I have had the night mare for over two years they are passing my account from collection agency to collection agency and I keep faxing the information that it is paid in full also associates who the credit card was through says it is paid in full. How do you stop these barracutas?

They're reporting my account to the credit bureaus illegaly. I've been dealing with them since October of 2004. They keep saying they're removing the account from the credit bureaus and they never do. Spoke to Supervisors and they're all unprofessional. BEWARE This Collection Agency needs to be reported to FCC.

you should file a complaint with the FTC and with the American Collectors Association

they can be fined heavily for a violation of the FCRA

you can also go to and post a complaint and get addresses on them

complain also to the CEO of the original creditor

i set up checks for 6 months at a time to be taken from my account. They have not called to set up another six month payment. I am holding my payment in the bank until they call. Is this OK or should i call them?

Keep a close eye on your bank account. I think you should call them and set up the next 6 months payments. Just remember, you are taking a risk giving a collection agency your bank account number. They can access it without you being aware and cause NSF fees and bounced checks.

In my opinion, you should contact them to make payment plan for the coming months. If they report your account as late, that would hurt your credit. Also do what brat has suggested above.

Someone just phoned me from Credigy. I'm waiting for the Consumer Protection office to tell me if they are allowed to do business.
Should I wait or speak to them?

I do not see anything bad in speaking to them. Ask for receipt for your precious six payments and make a written agreement for the rest of your installments, so that they cannot claim anything unfair in future. In the mean time, you will get the feedback from Consumer Protection Office also. Keep us posted.

My name is evelyn santiago and my questions is that back in 1997 my dad got a credit card in his name but it was my card meaning he put me as the co applicant and I was suppose to be responsible in paying the account which it was with fleet, but I came some hard times that I couldn't back then pay it. But now that ihave become stable, I was searching long and hard to see how can I make payment arrangements to start paying them off, but now I got a summons in the mail stating that credigy is suing my dad naturally cause it was in my dads name, saying that they have tried numerous attempt to collect and haven't in all these years recieve anything like that. As a matter of fact thats what I have been waitng for so I can make payment arrangement so slowly I can pay it off. And I still want to do that. So how can I avoid this summons and who can I contact to avoid this stuff in court which I already know that I owe this. Please tell me what can I do? I mean I never recieved any notice from credigy concerning my account at all so I don't thats fair getting a summons and not recieving any kind of notice in the mail concerning this account that I owe. So please I need to know who to talk too or contact please

Could you tell us when did you make the last payment towards this card and which state do you belong to?

The reason I'm asking this to figure out the SOL for this debt. If the SOL has expired, you will win the case without paying a dime.

Otherwise you can contact Credigy and ask for out-of-court settlement. Probably they will cooperate. Keep us updated on this.

Hi stan its me again to your response on this matter well to tell you the truth I think the last payment that I made was in 99, and I come from connecticut. So what is the sol in my state? If I have to contact credigy, what is their contact number and what do I need to know because its been so long that an accoutn number now is hard to know

SOL for Connecticut is 6 years. The countdown starts from the date of last activity seen in the account. If you made the last payment in 1999, the SOL has expired already. Hence no one can force you to pay this debt, nor can any legal action be taken against you for a past SOL debt. You can verify the SOL of your state here too-

You can send them ???cease and desist' letter and tell them that as the SOL is over, they cannot force you to pay it, so stop calling. You can collect their contact address from the previous page of this thread, or you can consult BBB website to collect their contact address.

In 2002, I set up 6 post-dated checks to allow First Select to receive their money on the 14th of the month. They took all my checks at once and caused me a lot of money in fees in addition to ordering several statement copies from my account for $4.00 each. I hope they don't do that to you.

I didn't even know I owed First Select ... I thought we had paid off all of our credit cards frpm when my husband got hurt. On my credit report is this First Select ... Called them and they said Credigy bought it in Jan. 06. How do I find out if I really even oew this. It was a Discover card .

Ask for validation. Collect a suitable format of debt validation letter from the free debt consolidation Sample Letters e-book, make required changes and send it via certified mail with return receipt requested. You can get the e-book here-

Once they receive this letter, they are supposed to send you itemized details of your account. You can also contact your card issuer and inquire if they have transferred your account to Credigy or not.

If you are quite sure that you paid this account back, you will be able to get it removed from your credit report too. Keep us posted.

