Credit report shows lvnv funding listing – Why is it so?
Date: Sun, 06/25/2006 - 21:56
lvnv funding llc is a collection agency, additional DBA resurgent. Let me tell you, I haven't dealt with them personally. But what I have understood after going through the forum posts that LVNV reports consumer accounts to CRA without informing consumers at first place. That is the reason people get confused on why they are appearing on their credit report, might be their own business strategy, lol. LVNV prefer collecting charged-off retail accounts mainly.
Thought I should gather the information available on them, so that visitors find it easy to understand. Their addresses are:

Check them with BBB.
It is always suggested to send them request for debt validation through certified mail, if they suddenly appear in your credit file. If they cannot validate the debt satisfactorily, you can ask them to remove the listing from your credit file. You can also dispute the item with credit bureaus directly stating the collection agency has failed to validate the debt, hence it should not be reported any more.
Hope this helps, if anyone has any more information on LVNV, or if you have any updates, please post it here.
Here are some instances of their activities with other consumers:
- I noticed on my credit report that there is a company called LVNV Funding LLC for $3195.
- You were on my credit report and I have no clue why I owe you 2406.00
- I am purchasing another home and a derogatory tradeline appeared on my credit.
- I have not contacted this company to assume the debt nor have I signed any note. I have three questions...

David, thanks so much for the helpfull info! If you remember i have been dealing with them for months, they still haven't validated. Of course in my follow up letter to DV,I told them they had broken numerous fdcpa reg, rude, abusive, threatining, giving my info to a third party(wells fargo) and calling me during the DV process, maybe that't why i haven't heard from them. I was still thinking of sending a payment proposal to them, but maybe I should wait.Oh,by the way,If I am not mistaken,I believe that Phillip-Cowen is also associated with them,at least that's what they said. I was passed from LVNV to Resurgent,to Phillips-Cowen.Thanks for the great stuff :D ...Karen

Anyone have a successful battle with this stuff?
I just received one of these bogus "past due account" bills today...Has anyone had a successful process with this company? If so, what steps did you take?
The "previous creditor" is stated as GE Capital; and the "credit recovery" company is called Pioneer Credit Recovery, Inc., based in NY. Scam, scam, scam.
Thanks for any help you can give, and for previously posted info.
Thanks!

MCI bill / Park Branson / to LVNV Funding
I recently ran a credit report knowing that I have always had excellent credit. I found out that in April 2006 MCI reported that I refused to pay a bill. I have not lived at ********* in two years but my son Carl Jr does. I found out from him the reason he refused to pay the bill and even though his reasoning was liget I informed him that he should have let me know this was going on because the phone is still in my name. Anyway I contacted Park Branson on today and paid them $114.06 over the phone. The conformation # they gave me is 097***. They asked that I contact you to have this removed from my credit report.

'It all started when LVNV kept calling my home at all times of the day and night and even on Sundays. They said I owed a debt back in 1998 from a Mellon Bank, they said I owed over $7,000.00 and some change. I told them they had the wrong person but they kept calling and calling and calling. I asked them to prove to me that I owed this money. They never did. After I refused to talk to them anymore, my husband started talking to them. Some females would call and get really friendly and cozy with him and eventually convinced him that I ran up a charge card buying jewelry, shoes and makeup and also charging lunches and holtel bills. Keep in mind, they never sent me or him the proof....But he started believing them. They also told him if he didn't make me pay or he pay it then they would garnish his wages and take some of our belongings. So he made a little deal with one of the females and started sending payments. He was in a car accident a few months later and stopped making the payments because he couldn't work...But LVNV kept calling and told him, the deal was off for small payments and he had to send the lump sum. OF course he was able to and they started hounding him relentlessly. The females weren't nice anymore..lol. Well eventually he started harassing me for the money and I flat refused to pay since this was honestly not my debt. This caused so much tension and anxiety in our marriage that eventually we grew apart and were divorced. After this event with LVNV, my husband began to not trust me with gas credit cards and our checkbook because he said I would run up the bill. So without saying of course this caused fights. Now we are divorced and my x mother in law tells me that he is still getting calls from LVNV. They don't call me because I will not talk to them and I refused to pay a bill that was NOT MINE. Now I miss my husband and the relationship we once had before this bogus lie was aset on me. I'm so unhappy.')

