I just had a shouting match with these people today. They threatened legal action, brought up bills of mine that have nothing to do with them, brought up my credit situation, told me I never pay my bills and were down right condisending and rude to me. I tried to make other arrangements with them, but no matter what I said, they would not accept it. They are constantly harrassing me at home and at work. I want it to stop, and I dont know what to do. I refuse to give them any of my checking information. What can I do?????


Yes, National Enterprise Systems (NES) has a bad customer report in our forum. The first thing you can do is send a debt validation letter to them. You can also follow the steps said in this post.

I am currently in the process of winning my case against this CA. They called my house threatening to have my wife arrested, claiming she owed two different amounts on the same debt, and generally screwed up all over the place when it comes to the law. They are clueless about the FDCPA--either that or they dont care if they break the law or not.

Yes, skydivr7673, please do keep us posted. It's always good to hear when a debtor, that has been harassed and abused by a CA violating the fdcpa, turns the tables on them.

to the original posted, I would definitely send out a debt validation/partial cease and desist letter STAT. I put the fact you don't want them contacting you at work in BOLD letters so they get the message. Send it certified mail/return receipt requested so they have to sign for it and you get proof they received it.

I can tell you, these people are a NIGHTMARE. They called my husbands place of employment repeatedly after they were told he couldn't receive calls at work. They threatened criminal charges for Theft of Services.

Then when I called and talked to someone and told them about all the fair debt collection laws they broke, the response I got was "so because an employee broke some rules your not gonna pay a debt, this is a refusal to pay then right?" but it was SHOUTED in my ear.

Best of luck dealing with these people. They demanded $5,000 in 30 days from me. I filed a complaint with the FTC and my local consumer protection agency.

CA's as a general rule cannot threaten legal action as they are not capable of doing so. When I was working collections, one thing that was always stressed was collectors are not attornies. Collectors can "recommend that the client takes legal action" or can "recommend or refer your account to our attornies for legal action". It is all in the verbiage. It is a violation of FDCPA for a collector to say "I will sue you" or "I will take legal action against you" because it is personally something the collector just cannot do!! In a lot of cases, even implying that the collection agency itself will take this action is enough of a violation to nail them!!

I have been harassed by NES just Tuesday nov 4 2008. They where calling me about my Citi account. they brought up saying that the bill was 740.00 they where willing to make it 30% off to 518.00 I asked they guy where he would like me to get the money. Pull it out my A**. he said forget about paying all your other bills and pay this one . No one else is going to sue you but we will. I asked whathe wanted me to do live on the streets. but figures he didn't have an answer for me. He then started to get Errigant with me. You shouln't have chared the merchandise if you didn't intend to pay. I have tried to goto the location Zales to pay for the account they where we only can accept checks no cash no credit card. I told them i didnt have a check book. to make prior payment i have had to borrow a check book and provide the cash to whom i borrowed a check from. which was my mother. I was in touch with there credt collection dept to make arrangement but they started to debit my account for more than i had authorized. Need less to say the account went into overdraft and closed. I have received a letter from these Ignorant SOBS. about the collections. I am with any one that is here to take these people down. we need not to cower don to these people. they have no right to treat anybody like that. I know I live in a state where i only have to have one party acknowledgment about a call being recorded. They wont call back to talk to me. I let him not that he was in violation of the fdcpa act he asked how . I told him that he is not allowed to discuss my personal information with anyone but who is on the account. I am waiting for my Summons in the mail. I know that the original creditor has to be the one to file the claim. People lets join together take these SOBS down. They want a fight well then I say lets bring on the blazing guns. lets fight fire with fire.

I have been trying to take care of this since the first charge but No!! They have to sell it to NES. all NES is bullies wanting to pressure people to pay up no matter what the situation is. I am planning on sending the letter. That would be great if i could clear this up because they defaulted by not accepting cash.
