Being Sued!

For the last 3 years I have been sick and trying to get Social Security Disability. I finally have my disability hearing on 8/24. Obviously during this time I have been unable to pay my bills and fell behind and eventually had to stop making payments on my credit cards. Today I was just served with court papers from American Express as they are now suing me for $1100, the balance on my credit card. I'm not sure what to do as I have no money to pay this. I am too sick to go to court. I wanted to file bankruptcy several months ago but no bankruptcy attorneys wanted to take the case. They all told me to come back once I got my Social Security and they also didn't want to take the case because I have a personal injury lawsuit pending. I can possibly borrow this money from my sister to make this go away, but I am afraid that if I pay them this is going to cause all of my other creditors to come out of the woodwork looking for money too. I'm really at a loss here and pretty scared. What should I do? The debt is valid, even the amount is close to the actual amount on the card as I think I had a $1000 limit.


Is it Zwicker, who is suing you? What state do you reside in? Please answer these questions so that I can better advise you. Also, when was the last time you made a payment on this Amex account? Thanks!

Hi,

I understand the situation you are in. as you have now received the court papers it is really important for you to answer to the summons. But while doing this, you can also talk to Amex about the situation you are in. In order to prove your situation provides them with proof of your income and expenditures. They may agree to settle this debt. If not possible, you can try to at once consolidate all of the debts (unsecured) that you have. You can transfer the balance from all of your credit cards to a card which has relatively low interest rate.

Sounds like AMEX charged this off and a debt attorney bought it. This has happened to me with Capital One. A debt attorney I've been dealing with claimed that Capital One is suing me,but lo and behold how does a $500 debt turn into $1500 that is now being garnished from my check? These vulchers are taking 25% of my paycheck that has left me on the verge of losing my car and home. The worst part of it, I had two Capital One cards with $500 limits and thought that this garnishment was for both, but now I was served yesterday with papers on the other card which will probably turn out to be another $1500.00 deal. I am contacting an attorney this week to see what options I have. THe court date on the latest papers state something about Sept 23rd. I can fully understand people going off the deep end when a financial crisis hits them like this. I do not care to pay a legit debt, but this is all out loan shark tactics. I am sickened that these people will make huge profits off of our backs. Be very wary dealing with any kind of debt "attorney" because they did not get where they are at by being uneducated about debt laws.

Neither Cap One or AMEX sell off their debt....they place or assign they to attorneys to sue on their behalf.

Very easy...late fees, accrued interest...plus you pay the court and legal fees. This is standard anytime anyone is sued.

Have you answered the summons? Did you answer the previous summons or show up in court? Try to set up a payment plan to avoid being garnished? You do not need an attorney to do any of these things....you can do it.