Thank you... After hours on the phone I found out I did pay in 2000 !! Now I'm searching First Select on a Visa I was sure I paid. I thought my credit was in good standing until I went for a loan. I am having trouble getting Discover to remove it from 2000.

I too, have been dealing with Credigy. They are double reporting on my credit report. They are reporting as Credigy and First Select. I contacted them and my Attorney State General about the issue. Credigy replies they have no affliation with First Select. Is this true, but I see on this site and on others they are a part of First Select, Inc. Also, when I ask them to verify, they just send me very vague info on the debt. What should I do?

After a charge off from Fleet, I rec'd a statement from First Select for 6400$ more than the original amt. They said it was a 'gratuity' fee for taking over the loan, but they would settle for a one-time fee of $2400. I refused, it was turned over to Credigy who enlisted a 'lawyer' for suit. In researching I found out that Credigy/FS are actually a part of the Providian/Fleet family and the accounts are really not 'bought', just turned over to the different departments. Be very careful, they are slizzy and go for the judgements. I had to get a lawyer working on it now to get it overturned!...

I had a $900 debt from my freshman year of college in 1996. It was a Discover card and charged off in May of 99. It was bought by First Select who said that I paid $25 in 2000, which I may have, but that would have been the only payment to them, if it ever occurred. It was then turned over to this Credigy who hired a lawyer who sent me a summons. The amount is for $7200. This is on my credit reports under various names, but with similar amounts. I have hired a lawyer who filed a motion to dismiss based on Maine's 6 yr SOL, but because I allegedly made a payment in 2000, they said it moves the statute to September of this year. So, they are alleging that the date of last activity was September of 2000 but one of my credit reports says that it was November of 99. I have just made an offer to settle for $1000. If they don't accept it, we will be going to court. Is there anything at all I can do? Aren't they in violation of the FCRA by reporting different information on different credit reports. My lawyer says everything looks fishy but they may have the documentation they need to do something. Any advice on any of this? Thanks.

Terri. I will pull a credit report from the three bureaus and do a comparative study on the dates posted on this account. It is also better to contact Discover and know the date of the last payment made towards this account. If the SOL is over, you are free to avoid payment on this account, provided you have the accurate dates of last payment

I like alot of these people have paid first Select on the behalf of Assocaites and I am not being collected on by Credigy. I have been disputing this since 2003 and have not been able to get anywhere. Any suggestion?

About 7-8 years ago I was reported to a collection agency for a current amount of about $1200. I continued paying on this account for about 3-6 months. Then at some point one of my payments was returned to me saying that the address was wrong. I double checked my records and the address was correct with what I had, so I re-sent it. Again I got it back.... I never heard from this company again, nor any other company about this ordeal. It had never crossed my mind since.... A little over two years ago I went to bank for a bank loan, and saw it on my credit report thru a different collection company, and charged off as a bad bedt with the amount of like $1000. The bank did not even acknowledge it, and gave me the loan.
Here is my new, Current problem...... I went to the very same bank yesterday to see about gettting a new car, and to my surprise I all of a sudden have a OPEN, unpaid account with CREDIGY for $9,000. It states that the original creditor is the same as the one that marked off as a bad debt, but only way way way bigger..... I am currently disputing this but I am not sure of my rights!! Here are my questions and concerns...
How can it go from being $1000 to $9,000? and is this legal?
How can it still be open, its been seven years since its been in collections the first time?
What are my best options?
Is this credigy company bogus?
Please please help me!!!

Rebecca, did you contact the consumer protection office in regards to whether or not Credigy is suspended from collecting? I was wondering because Credigy recently came up on my credit history, an enormous amount for me and I have never used that kind of credit. I called and left a contact mess. Any news-- let us know.

Hello guys! I work at credigy, i would like to tell u that we don1t keep your bank info, we just use to make payments and about that payment plan u should give us call and set up more checks because if u don't pay the agreement will get broken and interest will return to acrue on the account!

Verdict Report: Fausto et al v. Credigy Services Corporation et al Case 5:07-cv-05658-JW.

Plaintiff???s attorneys: David Humphreys and Luke Wallace of Humphreys Wallace Humphreys, P.C. Tulsa, OK; Bal??m Letona, Santa Cruz, CA and Ron Wilcox, San Jose, CA.

Defendant???s attorneys: Tomio Narita and Jeffrey Topor of Simmons & Narita, San Francisco, CA; John Gillespie and Jeff Lucas of Stewart and Associates, Atlanta, GA.

