I think you're talking about a collection agency with whom you tried to negotiate for settling the debt. Have they already sued you? If not, then let me tell you that it is a common practice of a collection agency to threaten a debtor by saying that they'll sue him.
Now, to start with, have you send them a debt validation letter? If not then please send it. You can get an idea to write a DV letter from these sample letters .
If they can't validate then send a cease and delete letter to them and also dispute wrong reporting to the credit bureau for removing it.
