I received a called from this busniess telling me i owed $320 to a payday loan that i defaulted on and that they needed the money sent to them. I have messed a payment with the payday loan co., i DON'T KNOW WHAT TO DO ABOUT THIS BUSNESS ARE THEY FOR REAL

I took out a loan with Husk Hawk Payday loans in the amount of $100.00. The interest ($30.00) on the loan was to be paid on the 1st and 15th of every month or pay the loan off in full in the amount of $130.00. I extended the loan (paying $120.00 in interest). On July 1st, a judgment was placed on my checking account for an unrelated event. Husk Hawk presumably attempted to debit my account for $30.00, however, my account was frozen and eventually debited for the full amount for an unrelated debt. The July 1st payment was the first payment that I have missed since taking out the loan.



I received a call today (July 23rd) from Sergio Ahumada at 866-979-5505 ext. 241 representing Nobel Recovery Services stating that I owed the amount in full today. I explained what transpired with my bank account and that I would pay the balance in full ($190.00) on August 1st, 2009 (my payday). He said that he had to discuss it with the "director" and see if that would be okay. Sergio, before that, told me that he believed my situation and was sure I wasn't trying to defraud them because he "could see that I had been making payments but he would have to get it approved." A few minutes went by and the director told me in no uncertain terms that if I could not make a payment today (the date of this complaint), they would "file the necessary paperwork" and that would cost me more money. He was basically saying that they make more money by "pushing paperwork" than collecting the debt. I told him my situation and that I would be more than happy to satisfy my debt on August 1st, 2009. I asked for validation of the debt to be sent to my work email address. He told me that was unacceptable and that they would just proceed with the paperwork, talk to my Human Resources Department, and "see what other companies I had defrauded." I explained that I don't have the money today but I am willing to pay the debt that I owe regarding Husk Hawk on August 1st, but I also needed validation of the debt for Nobel Recovery Services (since they told me that Husk Hawk had sold the debt to them). He told me that if I made any kind of payment, I would be able to delay the balance until August 1st.



I, however, think this is a scam. I do owe money to Husk Hawk, but I don't know if Nobel Recovery Services is a legitimate group. They contacted my mother in a different state (Massachusetts) and harassed her before they even contacted me! They then threatened to tell my work about my debt, which I know is illegal in the state of North Carolina.



Sergio Ahumada gave me the following information so that I could send a Moneygram, if it would be "approved" for me to delay until August 1st.

They said that I would have to make a payment of $50.00 by July 24th (today is the 23rd) by 10:00 AM or they were going to "proceed with the paperwork."



I am unsure of the legitimacy of this company, and if legitimate, the method with which they go about collecting their debt by threatening to notify the employer and harassing the debtor's mother.

I filed a complaint with the AG and after reading this site.

If you are not sure of the legitimacy of this company and if they in fact do legally own or have the legal authority to collect on it, you are within you legal right to make them validate the debt. If they refuse to, contact your states AG office and file a complaint. FTC as well.

Hey Pissed Off - I had the same situation that happened to me yesterday. Same exact deal. The guys I talked to said he didn't think I was the same "criminal" that he normally deals with and that he would check with the "director" to see if they can help me out. When I talked to the director, all he told me was that I needed to pay in one hour or he would file the paperwork as well. I talked to an attorney about this, they said, let them file the paperwork, if there's even paperwork. According to a lot of these forums, no paperwork was ever filed.

They can't garnish your wages until they get judgement to do so. In order to do that, you would have to be served to appear in court.

I don't know how real this company is. But I do know that they are practicing illegally. I'm in California and they also cannot tell my work about my situation. But they have left me messages on my voicemail saying that if I didn't take care of the money I owe, then they would keep contacting my work.

I, too, have filed a complaint. That's all I can do for now. I will consider taking more action (with the help of my attorney) should I need to in the future. It's ridiculous how much they put people through!

