What to do if Nelson Hirsch & Associates Inc calls you for old loan?

I received this call on today from a person who is employed with Nelson Hirsch & Associates Inc. (Kayla Conley) who says she is investigating a loan of $500 I borrowed in 2005 (four years later). I am not financially able to pay them anymore money. What can I do? Judgment in Texas


I recieived a call from nelson and hirsch and they told me that i owed on a payday loan from four years ago. I did not take out this loan myself but apparently my ex-wife took put the loan in my name after we were divorced. I spoke with my attorney and he told me i am still responsible for the loan because i did not dispute it within thirty days and i had to pay the bill then take her to court for identity theft and prosecute her. I can't bring myself to press charges against my ex because she is the mother of my three children. but at the same time i cant stop her from taking loans out in my name. I have tried asking her to stop this behavior but she continues to get loans in my name. Help! Help! Help! please dont tell me to prosecute her because she is the mother of my children but she keeps gettin these loans.

okay,i have quite a few points to make.

1)whoever your attorney is should be disbarred.why?because advising you to pay a bill just because someone called doesn't deserve to practice law.
2)your ex-wife more than likely used you as a reference in getting these loans.unless you actually co-signed for anything you are not liable.
3)per the FDCPA you must receive a dunning letter 5 days after initial contact.if you don't receive said letter.the 30 day rule doesn't apply.i mean how can you dispute without an address to send the dispute.
4)nelson hirsch is a dirty bottomfeeder that violates the FDCPA hand over fist.

in fact who knows,maybe your ex-wife just applied for pdl's and they are using that info to make a cheap buck.above all else talk to your ex,and be sure.again your lawyer is the one who should be sued for malpractice.do not pay this until you get details in writing,nothing in writing,it's not legit,and the lawyer is a slime.

After speaking to another company by the name of WC Group and being told they were going to take me to court I gave them my debit card information and directly afterwards I had two unauthorized charges from T-mobile come through. Of course the authorized charge from WC Group was declined for insufficient funds. The then called back and informed me that because it was declined they debited $390.00. I filed a dispute with the BBB as I had to request something from this company several times and they never took the full amount so I cancelled the card. I could not find much information about this company, so I have stopped speaking to them and now I am waiting on the results of this.

Because of this past experience (which was VERY recent) I decided that I would not play ball with Nelson Hirsch and Associates. I called and had to leave a message because I work M - F 8 -5. I received a couple of messages saying they were going to take the next legal step and that they were not going to continue to leave messages. I called them back today and left a message telling them that I have not received anything in writing from this company and after researching them online it seems to be for a payday company. I settled my payday loan with a creditor that called about 2 years ago. I told them that if they needed to contact me it should be in writing and that if this was concerning that loan then I would not be paying them because that matter is settled and if they continued to seek reimbursement for this matter then I would need their information in writing so I could file a lawsuit against them.

I only wish I would have found a chat like this for the other company of WC Group because I feel so violated by that company and I also feel like an idiot. I did look them up and when I called the company I asked if the WC stood for anything and they said no. When they charged my card it came across as Western Capital Group. I found one site about them, but it was several years old and I could not locate much else from actual individuals who have dealt with them. I did get a message from the company because my complaint to the BBB stated that I did not authorize the $390 to be taken and that other charges were taken that I feel this company is responsible for. Needless to say the individual that called me back was not very happy about this complaint and said that our arrangement was off and they would enforce their legal rights. I was a little afraid at first, but I have lodged my complaints and I was disciplined at work due to this company so if they sue I am fully prepared to file a counter-suit. I won't be so stupid next time!

I don't want to be too redundant to all previous post with this question but my situation has a bit of a tweak compared to all others. I'm getting the calls from this Nelson, blah blah blah, same as you guys. But, they're asking to speak to a Donald Dyer, which isn't me unless my parents lied to me about my birth name. (That's my dry humor) They're giving me a case number, etc, etc and explaining to me (all through voicemails I might add, I've never answered) that they would like to help "alleviate" my situation. oooook! Sometimes its a computer generated message but when its actually a human, he say's his name is "Orlando King". He states as follows; "Hi, my name is Orlando King with Nelson Hirsh and Associates and we are investigating a "claim" against (stops and corrects himself here) investigating an "allegation" against your name and social and would like to help you alleviate this situation as soon as possible. If you could call us back at 1-7..(stops and corrects himself again) excuse me, 678-593-2372" followed by case number, etc. My first question here is that if there's a claim, allegation, whatever against my name and social, how come it doesn't match? I'm pretty darn sure my name isn't Donald Dyer unless I've been spoofed my entire life and the doc was drunk when completing my birth certificate. I too had to take out a payday loan years and years ago but I did indeed pay back all of mine. I'm certain of that. My second question is this. I work for local law enforcement in my area. Would it be smarter for me to continue to ignore this craziness or should I call them from the recorded lines here at the PD and tell them this isn't who they're supposedly looking for? They've never called me at work nor have they sent me any letters via mail or email. The last thing I want to do is open the worm hole for them to have my work info as another source to harass. I've been in this situation once before with some other random company and once I told them I was calling from the PD with my Lieutenant standing by on a recorded line, I never heard from them again. Go figure. What's the advice guys?

