Trouble with LVNV Funding LLC

I've been paying a debt to GE Capital Sam's Club through a debt consolidation company. Last fall I received notice from a company named Resurgent Capital Services LLP, saying that lvnv funding llc had purchased my acct. from Sam's Club. Since they had my personal information, I took this to be true, so I notified my debt consolidation co. and made arrangements to forward my payments to Resurgent, not knowing that this was a collection agency. A couple of months later, Sam's Club started sending me late notices. Sam's has repeatedly denied that they sold my account. My payments are now being sent to Sam's, and they are current. Meanwhile, LVNV Funding LLC keeps selling my account to other collection agencies, and no doubt have reported this to credit reporting agencies. I've been through a very difficult bout with cancer and am still on disability. This problem has dragged on for months and months, and meanwhile my personal information about this account is spreading out there. Help.


Do you have anything in writing from the original company that they are receiving your payments? You need to ensure that the money is getting posted towards your debt account and the balance is getting reduced.

If LVNV Funding does not have your account info, they don't have the legal purpose to report in your CR. If they have put the remark, dispute the item with the company and get it removed from your credit copy.

Thanks for your reply. Yes, I've been receiving statements from Sam's Club each month indicating that my balance is going down.

Ive had this happen as well and the comapny really had no idea that your account has been sent because it was a mistake and the original company still has your account. If this is the same situation, Sam's club had sent your file with a bunch of others by mistake for baisic collection, but hasnt sold it to LVNV.
If LVNV had the accurate account info then this is probably what happened. If you havent done so, send all the copies from the collection agancy to sams ( id take it in personally) and show them the payments made to LVNV. Youll want to get that money transferred back to Sams club to show payment. I would aslo write a letter to head office detailing your problems with the collection agencies, and with Sams because they were not dealing with your situation. It was probably a clerical error on Sams part, but it has to be dealt with because as you say, your private iformation is being sold.

You dont want collection agencies to have ANY information on you because that can ruin your credit and collection agencies tend to make more "mistakes" and new bills youve never heard of will pop up on your credit file.
