I was stupid and went to a cash advance place and took out a loan. I failed to pay it back, it was turn over to a collection agency. I called them back the first time they called and tried to set up arrangements, however, they want their money in full and are not will to negotiate any type of arrangement. They told me if I did pay they would turn it over to their legal department and take further actions including going to court and garnishing my wages up to 33%. Can they do this even if I am attempting to repay the debt? They told me they were unacceptable terms on how I wanted to pay them back. It would take me 2 months, but I would be making 2 payments a month. Any thoughts?

Which state do you live? PDL laws vary from state to state. Find whether Cash Advance is legal in your state.

I have found the following threads which may give you some idea - How to tackle Cash Advance: -

What I did, when a CA called my house, about an unpaid PDL, I told him I would pay ONLY what I barrowed. He said he "couldn't help me." I told him what I would pay for the loan ( Iwould pay the amount I owed, but, I would do it in apyments.) I just hung up. I'll call him back at a later time.

Seems, sometimes, that the most difficult people to deal with are the s-called CA's that call about PDL's. Don't the CA's know that MOST PDL's are illegal? The CA's just 'play into that game? Gosh. I think I DO need to send a letter..thanks for the advice.

No, they haven't. Actually......I haven't heard from them in a while. The CA, I mean. I haven't contacted the PDL i barrowed money, however. Usually, in any OTHER debt, it would probably be a good idea to contact the OC. What about THIS situation?..I have a feeling the PDL would just tell me I owed ALL kinds of money..above and beyond what I barrowed.