These people are rated low the by the BBB if you go to their website there is a place to contact them there. They are very unprofessional and will not work with you at all. They want only the amount they are looking for and want in a short period of time. Unfortunately they can not collect what I don't have. I filed a complaint about them to the FTC. We will see what happens.

The problem is that the company cannot give the exact information for which company loaned the money. They have a list of man loan websites that it could have been from, stating they are collecting under an "umbrella" for various loan sites, which is just insane that they cannot give any information regarding even the bank that I supposedly got the loan paid to. Funny the amounts are always the same too -- I think they just wait long enough 5 years and then start calling to put fear in people... seems everyone's loans were 4 or more years ago, long enought to not be sure.

I got duped for 100. My calls are recorded at work. I will call and notify them my attorney is investigating. They called me from 1-888-674-5149. She actually sounded christian and seemed to understand. Will file with FDCPA. Canceling card I gave. This hurt.

I am sorry that you feel duped. It seems as though you may have duped a few loan companies yourself. If you would have enough intergrity to payback the money that you originally borrowed or at least communicated with these companies, you would not have been in this position. To address your comment about being a Christian, the bible says "render unto Ceasar what is Ceasar's". It also says forgive us our debt as we forgive our debtors. Again I am sorry about your financial woes, but please remember you started this by getting a loan that you never paid back.

I received a call from Nelson Hirsch & Assoc. today on my job. They wanted me to pay for a loan that I had years ago. My loans have been paid up. I asked them to send me a statement of what I supposedly have owed. They sent me an email with my name, street address and their city and state. The amount was way over the hill in the amount of $1,100.00 they claim this is from interest, in what year, I have no idea. I paid a company or someone like this two years ago in the amount of $450.00 and never received a receipt or knew who it went to. I sent it in a money gram. I learned to never do this again. This is a scam. I forwarded my complaint to the FTC and my towns police dept. who told me never pay anyone that cannot send it by mail in writing on who you owe, how much, and exact date of transaction. I will expose this company to the FTC and Comsumer Affairs. Something must be done to these people harrassing people who paid their depts.

these pl called me and threatened to file suit against me in my state of residency with inm 24 hours 3 days later they threatened it again, i wanted to know what the issue was bc i dont have any debt having paid it all off. they said a pay day loan from ten day pay day which i cannot find anywhre on the web. they then started yelling onbscenities on the phone at me and threats when i asked if i was a scam. this tells me it is.. its not legal for a credit agency a legit one to threaten you at all. or call after 8pm they called me up til 1130p with an unavail number

This company is truly a scam. It is so unfortunate that I worked for them for a few months and saw and heard some very unprofessional business being held. I thank God I was able to get another job that is a legitimate and professional collections job. Nelson Hirsch & Associates is a pathetic excuse for a company. I am so thankful that I kept my integrity and treated the debtors like I would like to be treated and it truly paid off. I feel so sorry for the reps that are left there struggling to make a living at 7.25 to 8.50 per hr and being told to do these unethical business practices. This company will be bankrupt soon with all the lawsuits against them. God will never bless that evil owner. I just hope the decent employees that are left will be blessed with better jobs. Any job is better than that job!

OMG I just got a call from this office, Nelson Hirsch and Associates Inc., Ms. Williams. She said they were investigating a pending legal matter that involved my social security number and my name. She said I or my attorney needed to call back with a verbal statement and left the phone number 888-674-5149 ext 2226. She also referenced a file number. Thank you all for the information provided here. When I received her message I was worried by her tone and what she spoke of and it upset me.

Unfortunately these highly illegal tactics are employed by bottom feeding collection companies. This is why all the federal consumer laws were enacted, to stop this kind of abuse! Look at the fact that many collection companies consider violation lawsuits as a cost of doing business. What that basically means is that they know full well that they use illegal tactics and that they simply don't care.

No one here EVER suggests, much less condones not paying your legitimate accounts. But that is the rub it seems....the Nay Sayers and the Downright Rude love to scream at people to pay their bills, but then just sit there and blink dumbly at the computer screen when the reply is "I will be happy to pay it as soon as they provide the proper paperwork that this is a valid debt at all". At least that is all I can come up with since the very same people who post these inflammatory comments NEVER come back and respond when challenged.

