I just recieved a summons saying that they are suing me. Can they do that? Especially for a debt that they bought?

I have a question this bottom feeder showed up on my Credit report I sent them a request for Validation at 2 of their companies within their company.. They kept sending the account around the block it did stop at two !!!
I never sent anything to the main company as I did not know LVNV was the boss ..The two companies never responded
LVNV showed up on my credit report so then I knew they were the boss but that was about 6 months after all this started..They do report on the credit report that I am disputing it however they keep reporting it as charge off evey month can they do that ? Thanks
I live in Texas

I'm trying to decide what to do with them as well. Have about $4400 on what used to be a Sears card. They are on my credit. Last received a letter from Resurgent dated Dec 10th. So it's been two months and I have not received any calls from them. I'm sure it won't go away...but trying to decide to try and offer a settlement around 40%, or just wait and see what happens. I'm worried about getting sued by them as well. And I really haven't been able to find out on this site if they even do settlements. Everyone says how bad they are but I haven't found much in a way of percentages people are able to negotiate or if it just ends up with a summons at some point. Very confused on this one..

thanks bea2ls! It's sort of strange to me that there really hasn't been much collection effort. So I'm sort of expecting out of the blue I'll be getting a summons. I've settled so many of my other accounts recently I don't have money for them right now.

Good luck and I'll be sure to post as well if something comes up.

Yes they can, once they contact a law office in your state. I'm hoping to get some sort of letter if they do go to a local lawyer but really they don't have to. I'm worried about just getting a summons without any other contact before hand as well. I'm hoping for the best on this once since I just don't have funds to offer them right now.
