Cash Yes Contact Information

Does anyone know if this is a good address to contact Cash Yes via USPS? I found this address on the BBB site. I'm trying to send them a letter notifying that I fulfilled our contract and am actually requesting a refund for overages.

However, on the CashYes website they have the address listed as:
Suite 508 Marina Towers
Newton Barracks Road
Belize City, Belize C.A.

I also tried emailing my letter and intentions their collections department, which was listed on their site, but it keeps bouncing back to me saying undeliverable.
Any information would be great as far as how to get in touch with them via writing.

Interesting. When I look on the Cashyes website, they have an "affiliate program." When you click on it, it only talks about Cash Jar. Are they one in the same? I have contact info for Cash Jar (who is a pain in the arse from what I've seen on this forum).

Have you tried faxing them? You can send them a fax via the Internet at free fax dot com, Their fax number appears as 1-877-898-3183 on their website.

So they replied with the following message below:

Kindly resend a signed copy of the document.

Why would they need a signed document? I thought I read somewhere on the forum not to send in signed copies of these letters as some lenders can do shady things with your actual sig.

Shaz, it was basically a letter stating I know they're illegal in my state (LA) and that I fulfilled my part by paying the principal amount borrowed. I borrowed $500, but paid $600 (they debited my account for $150 on 4 separate occasions). I also asked them to refund my the overage and to stop all calls and communicate via mail or email.

To Whom It May Concern:

As of today, September 25, 2010, I do not authorize CashYes, nor any representative, parent company, affiliate, or subsidiary of CashYes to withdraw any funds from the checking account under the name of, Ashley Coleman, account number xxxxxx, JPMorgan Chase. In fact, I have closed this account to prevent further unauthorized activity in this account.

Your company is in violation of La. Stat. Ann. 9:3578.1 et seq. which states (in part):

1503 Licensure of Brokers

A. No person having an office in Louisiana shall broker a loan in Louisiana unless exempt by statute, without first being licensed and complying with the provisions of the Louisiana Loan Brokers

According to the Louisiana Office of Financial Institutions, your company is neither licensed nor registered in the state of Louisiana nor do you have an office in the state of Louisiana.

Furthermore, your company is in violation of other sections of La. Stat. Ann. 9:3578.1 et seq. I have summarized the applicable sections below:

Loan Specifications:
•Maximum Amount of Loan - $350
•Term of Loan - 60 days
•Maximum Rate of Finance and Fees - Documentation fee of $5 + $45 or 16.75% of check (whichever is greater); You have to pay 36% p.a if your default period is anything between 1 to 12 months or 18% p.a if default period is beyond 13 months)
•Finance Charge on $100 loan for a 14 day period - $25
•APR for $100 loan for a 14 day period - 650%
•Rollovers Permitted: None (cannot renew or rollover but licensee may accept partial payment of 25% of amount advanced plus fees and enter into new loan)

In addition, your claim that the contract I signed is only governed by the law of the state or country in which your company resides is unsubstantiated. Your company accepted, and transacted business with a citizen of Louisiana. Thus your company is subject to the laws of Louisiana including usury laws and statutes governing small lenders.

I am offering CashYes an opportunity to settle this account. To date, I have paid a total of $600 ($150 was debited from my account on four different occasions) on a $500 payday loan with your company.

Since Louisiana law specifies that a payday lender must be licensed to legally lend to Louisiana citizens, I am only responsible to pay back the principal amount borrowed. I have been illegally charged $100.00 in excess. Therefore, I am expecting CashYes to mark the account paid in full and issue a refund in the amount of $100.00, the amount I have been overcharged by your company. I also require a paid in full receipt for the account in question.

Furthermore, at no time will CashYes, any representative, parent company, subsidiary, or affiliate of CashYes place any derogatory mark on my credit report with any credit bureau, nor any other check writing database, such as Teletrack or any equivalent database. In addition, CashYes will not pursue any type of wage assignment (voluntary or otherwise) against me now or at any time in the future.

I hereby revoke any and all wage assignments I may have signed with CashYes; this includes any of your affiliates and collections as well. You no longer have my permission to use this wage assignment.

All telephone communication to my home or place of employment is to cease and desist and you will not contact my references at any time. All correspondence as of today shall be in written form through e-mail (using the e-mail address listed previously) or written letter through the United States Postal Service.

If CashYes does not abide by the settlement conditions stated above, I will have no choice but to file a civil suit against CashYes for the monetary damages that I am entitled to per Louisiana law, and all legal fees that I acquire during the course of such a civil suit. I will also formally complain to, and request that the Attorney General of Louisiana, James D. Caldwell, the Better Business Bureau and the FTC to file criminal charges against CashYes for its illegal lending practices to consumers within the State of Louisiana.

Please acknowledge receipt of this letter, and acknowledge acceptance of, and willingness to adhere to the settlement described above, in writing, within 24 hours of receipt. If I do not receive this acknowledgement within 24 hours, I will begin the legal proceedings described above.

Thank you for your prompt attention and cooperation in this matter.
