A company called MCM called me about a credit card. I admit the debt but I want to discuss what happened. A man called me and he was speaking broken English. I could not understand him and I also had a bad phone signal. So, I tell the man that I have to go and to call me back at a later time because I was also at work. He keeps talking to me and keeps trying to push a settlement offer on me. I keep telling him I have to go. So then he yells at me and says"DO YOU UNDERSTAND WHAT I AM SAYING, DO YOU UNDERSTAND CLEAR ENGLISH" that really made me mad. He could not speak clear English. Am, I wrong for being upset. Has anyone else here had that problem and what should I do about it?

I recieved a call today from Mcm Collection Agency this person called me three times on my cell phone I was at work, he claimed that it wasn't listed as a work phone but I formed him it was my cell phone. I don't even know how he got my cell phone number. The phone that he calls from shows unknown, and he also so spoke broken english and he was very persistant. The credit company he was calling about, I paid off my debt with them back in 2002 I asked for proof from their client and he told me that he did not have that information nor could he retrieve it from them. What can I do to stop the harassing phone calls he even has called me on the weekends Saturday and Sunday.

i recved a lettr frm mcm collection wanting me to:
1. A copy of any documentation that supports my dispute.
2. Cancelled Checks
3. Paid letters
4. Police reports?
5. Any other documentation to support my claim.

Isn???t it their responsibility to validate the debt and not me furnish them any information? This is the information I requested from them. It is my opinion that this is the information that they should be able to come up with if they can validate my request. It appears they cannot validate the debt and are trying to trick me into helping them.
..how do i write a responding letter to this. plse hlp me.

Send them a new DV letter stating that you have NO information on this supposed debt and that you are requesting that they provide you with proof of said debt.

That is a typical response tactic. When you write them back, inform them that you have no idea if the account is the product of identity theft since they haven't even proven this account actually exists.

They likely do not have this documentation. All they have is your name, your last known address, your phone number, your social, account number and the amount owed one an in-house document.

they pulled the same crap on me--it is their responsibility to validate the debt, dont be fooled into sending them any documentation even if you have some! Make THEM uphold THEIR end of the laws, dont do it for them.

They claim that I owe 2500 on a Providian credit card since 2003. I haven't had a Providian card since 1998. I told him he was crazy. He tried to make a settlement offer, I said, you are out of your mind, get your subsidy somewhere else. He made some threats, I quoted California Collection Law If no payment has been made on a debt then after 4 years it is uncollectable. Not only do I not owe this, but if I did, I still would not have to pay. I asked him how a 300 limit card (which it was in 1998) could now have a debt of 2500. These people are crooks. By the way can anybody tell me the contact number to mcm collections?

It got so bad with them and me I sent a letter to the BBB and to mcm collections ct office. They responded they would not contact me by phone any more about the matter but after which they still would send letters to me (bills if you want to call them that) for about 6 months with the signed "name" of "cease and desist" They gave up and sent to another DC.

They sent me letter on a bill back in 2003. I have no idea what they are talking about. Now they are calling me at work. I told them to send me proof of this bill. They said it would take 7-10 days. I said bring it on!!

they are very harrasing and just dont care.. i was able to pay $20 less then the min. amount they wanted and they wouldnt accept the $$. now they have turned it over to their "lawyers" and they want even more money.. they asked me how much i make i told them expecting ok how much are your telephone, rent, etc... they told me they dont care they want $200 a month which in no way can i afford.. they dont care about cost of living. i want to report their behavior so bad because if i didnt have a good family to talk they can seriouslly make someone want to shoot themselves. They are nasty and threatening no matter who you talk to. THEY will not take what you can afford because its not what they want.

Some guy from mcm collections called me looking for a women that does not live at my residence. I told them so and they continued to harass me. I will probably call teh state attorney general in CA on Monday and file a complaint. Does anyone here know mcm collections contact number?

Even if the statue of limitations expire.. still a debt collection agency can collect.. They cant take u to court. And also When a debt is purchase by a collection agency, if u dispute within 45 days.. burden of proof lies on company after 45 days, it lies on debtor..

I have been battling this company for months now. The call me at least three times a day starting at 7:30 in the morning. I have told them I do not live in EST, and that the debt isn't legitimate but they have an automatic dialer that has my cell phone ringing like crazy. They send these outrageous claims of settling a debt that was supposedly thousands of dollars for half the price. Its insane, even if the debt were legitimate its seven years old. Does anyone have any first hand knowledge of how to stop these calls (I have asked through my cell phone service provider)?