I received a call from a Sky Enyeart who stated he is the Director of Finalization. He was nice when he told me that they were contacted by Midland Financial (the company I had my money loan through) and they wanted to settle my account with them for a lesser amount. I told Sky that was fine. I told him that I would send in a Postal Money order if he would just give me their address. He proceeded to tell me that they only accept payments thru Money Gram. I explained to him that I would rather mail in my payment so that I could make sure that it was received and signed for. He stated that the company would not accept that. He was nice up until that point. He then put some guy named Ed on the phone who stated he was the Director and if I did not make my payment thru Money Gram then they were going to request the payoff for the full amount which is more than my money loan.

I told Ed that I would be filing a complaint thru the BBB and the Federal Trade Commission. I told him it was in his best interest not to contact me anymore regarding this issue. I am sending in my money order tomorrow to pay off this loan for the settlement amount I was first quoted. THESE PEOPLE ARE EVIL!!!!!! Thanks again though for the address!!!!![/color][/size]

Her Kri55ol. I was just reading your information about your call from Nobel Recovery. That is what the Director of Finazlization Sky said to me. He even said that MIdland Financial was a scam of a company and he apologized that he had to make the call. This of course was before I asked for their address and had to speak to Director Ed.

i talked to somebody from there office trying to get info so i can make a complaint at first i didn't tell them who i am and they woudldn't even give there address. the next time they knew who i am and the person that i talked to gave me there address and it is in anaheim but when i ask her to who should i address the letter she just told me address it to the director of operations wheni ask her the name she can't give me any then i ask her what position she is she said she's an account representative the i still insist she give me the name and even told her thet she's working in the company without knowing who their director of operations is....then she hang up on me hate this scammers

i am also dealing with mr.bowen and his boss and a third boss i only send money grams and that is it they tried debt cards but i said no and they tried the fraud case and two hrs later they were pleasant and willing to work with me and i hope to end this very soon

Hey everyone - Yes, I save all the messages from Nobel Recovery. Just today, I got a call again from Mr. Bowen. He got my voicemail at work. His message indicated that he specifically asked for the HR department and was transferred to me. But after speaking to the receptionist who transferred the call, she said that he was very clear and asked for my extension! Liar! I think they leave these messages saying they're "ready to proceed with the paperwork to my employer" to try to scare me. They also told me, last Thursday, that if I didn't pay up that day, they would move forward with whatever paperwork they keep talking about. How come they won't just send those darn paperwork to my employer???? Why do they keep asking me to call them, right?

Minnieme - I can't find a website for this company. They attorney I've retained also have never heard of them before. I tried finding them on the BBB, but it just gives you their business information - no website.

Only two people people have ever sued them for FDCPA violations, one on a list ("et al") and not sued specifically - for Noble, and 1 for Nobel.

Neither name was found on Bud Hibb's list of bad collectors.

Their BBB report shows only 3 complaints (which they ignored) in the last 3 years.

The only thing I could find on them was a few anonymous complaints posted on public forums - mainly this one. Their Business License shows them to be a new company - July 2008.

Send them a Cease & Desist letter for them to not call your employer. After you get the green card back, log any more calls and sue them for the FDCPA violation.

If you have a recording of them claiming to sue you for fraud, then *you* can sue *them* for $1,000 for the lie, a violation of the FDCPA.

I too was harrass by this company. They called me this morning telling me if I don't pay $400 in half hour they are going to take legal action. I've already paid $320 on a $300 loan. They scared the heck out of me and got me all stressed out. I've hired OVLG to help me settle my debt but my first pymt isn't scheduled until the 15th so there isn't much they can do since they haven't sent out legal docs. But I feel a little bit better after reading the threads. I am in California by the way so if you have any advice please tell me.

I had probably 6 other payday loans from other companies and found out thru this web site that most were illegal. Took care of all of them either thru refunds due to me or just pif... Now yesterday at work I received a call from Nobel Recovery Services with a phone number of 866.979.5505 from a Mr Lopez ext 222 telling me I committed check fraud and fraud against a bank. I explained to him what all had happened and i would be more than willing to make payment arrangements and he put a david lerner on the phone from ext 221. who refused any payment but payment in full he told me to borrow from my family, but told him i was unable to he basically told me i was a thief and disgusting along with my family because they can not help me. I never refused payment he refused to accept it. any ideas. of course he says he will sue me i told him to bring it on.

