs will be brought down to their knees. This is not heresay, I have given the proof that what I say is an effective route to stopping these slugs in their tracts. I waited to bring this to the attention of the board for just that reason. . . . I too needed proof of what I was saying. I just expect to get it so quickly. Tomorrow I am moving on to Star Advance. With just one PDL left I now have the time and the energy to hit them where they live as well. Good luck to all. And once again, many thanks to James.