Is there anyway to get them to stop calling so much? I have absolutely no intention of paying them, I'm just irritated at there constant calls. I have told them that I live in the Midwest, but they continue to call at 7:30 in the morning my time (7 days a week). Each day has no less than three calls from them, five per day is typical. Doesn't this constitute harassment?

hey hi im going thru all kinds of stuff... I called them yesterday to make a somekind of payment arrangement and he was rude and wouldnt even listen to me or help me make the the arrangement... I got you need to pay this , thats it and hung on me! I saids on the paper they had sent me to call them to make payment arrangement the 17th of this month before legal action is taking... Well I did and thats what I recieved from them on the phone... So now what! ugh! I did try to exspain I lost my home, I Have 3 children , 2 with health conditions. I owe nothing. Didnt matter.

They called me about a debt, that I paid to THEM 3 years ago. The woman on the phone was rude and interrupted me over and over. I handed the phone over to my husband, who became very angry with her rude behaviour. Admittadly, I called her company crooked...She then proceeded to be VERY rude and eventually my husband hung up on her. We called back 2 x getting her each time, how does that happen??? She actually put my husband on hold after telling him to "act like an adult" and that he would stay on hold in order to "calm down." I then called back, again getting her and she then told me that she wouldnt put up with us calling her names. We at NO point called her a bad name, not in any facet. The worst I did was call her company crooked. She then accused me of saying her company "sold money." Now english wasnt her first language, her accent was very heavy and hard to understand but I didnt accuse her of selling our money. That isnt even something that is done! After giving up and paying this debt, we have dealt with it for 2 yrs, she gave me a confirm # and I asked for supervisors names, and she gave them and then HUNG UP ON ME! This is a crooked, terrible angency that will cheat people out of their money, make up debts and frighten people into paying them. I will contact the BBB and I encourage all of you to do the same.

I just got off of the phone with them and I am still crying. They told me a I was a fool and that they didn't want to hear my sad story. I offered to make monthly payment and the guy laughed at me. I am a full time student paying my way thru school and work full time. He laughed at me even more and told me that women shouldn't even be allowed to go to school. Their place is at home. I was shocked!!! I really want to pay this off, but I don't want to go thru them. I can't believe that he made me cry. I am shocked my CC company would hire someone as brutal as MCM. I'm scared to call back. Oh and did I mention that the guy I talked to was a supervisor???

I'm sorry you got that sort of treatment. But there is a bright side to it. You now know just what kind of scum these people are. So you shouldn't have a qualm when we help you jam their illegal, contemptible actions right down their throat. Gimme some information about your situation, and we'll get you started on that process.

Is this concerning a credit card debt?
What state do you live in?
When was the last time you made a charge or payment on this account?

MCM collections
These bozo's called me from INDIA!!!!!!!!! they called using broken english, I asked for someone else, she transfered me to someone named Mark Smith, who was even worse!!
GOD save the USA!!!! Dont pay them!! force MCM to keep our money here!!! USE USA PEOPLE!!!!

KEEP OUR MONEY IN THE STATES - DONT PAY COMPANIES WHO SEND OUR MONEY OVERSEAS

We hired MCM to do collections for us and we were flooded with calls from our debtors that they counldnt understand the people calling them. Turns out that they were using agents in India!!! We have since fired them and went with another company

This guy who doesn't speak English clearly and obviously doesn't understand it at all is calling me and trying to push a settlement. He calls me a couple of days before my pension check comes in and wants me to send him money. I told him that my old bills are in storage and that I would like to look at them before I discuss my bill with him. He tells me to send him money I don't need to see my old bill. He says I closed my account in 2004, then asks me why I am continuing to use the credit card. I don't even have the credit card. I have been a victim of ID theft in the past and believe I may be again, but he just keeps telling me to send money now. I told him that I am on a limited income and he says to bad send money. I hung up on him and he called me back telling me it would do no good to hang up on him. I don't know this guy from Adam and he wants me to send him money.

I was called twice by mcm. and the first time the man on the other end was very rude. He told me they could make me pay the money and that thye could do it in a weeks time. He wasn't trying to listen to a word i was saying concerning the account. Neither would he answer any question i was able to ask. I was glad my phone died when it did. The second time they were a little better but stilll could not prove to me that i owed the debt that i know i do not owe.

If you hear from then again stand your ground sweety. The second time they called me, i don't know who i talked to but he knew better, he wwatched his tone, did not raise his voice and understood that i wasn't joking. I too am working , going to school , am the only provider for my home and have a baby due in 3 mths. I told them until they can send me papers proving i owed them what they say i do then they have no reason to call me, He replied "we will be calling back", i said that's fine and you'lll hear the same thing again, and hung up. Don't let idiots get to you.