To one of the posters who mentioned Pioneer Recovery. This is a firm frequently used by LVNV and their previous incarnation, Sherman Acquisitions. Pioneer sometimes doesn't keep the debt long, then LVNV farms it out to another agency or "attorney". They hope you'll eventually pay something, and bring the debt back into the statute of limitations. If you don't, and hold firm that they provide specific evidence, you usually won't hear from the again. They are a very stupid people, LVNV. They once sent me a card that had been signed (my forged signature), but the card had no name for any firm on it, LVNV, Capitol One, etc. nothing.

hi guys ... I came upon this forum searching for information on LVNV Funding, LLC. I received a letter, like most who have already posted, but the originating account is *with* LVNV ... the collection agency it came from is AllianceOne Receivables Management INC; PO Box 211128 Eagan, MN ... They say I owe $2051.81 ...
I haven't checked my CR in over three years, but I know for a fact that there are three (valid) accounts on the report ... none of them in this amount! Does this mean I have had information stolen???? How do I handle this one?????

I have proof of *all* of my debts ... even the ones that have been paid off ... the only thing that is outstanding is a voluntary repo of my car ... three years ago. Have you asked the CA to validate your account? Throw the ball in their court. They are legally required to prove that the debt is legit. Until they give you anything in writing, they can't do collections on you and cannot report anything in your credit copy. Be ready to file a legal case if they try to do something suspicious in your credit copy.
Is there any suspicious account in your credit report? Dispute the item with the CRA. Make them investigate the item so that you get confirmed about the reporting. If your dispute is correct, they have to report the item from your credit file.
Debt Verification Proof of debt
HI Everyone, when you request proof of debt from a collection agency or creditor and all they send you are copies of statements with your name on it, does anyone know if this is sufficient proof? LVNV has sent me this and this is not my debt. I'm just wondering what the law says abut sufficient proof, and I haven't been able to come up with anything.

Kay- that is not sufficient validation. There are sample letters to the side of your screen you can use to fit your circumstance. But don't expect LVNV to validate, they haven't mine for a year. And they DO share info. LVNV callled Wells Fargo, who in turn called me, and said they heard I need a loan and was in finfancial straights- I had never even heard of Wells Fargo before!!..Karen

The best way to handle to LVNV is to realize what you are dealin
The best way to handle to LVNV is to realize what you are dealing with-- a VERY CORRUPT junk debt buyer. They don't care at all about your problems, they just want your money and will do anything to get it. They will try to hide behind one collection agency after another. For example, if you send a letter disputing the validity to one of their collection agencies, they will stop using that one and send your account to a new collection agency to start up annoying phone calls all over again. And when they do send what they call "validation" it is nothing but a very small paragraph written on their own letterhead stating that they hereby validate the debt, which is meaningless and won't hold up in court because it proves absolutely nothing and a judge would laugh them out of court if they tried to use that as evidence. So, what I found to be effective with them is to send the letter disputing the validity of the debt and alleging credit fraud directly to LVNV by certified mail. Tell them that you are the victim of identity theft and that you believe all of the charges are the result of fraud and that you refuse to pay the fraudulent bills of someone else. Demand that they send you the actual credit card bills and receipts showing who signed for them, and what was purchased and where it was purchased. They have to respond to your letter by going back to the Original Creditor to get all of these records which costs them some money and gives you a huge amount of time before they will resume collection activities. In some cases they won't be able to find the information or the Original Creditor will not cooperate with them, and then if they try to take the matter to court, you can bring this back up in court through the motion for discovery, and win against them. If they can't get a judgment against you, then they will never be able to collect anything through legal means.

I'm well aware of the collection tactics of them!! Been dealining with their MANY agencies now. The only problem, it's not identity theft. It's an old cc opened up in 1982, no charges for 12-15 years, and we have been paying Sears all these years, stupidly. I feel we have paid 10x over what we charged in payments for 20+ years..Karen

Well, unfortunately the SOL for FL is 5 years. Which eliminates using that as your defense. However there is another defense that you may be able to use. LVNV is known for their record keeping, you may be able to request validation during discovery. If they can't you may be able to get the case dismissed as they cannot show cause for action. I would suggest going in this with legal council. You can start with naca.net for a good place to search for a consumer protection attorney.