San Jose California Federal Jury Returns Verdict totaling $500,000, against Credigy Services Corporation. The verdict consisted of $100,000 in actual damages and $400,000 in punitive damages. We are informed that the verdict is the largest under the Fair Debt Collection Practices Act on behalf of a consumer who owed the debt. The Fausto's are entitled to an award of attorney fees and costs as prevailing party under federal Fair Debt Collection Practices Act and the California Fair Debt Collection Practices Act.

Manuel Fausto opened a Wells Fargo charge card at a local branch in 1992. The account had a credit limit of about $1,000. Manuel Fausto and his wife Luz made monthly payments on the account as agreed but the balance kept increasing. After asking (and being declined) at the local Wells Fargo branch to have the interest on the account "frozen" so the balance could be paid off, the Faustos received help from a local business that promised to negotiate a discounted payoff of credit card balances. The Faustos had no other credit card debt but paid the Wells Fargo account off in 1998 or 1999 with two money orders delivered to the local debt negotiator. Seven years later, in August of 2006, the Faustos received a phone call at their home from a debt collector calling from Credigy Services Corp. The Faustos had no dealings with and did not recognize Credigy as someone they owed. The Faustos also received a letter from Credigy claiming that almost $17,000 was due on the account. The Fausto's made an appointment with a non profit legal clinic, the Watsonville Law Center, who wrote a letter for Mr. Fausto to sign demanding that Credigy provide a copy of the contract proving they owned the debt and some proof that the debt was actually unpaid. Credigy responded with a form letter restating the balance claimed due. The Fausto's brought the letter back to the Watsonville Law Center. WLC wrote a letter for Mr Fausto informing Credigy that since they ignored the request for information, that the Fausto's demanded under federal law that Credigy Cease and Desist all further contact with the Faustos. Credigy continued to collect on the account, writing numerous letters and calling the Faustos home over 90 times. The collectors were calling from a Credigy affililate in Brazil and made repeated false threats to the Fausto's that Credigy would take their home and paycheck even though the time to sue had expired years before Credigy's first phone call to the Fausto's home. Mrs. Fausto tape recorded the last phone call from Credigy which documented false claims that the account had been reviewed in the legal department that the account was a joint debt owed by Mrs. Fausto also, that Credigy was a "Credit Agency" and that Credigy would report the account "forever" on Mr. Faustos credit file. Credigy's training manuals suggested to the Brazillian collectors, who were paid the equivalent of $400 monthly salary, to use the "coercion method," that credit reporting is the most important financial information for American consumers and to tell the consumer that their life will not be the same if the debt remains on their credit report. Credigy sued Mrs. Fausto claiming that its debt collection phone calls were confidential and seeking damages. Credigy admitted receiving the written cease and desist demand (sent certified mail) but claimed it made a ???Bona Fide Error??? in continuing its collection efforts. The jury heard testimony that the ???Dispute Resolution Team??? was confronted with stacks of dispute letters, was understaffed and told that no more resources would be made available because it cost the company money. Two employees who testified left Credigy because of physical problems they attributed to the stress of their jobs.

The collection calls only stopped after a lawsuit was filed. Credigy had scheduled the calls to continue until the year 2020. No records from any source, including Wells Fargo existed as to what was charged and what had been paid on the account. A consumer from Illinois (a victim of ID theft) and another from New Mexico (former husbands account) testified that Credigy ignored their request for proof that the debt was owed and that Credigy continued collecting upon them after having received cease and desist demands.

Credigy???s trial strategy was to attack the credibility of the Faustos and their nine children. Mr. Fausto had a second grade education and Mrs. Fausto received a sixth grade education. Neither spoke English. Credigy issued subpoenas to depose the majority of their children and sought banking, mortgage and medical records of them and their children. The trial court permitted Credigy to elicit testimony that Mrs. Fausto had been charged with driving without a license and hit and run of a child on a bicycle and that Mr. Fausto had been cited for driving with a suspended license and that the police arrived at his home to arrest him during the time period Credigy was making its collection calls. Credigy also introduced evidence that the Fausto???s borrowed a significant sum against their home in the name of their oldest son and that the house was the subject of a foreclosure several months after the collection calls stopped.

The Credigy defendant's filed nine separate motions for summary judgment and withdrew four of them following receipt of Plaintiff's responses. In denying the remaining five motions, the trial court invited a motion for sanctions to be filed because of defendant apparent efforts to unnecessarily multiply the proceedings