These people are a real nuisance! They call my cell as often as 6 times a day, 7 days a week & as late as 10:30 in the evening. At this point, even if I HAD the money to pay what they want I wouldn't because it would put some phone collection person out of a job! Whenever they call now & I'm near the phone, I like to just pick it up but not answer so a person has to get involved & they can't just robo-dial.

I received a really harrassing phone call from MCM about a Visa collection and it wasn't even mine. The caller was very rude and asked, "if I was sure who I said I was"?
A real idiot. I called the manager about it and am reporting them to the BBB.

I;ve lived in my house 45 years, same phone. My husband and I live here and don't owe anyone a thing. I keep getting collection calls from a guy with a broken accent asking for a woman with a completely different name from ours. I tell him there is no one at this address by that name but it continues. I am really beginning to lose my sense ofhumor about it. How can I stop this? Once you say "You have the wrong number", that should be the END of it.

You need to get the address and send them a cease and desist letter stating the person they are looking for does not reside at that phone number nor has that person ever had that phone number. Tell them if they ignore the cease and desist you will be forced to consult with an attorney to see if suit should be filed for violations of the TCPA (telephone consumer protection act) which I think is $1,500 PER phone call.

Keep track of all of these calls and if you do send the letter and they continue to call, consult with an attorney at NACA.net.

Midland is widely regarded as a prime example of how not to run a collection agency. They've established quite a track record over the years, including pretty much every dirty trick and shady tactic in collections.

Customize my template above to fit your circumstances, and send it to them certified mail, return receipt requested. They'll take a certified letter a little more seriously than first class mail, and the return receipt card will provide you with legal proof that they got your letter, should you ever need it. Don't sign the letter, just type your name at the bottom. Don't give Midland a sample of your signature. They've been known to copy signatures onto other documents entirely.

If they don't knock off the phone calls after they get your letter, please post back. One of us will be happy to assist you further.

I received a similar call. When I asked who the caller was and what he wanted I was told, "Don't ask so many questions". I had a right to know who was calling an what they wanted. The caller finally said that he represented MCM. My suggestion is do not call me again.

I recieved a phone call from MCM they were trying to collect on a debt thats over ten yrs old. I've stablished good credit and own a home and vehicle, he threatend to put that collection on my credit report, can they do that? is my credit report or score going to be affectved?. I've looked at my report from time to time and never see this COLLECTION they are talking about.....any answaers will help

If it has been more than 7.6 years since a payment was made, they cannot put it on your credit report....Most likely they are just scaring you into paying, don't fall for it.

What state are you in? While it may be past the time for credit reporting, the statute of limitations to collect varies by state. some states are 3 years some can go 10 years.

Once you find out the debt is out of statute, then you send the debt collector a cease and desist letter telling them to never contact you again and that if any information is placed on your credit report, you will contact your attorney to see if a lawsuit should be filed.

If they try to sue you on a time barred debt, you can counter sue them for violating the FDCPAct plus have their claim thrown out...they pay you and your attorney.

I am in california thanks for the advice. I recieved a second phone call from them at which poit I asked then to give me name adress phone numbers and dates of such debt. once he gave me all of that I told him to please not to call me again. I have not recieved a phone call since but I did recieved a letter which i ignored. I am still a little timid about a ten yr old debt to be put on my credit report. but its probably just a scare tactic like you said....

If the debt is over six years old "from the date of the first reporting", they CANNOT collect. They can try.. but the statute of limitations runs at six years. Any burden of proof of the debt MUST be made by the collection agency/attorney wanting to collect on the debt. They cannot call you more than twice in one week. They cannot call your work if you write to them and tell them not to call. They cannot call you after 9 p.m. or before 8 a.m. These provisions were put in place by the government (Trade Commission)to keep idiot collectors from doing what they love to do best - harass! And the poster who said the lawyer doesn't have the right to jack up the price... hate to burst your bubble but yes they can. They can tack on the interest over the years. It happened to me, just before the six year statute of limitations ran - a $5K debt suddenly became almost $12K. I filed bankruptcy. Shut 'em down real quick. They got nothing.

I had gotten a called from Tanya of the MCM collection Company. She had varified my name and the last four of my social but the card and information did not belong to me.
She told me to contact the police of the bogust information. How on earth am I to go to the police just on say so and wrong information she had told me wasn't in detail. I never had any credit cards in 2001, I never had any credit card to a limit of $3,000.00 or more not even to $700.00 limit since the 90's. I told her she had called my job and to give me a number to call her back. Her reply was I am trying to help you, what kind of payment plan do you want? How is she helping me when the information is not mine! I need to know who to report this too......

you do report this to the police.her phone calls i mean.if it's not on your CR then it doesn't exist.she probably got your name from the phone book.report her to your AG as well.