LVNV Funding had contacted us we never paid as we never had money to pay it.
Well this last summer we started paying on it 50.00 a month I never questioned it as at the time they said it was Wells Fargo and we had a pick up repoed with them so I knew it was our debt. Now they are threatening sueing us as it is causing our account to go up. I asked for letters showing that they have the account ect and when asked I got hung up on so I called back and got hung up again. My husband called back we got a supervisor and again got treated nasty. When asked for information on LVNV I got told they don't have the information, I am dealign with Drs bondage. And that all of a sudden teh account is Wachovia well we never banked with wachovia they said they don't have to talk to me because I am not on the account. Well how is that possible when I am the co signer. Do we have any legal leg to stand on with this.
My husband is in the military this is a prior service debt. So the military said they can't do anything to his career wise.
I just don't know what to do I am so frustrated and ticked. I am just lost on what to do now. any help would be appreciated.
Hope this came out clear.

Do you know what the money is for they say you owe? Some CAs do this and athere is no account.
You can dispute it with the reporting agency and also send LVNV a debt validation letter to find out what it is for, if you don't know.
Before you pay any one off, be sure and get something from them saying it will be paid in full before you send the payment. Or you can write a letter stating that, you paying xx dollars that they say you owe, will be considered paid in full. Send money orders or something that doesn't have your bank info.
Please be sure that this is your debt and it is valid before you pay. If you need help, feel free to ask questions..karen

LVNV Funding LLC affiliates
The brady bunch of Sherman Companies: Sherman Acquisition Limited Partnership, Resurgent Capital Services LP, Sherman Acquisition II Limited Partnership, Sherman Acquisition LLC, Credit One Bank, N.A. Sherman Acquisition TA LP, Ashley Funding Services LLC, PYOD LLC, Ascent Card Services LLC, lvnv funding llc, Ascent Card Services II LLC, Anson Street LLC, SFG REO LLC. If you opened an account with any of the companies listed above, that's how they got to you. For our case, I was able to trace it when I opened a credit card with Credit One Bank last year. Then recently, LVNV comes into my credit report trying to collect a debt for Best Buy which I have already paid off 2 years ago. The funny thing is Best Buy also reported it as paid way back in 2006. I just sent my letters disputing the claims at the credit bureaus and LVNV - furnished our state general's office as well since it appears they have a branch in our area.
LVNV Also buying "settled" debt
A few years ago - I decided to erase my credit card debt with a debt negotiation firm. I was often late or didn't send payments and was up to about 24,000 in debt between several cards. I sucesfully completed the program (if 800 a month for over two years is succesfull, along with a suprise forgiveness of debt tax document here and there...). I have letters from all of the credit card companies saying the amount I had paid was sufficient to fulfill the obligation of debt (with forgiveness of around 25-45% of the total amount). Now - LVNV has items in my credit report for two of the credit cards that were sucesfully paid off - Discover and Sears. I imagine my best course of action would be legal counsel that deals with these sorts of problems.

Send LVN a copy of the satisfaction letter from Discover and Sears and ask them to remove the trade line from your CR. Also send a copy of that letter and the satisfaction letters to the Reporting agencies asking that it be removed.

you guys are all idiots. its perfectly legal to purchase bad debt to collect on and make the money. once you own the loan you can report it to your credit. only way to prevent this is to pay your bills. technically lvnv is not a debt collector, they own the loan/account you defaulted on. take responsibility dont blame others

Ryan,
1st LVNV IS a debt collector, regardless of their purchasing of the debt they were not the credit grantor therefore by federal guidelines they are a debt collector.
2nd, the original creditors (Sears and Discover) settled the account with the OP and sent letter to this fact. LVNV does not have anything to collect on. If the OC's sold them the balance erronously then that is not the fault or reponsiblity of the OP.
As to regards to pay your bill, he did and received a letter of satisfaction from the OC.
In regards to "you guys are all idiots" small minds resort to insults when they are outclassed.

too am dealing with them. They have a lawyer in my state (GA) representing them. They sent me a "verification" with name of creditor, amt owed, date of last payment" - I sent them back a letter requesting validation again and I stated "your verification leaves a lot to be desired and in no way resembles validation of this debt". Then they sent me admissions, documents request, etc. asking me to admit to all kinds of questions and provide them with documents. I replied back to which some of my answers were "defendant does not admit, etc". Of course the lawyers sends me another reply stating I did not properly answer his questions and I have seven days to reply or he will compel the judge to make me pay attorney fees. Why should I provide him with documents or answers, that if he has a case against me, he should have? correct.