The way I look at it, since collection agencies use every tactic (besides the illegal ones) to collect upon the debt, you have the same right to use every law to your own advantage to force these companies to start playing by the rules. The true irony is that they would all get paid most of the time if they acted in a lawful manner.

Listen to everyone that tells you not to pay, only if you want to have a horrible credit score.
I'm a firm believer in paying my debts. So don't just blow them off. I would request it in writing first however. If they don't give it to you in writing it only means that you can dispute it on your credit report easier, but he debt is still legittiment. If you can afford to, pay it. Don't listen to losers with horrible credit. They basically found a way to legally rip people off and then complain about how evil the collection process is. Contact the original loan provider too, so you can verify.

what a bunch of bunk.payday loans can't legally be reported to your score and this is a PDL JDB.meaning they buy illegal internet pdl's and use illegal threats to collect.btw 99% of all ipdl's are illegal and most of us have overpaid anyway.also if the loan was illegal the original lender sold it and won't take payments.to close the only loser is the one above me shilling for a bottomfeeder.

Wow...so basically what Blah is saying is If they don't validate, it is still a legitimate debt and you should pay it.

That is the most moronic thing I have heard. Even were the "debt" with a company that reports to credit reports, they still have to report correctly, which means be able to prove it. FACTA made this possible.

The bottom line is that if a company can't prove a debt is legitimate, then they have NO RIGHT to be attempting collection in the first place.

It is not the fault of the consumer if a company bought an account without any documentation. If these companies would put a little more dilligence into their business operations and made sure they got the documentation for each account, they wouldn't HAVE to worry when someone requests validation.

Received a call from them today about a "loan" i took out in 2005, over 6 years ago!!! First, they had the wrong social and don't believe me, and then to top it off they keep saying I borrowed 250 and now owe 590...I'm like WTF.....and then they want to talk about legal this and legal that, the Statute of Limitations ran out almost 4 years ago so why are they still contacting me!!!

Payday loans as well as any other payment history including utility or rent payments can be reported to a credit bureau and included in your credit score.

Anybody can report basically anything....it is just that the majority of these payday loan people don't report, it usually gets reported when a debt collector gets a hold of it, either collecting for themselves or on behalf of another.

AND if the original loan was illegal..they that account can't be reported no matter what.

To answer #182: They say these things in the hopes that you do not know your rights or the laws and can scare you into a payment.

#183: payday loan defaults are in no way shape or form fraud. It isn't even a bad check unless that specific signed check was cashed....anything done ACH is not considered fraud or a bad check. Sorry..no go.

In this state, the bottom line is if its an illegal debt created by an NON LICENSED internet PDL company in the state of Ohio., the debt is null, void and unenforceable . In addition , at least in this state, there is NO such thing as fraud on an illegal debt. Especially since that office spoofs their phone numbers. They are also being reported for impersonating FBI Fraud Agents...LMAO

Got a phone call from them on my husbands cell phone! How they got the number, I have NO clue, it's not in his name!

He does not owe any Internet Pay Day Loan! I'm the one who spoke with the woman and she told me that she needed to speak to him about his social security number and I replied anything she can tell him, she can tell me! She wouldn't and said it was a pending financial matter. lol I replied "YEAH RIGHT!"

These people must think we are all stupid! He owed a payday loan 6 yrs ago, and the statue of limitations have expired 4 yrs ago, so they can't do him squat! If they call again, I will contact an attorney about harassing phone calls from a company who never sent one collection letter!

I got the call yesterday about this as well saying i owed 320 dollars to them from 2005 that it was taking out a bank acount with a local bank which i was not even using in 2005. The info i got is

then also the South Eastern Legal : 1-678-926-8698


So I know this is not a legit thing since they named a Bank that I used as collateral as she said, and I wasn't even using that bank in 2005. Plus the fact that I have never used Quick Payday Loan Company.

This phone number (225-663-1822) called my husbands cell after he got off work! I answered the phone and the recording said if I wasn't my husband that I should hang up, so I did! I looked up the number and found it was Nelson Hirsh!

This is the second time these people have called my husbands cell. First time was June 14th! I have written down the times and phone numbers that have called that are from Nelson Hirsh and I will be contacting a lawyer for harassment charges!

Not sure if ROBINSON PAMELA FAYE is still working with them, but I intend to find out! She's a convicted criminal! Also calling the federal trade commissioner 888-225-5322

Dont quite understand your point....calling is NOT harassment. Calling twice is not harrassment either. Have you sent them a cease and desist in writing?

You cannot file charges.....that would be criminal. At most you can file a lawsuit, but unless you cease and desist them in writing as the the law requires first, you have no case.
