Dear Ashley, This email is to confirm your fax has been received. Kindly resend a signed copy of the document. Regards, Cash Yes Customer Service 1-866-568-1419 |
Why would they need a signed document? I thought I read somewhere on the forum not to send in signed copies of these letters as some lenders can do shady things with your actual sig.

Shaz, it was basically a letter stating I know they're illegal in my state (LA) and that I fulfilled my part by paying the principal amount borrowed. I borrowed $500, but paid $600 (they debited my account for $150 on 4 separate occasions). I also asked them to refund my the overage and to stop all calls and communicate via mail or email.

To Whom It May Concern: As of today, September 25, 2010, I do not authorize CashYes, nor any representative, parent company, affiliate, or subsidiary of CashYes to withdraw any funds from the checking account under the name of, Ashley Coleman, account number xxxxxx, JPMorgan Chase. In fact, I have closed this account to prevent further unauthorized activity in this account. Your company is in violation of La. Stat. Ann. 9:3578.1 et seq. which states (in part): 1503 Licensure of Brokers A. No person having an office in Louisiana shall broker a loan in Louisiana unless exempt by statute, without first being licensed and complying with the provisions of the Louisiana Loan Brokers According to the Louisiana Office of Financial Institutions, your company is neither licensed nor registered in the state of Louisiana nor do you have an office in the state of Louisiana. Furthermore, your company is in violation of other sections of La. Stat. Ann. 9:3578.1 et seq. I have summarized the applicable sections below: Loan Specifications: •Maximum Amount of Loan - $350 •Term of Loan - 60 days •Maximum Rate of Finance and Fees - Documentation fee of $5 + $45 or 16.75% of check (whichever is greater); You have to pay 36% p.a if your default period is anything between 1 to 12 months or 18% p.a if default period is beyond 13 months) •Finance Charge on $100 loan for a 14 day period - $25 •APR for $100 loan for a 14 day period - 650% •Rollovers Permitted: None (cannot renew or rollover but licensee may accept partial payment of 25% of amount advanced plus fees and enter into new loan) In addition, your claim that the contract I signed is only governed by the law of the state or country in which your company resides is unsubstantiated. Your company accepted, and transacted business with a citizen of Louisiana. Thus your company is subject to the laws of Louisiana including usury laws and statutes governing small lenders. I am offering CashYes an opportunity to settle this account. To date, I have paid a total of $600 ($150 was debited from my account on four different occasions) on a $500 payday loan with your company. Since Louisiana law specifies that a payday lender must be licensed to legally lend to Louisiana citizens, I am only responsible to pay back the principal amount borrowed. I have been illegally charged $100.00 in excess. Therefore, I am expecting CashYes to mark the account paid in full and issue a refund in the amount of $100.00, the amount I have been overcharged by your company. I also require a paid in full receipt for the account in question. Furthermore, at no time will CashYes, any representative, parent company, subsidiary, or affiliate of CashYes place any derogatory mark on my credit report with any credit bureau, nor any other check writing database, such as Teletrack or any equivalent database. In addition, CashYes will not pursue any type of wage assignment (voluntary or otherwise) against me now or at any time in the future. I hereby revoke any and all wage assignments I may have signed with CashYes; this includes any of your affiliates and collections as well. You no longer have my permission to use this wage assignment. All telephone communication to my home or place of employment is to cease and desist and you will not contact my references at any time. All correspondence as of today shall be in written form through e-mail (using the e-mail address listed previously) or written letter through the United States Postal Service. If CashYes does not abide by the settlement conditions stated above, I will have no choice but to file a civil suit against CashYes for the monetary damages that I am entitled to per Louisiana law, and all legal fees that I acquire during the course of such a civil suit. I will also formally complain to, and request that the Attorney General of Louisiana, James D. Caldwell, the Better Business Bureau and the FTC to file criminal charges against CashYes for its illegal lending practices to consumers within the State of Louisiana. Please acknowledge receipt of this letter, and acknowledge acceptance of, and willingness to adhere to the settlement described above, in writing, within 24 hours of receipt. If I do not receive this acknowledgement within 24 hours, I will begin the legal proceedings described above. Thank you for your prompt attention and cooperation in this matter. |

Can anyone offer any advice on what my next move would be with Cash Yes? They're asking for a signed copy of the letter, but I'm worried they'd use my signature for other purposes.

Assuming, when you first received the loan you signed something, they should and are likely to already have your signature. As long as it can be debated that they added to something your signature, you can debate that the original signed loan agreement only has a copy (faxed or e-mailed) of your signature. If litigation becomes necessary your proof of any and all legitimate correspondence, as well as their desire to get your money and not give you a refund should keep them honest. Disclaimer: This is assuming they are legitimate and honest in the first place.

Resend the letter and, instead of signing it, use a script font to type your name at the bottom. If they try to use that, it's not your signature. I agree that they're likely stalling. Probably trying to get into your bank account while they're doing it.

I'll resend it again this morning. They can try all the they want to get into that account, but no luck as its been closed for close to 2 months. They've attempted ACH debits, but no luck. It's definitely closed for good.
What's really crazy is I tried replying to the email address they used and the same error message came back. I even used it from yahoo. So they can send you messages, but they won't accept. What kind of mess is that?

Try using a different email address, like a disposable one you can get off the web.

Your last fax has been received but it still has your type-written signature. Please sign the document with your actual signature using a pen.
Re: Your Cash Yes Loan #XXXXX
Dear Ashley:
I am writing on behalf of Cash Yes in response to your recent faxes. Cash Yes strives to assist consumers with their short term cash needs and is concerned that you were disappointed with your experience.
Please be advised, however, that your loan was made pursuant to Cash Yes???s license in its home country of Belize under the International Financial Services Commission Act of Belize, Chapter 272. Cash Yes???s contracts, including the loan agreement you signed, clearly designate Belize law as governing its transactions and provide all disclosures required by Belize and U.S. federal law. Cash Yes has no physical presence in the State of Louisiana, and does not solicit Louisiana consumers via mail, telephone, or email. In order to obtain a loan from Cash Yes, a Louisiana consumer must log on to the internet and access Cash Yes???s website, just as you did. You received documents in conjunction with your loan fully describing how the finance fees are applied and your repayment options, and you agreed to these terms, including the applicability of Belize (not Louisiana) law to the transaction, with electronic signatures in multiple places. Should you require another copy of your documents, or if you need clarification on points referenced in the documents, please contact us. A careful review of those documents should resolve your concerns regarding the terms applicable to your loan.
Notwithstanding the foregoing, we have agreed to settle the balance owed and have marked your account ???paid in full??? as of today???s date. Cash Yes is taking this action without legal obligation to do so because of our ongoing commitment to customer satisfaction and for no other reason. We hope that this action on our part will resolve your concerns.
Thank you for the opportunity to clarify this matter and address your concerns.
Sincerely,
Cash Yes
They are included in a class action filed by my office but I would not hold out much hope they will respond. However there is NO reason to pay them anything, not even the amount you borrowed, as they are an illegal outfit that cannot collect in USA courts.

I'm having problems with this company too. I had thought that they were a payday loan company in the US. I find out latter they are located in Central America and have automatically decided to debit my account for larger amounts of money then I had agreed too. I finally received a copy of there contract two months latter and I was told by one of there customer service representatives that it would be only six payments. $500.00 latter and they still want a $250.00 pay off. Can you give me any advise? I live in North Dakota and have filed a stop payment with my bank and have contacted my state attorney.