I dealt with the same individuals a few weeks ago. I swear it was the same guy only he plugged his nose when David Lerner got on the phone. I've only had one phone call from them and it got pretty heated. I told them I had contacts that worked worked for the courts and the police dept. and that I was going to start an investigation on him and hung up. Haven't heard from him since.

good one. that is what i love about this site. the info i have gained has saved me hundreds and possibly thousands let alone my marriage. after i talked with him and the more i thought about it. he was rather pushy and rude. so i will give him that same info, since i have a cousin that works for the sherriff dept and a nephew that is a cop. I again really love this site, it was the best thing i have ever found.

You should mail it Certified, Return Receipt Requested (so you can prove they got it). If they ever call you again, you can sue them.

Ok, has anyone ever dealt with Nobel Recovery thru Check n Go and 1st bank of Delaware. I got a call last week. from Mr Lopez and Mr Lerner, then today Mr Lopez called me at work and when I requested their business license he gave me to Mr Hal Jordan. He skated around my questions trying to turn this back on me. Yes, I took out the loan and no I have not paid anything on it. I found out most of these places were illegal, tried to set up arrangements with check n go and they would not take anything. Didn't 1st bank get in some trouble with check n go and some of their other loans they were doing. I informed Mr Jordan that I would be filing complaints with the FTC and Attorney General office in CA and IN. Any one got any infoo woudl be great.

Mr. Lopez has been calling me too. I specifically told him to not call me at work. He said it was because I was "refusing to pay. I said no, I am just trying to see what I can afford to give you. He just called back today and said "I have broke communications, and that's a sign of refusal to pay, and I could expect papers delivered to my work". I said I wanted something in writing about this loan, then big bad Hal Jordan took the line, and made me feel real criminal. Today, I got a text message on my cell from them, and said I have broke communication again, and he would be forced to call my work to make arrangements with my supervivor to hand deliver paperwork. Can they call my work after I specifically told them not too??What do I do?? What is cease and desist?

Once you inform a collector not to call you at work they are by law required to stop. I can't believe they are sending you text messages. I would defiantly file complaint to your AG's office and save that text message. You should see if your phone company can generate a paper copy of the text message so you can attach to your complaint. Noble Recovery is pretty nasty, I went off on them a few weeks ago and they haven't called since.

this person left a message on my answering machine on Fri 8/21/09..very difficult to understand anything as he continously coughed and hemmed and hawed around. said they were going to call my place of employment on Mon 8/24 and my 2 references...did call 1 that I know of, told her to ignore the message....I called the number he left and got a "this is a general delivery mailbox, state name of person you want and leave a message" I then called the number in CA and got the same response. I left a message to not call my place of employment and my references. I got into a payday loan mess and turned to a payday loan debt management company. All of my payday lenders have been notified by email and/or fax of the situtation w/letters from the debt management company..One company in FL refuses to work with this company. any suggestions

I returned a phone call from this company tonite sept 21,2009.....the man that answered the phone was very rude callled me a criminal and a deadbeat i offered to male payments to him and he said that was unacceptable. He had me stressed to the point that i was crying. He told me that he was going to have my checking account shutdown and threatened to call my employer. i am filing charges against him with the attorney generals office and the ftc a nd the fcc the man war ruthless. I would love to join you! What do I need to do when I contact the FTC? NRS called me in July as well. All the information they had on me was 2 years old. I told them that I would not give them any money until they could send me something in writing to show me the amount that I owed. I do owe some money, but not what they were stating. I finally hung up on them! They just started calling me last Weds. leaving a message each day stating "we are trying to determine your location". I just ignore the calls and document them. I am going to send a letter to them this week, and will file with the FTC as well. Have you heard back from them?

If they could charge you with Fraud the company that gave you the loan would have done it. Thay are just trying to scare you into paying.
