Ok I have already gone to court with LVNV case dismissed without prejuice. I know they can come back and refile. That's not an issue But got a letter on Sept 15,2008 from northland group inc saying that LVNV is the current creditor and previous is citibank. Ok never have gotten a call from either place and now on nov 5, 2008 I got a letter from resurgent capital services saying prev.creditor is citibank and current creditor is LVNV. So why i'm a getting letter from different collection agencys saying that LVNV has my account

Also when I went to court against LVNV i owed 1,272.61
Northland says I owe 1,389.81
Resurgent says 1,406.71

Resurgent also sent with the letter A VALIDATION OF DEBT

November 5, 2008

Account number xxxxxxxxx for my name acquired from citibank is now owned by lvnv funding llc.

At the time the account was acquired from citibank, Citibank advised that the balance owing was 1,361.20. Since that time additional intrest, fees, payments, credits, and offsets. If appicable have been allowed for the current balance of 1,406.71

now in the lawsuit they had to pay for all the court costs and what not.

Do you think they added that onto my account?

Also resurgent has been calling now I haven't been home to answer the phone.

What should I do? I'm saving every paper I get from them. And i will again DV them since they couldn't produce anything during court and had it cont.. and then dismissed it.

I'm in Missouri


RESURGENT and LVNV are basically intertwined.you got a case dismissed with LVNV so now RESURGENT is trying to collect.send them the same validation letter.send it certifed mail retur receipt.

came in the mail today now they say they recevied my recent inquiry regarding this account (i haven' talked or sent anything to them yet) and they are in the process of investigagting my claim once a determination is made they will contact me with the results of their research.


what would this be about i haven't set them anything or talked to them the letter is dated nov 10th . 5 days after the 1st letter i recieved and now the total I owe is different 1,408.27 it was 5 days ago 1,406.71

When you DV LVNV, they immediately farm the account to Resurgent, MRS, or any of several other companies, most of which are all connected as part of the 'Sherman Group'. Been there, done that.

When the account gets farmed, the history, including your DV or court case, goes with it. DV Resurgent, and see what they do. In your letter, make a particular point to demand the identity of the account owner [with proof]. Then DV whoever that winds up being. When you reach the actual owner, the farming out should [hopefully] stop.

FWIW, I really like this DV template. I used this on MRS, the account got pulled and farmed top Resurgent. I used it on Resurgent and LVNV, and the crap stopped. Haven't heard peep from anybody about it since March 2008.

Unc is right- send them a letter. I,too, have dealt with them. It originally started with Sears, they sold it to LVNV and I started my letters.

When they didn't validate, I sent a copy of the first one along with a new DV to the next company, and so on. I think I have sent probably 5 or more to their many companies, along with copies. I also sent a letter with one,WW&R saying that they broke the following violations, and proceed to list them!!

Keep copies of everything and take notes of days and times they call or you talk with them. You can also record their conversations, if it is legal in your state..Good Luck--let us know what happens..karen

I plan on DV them and I'll do what you said. When I went to court the 1st time I hired a lawyer. So he set the DV and I have all the docs that the lawyer sent. I'm keeping everything I have the letter from the judge stating it was dismissed without prejudice and court costs were charged to the plantiff. I would just like to get them on a viloation and sue them ! i'm in missouri and I think I can record them without them knowing
