They can only if the debt is vald because in the contract you will have given them permission. That being said if they cannot provide you with documentation in a timely manner then I would inform the bank that the debit is fraudulent and to block any and all future debits from this company, their affiliates, and subsidiaries.

Talk to your bank about this situation. I will not let Geneva Roth take out money from the account without written information about the debt. This doesn't prove about their legitimate business. Moreover, they must have your signature in the contract after which you authorize them for any kind of debit in your account. At present, it is only a fraudulent activity. I had a payday loan that Geneva Roth was debiting from they kept taking the interest and had no phone number to where they could be reached would send me no e-mails or anything in the mail with the option to paydown the debt. This has been going on for 14 mths at 90.00 a pop for a 300.00 loan twice a month. Do the math 2,520.00. So I contacted my bank and told them they kept debiting my account and I had no way of getting hold of them so I wanted the debits to stop. They placed a stop payment on the 90.00 debit starting this next paycheck. Will they take me to court over this I have paid more then enough to these people. Can they convince the bank to continue the debits if they do I will shut the account down payday loans are a vicious cycle, I will be glad to have my freedom back

If they are taking these via ACH then there is really nothing you can do. The only place they could have gotten your new routing and account number would have been you bank unless you contacted said payday loan place and gave them your new account.

Geneva Roth is being investigated and have been turned in to the FederalTradeCommission.
(1) Geneva Roth in 2002 sold accounts to another PayDayLoan called PDVentures. Clients that have paid in full and had settlemenets with PDVentures received calls from Geneva Roth saying they are back dated in paying.
(2) Geneva Roth is well informed and know that theses clients have paid, but still harrass for money.
(3) Don't you think that there recordkeeping sucks? Example: Clients fully Paid the firm Geneva Roth sold account to, then Geneva Roth gets accounts back in 2006 then "pretend" clients never paid? Clients explain that they paid..but Mr. Bradley here falsifies the truth by probably reading a script right in front of him, pretending he is in a legal department. Let's work on shutting them down.
Never get payday loans on-line especially Geneva Roth!
It's rediculous that pay-day loans on line charge you an extension fee for $80/ This dosn't help any client bring the amount down. Geneva Roth gets money for this when their clients ask for an extension. Their not there to help anyone, not even the hardworking father who needs to help his family.
Better to go to a "real PayDayLoan Office" - they have no extension fees. All PayDayLoan Physical Offices are decent, legitimate and work out payment plans and their much easier to pay back fully on the next payday. They will warn you about on-line payday loans.

geneva roth ventures kept taking money out of my account so i closed it and switched to a different bank. i filled out an online debt consolidation app and somehow geneva roth got my new bank info. they put through 3 debits and when i called them, a woman named shirley (who calls my job quite often) tol me that once i put my info online it is fair game and they considered it as me updating my bank info so they have every right to take the money out. she was very nasty and told me she was going to fax over my contract to the bank so they will let the debits go through. i NEVER gave her my new account number and it is NOT on my contract that i originally signed with them so is it really legal for her to do this to me? this will be the 3rd account i have had to close because of them!!!

I don't think they can legally take money from a different bank account. You have to give authorization for the money to be taken from your account. Go to your bank and talk to them about the withdrawals. If you have to you can do a stop payment for withdrawals from them. Be sure the bank leaves the amount blank, or they will simply take out a different amount. This will stop all ACH from this company. The bank will charge a stop payment fee for this service.

I had a pay day loan out over five years ago and now Geneva Roth has debited my account for $89.67. Back then I had some fraudulent problems with the account and had to close it. I called the payday company and informed them of the matter. Can Geneva Roth still take money out of my account for something over five years ago even if I didn't give them permission to take it out of my new account?

I would never fathom putting an ACH through on an account our customer didn't authorize. I would expect them to file a complaint against me if I did.
I don't understand why banks are so meloncholy about this whole thing. Like they don't care... "nobody could possibly be putting a transaction through without your permission, stop wasting our time."
Sound like someone needs to file a class action against the banks for letting all these ACHs go through.

Despite its Utah license Geneva Roth operated from 1923 Foxridge Dr., Kansas City, KS. Their loans aren't even legal under Kansas law and since they aren't in Utah, they can't even argue that their Utah license allows them to lend under Utah law to people outside of Utah. A good class action attorney could have a field day with Geneva Roth.
Need advice
I had a pay day loan with Geneva Roth and they also took 90.00 dollar instalments from my account since I figured it was their way of taking payments. I didn't think much of it until they kept taking 90.00 twice a month causing me to overdraw my account. Later I closed my account after many attempts to make contact with them with no responce and they called within two days to complain and threaten to take me to court. I live in Wyoming and have spoken to a lawyer and he told me that since the 90.00 dollars they are taking out never went towards principal but instead went "to keep the loan active" that I should contest the loan in court but to make sure that I have all debt paid plus 36% does this sound right?

(Somebody double check me please, because I'm coming up with that from memory. I'm not 100% on the rate or the rollover limits). Where he comes with the extra 6%, I couldn't tell you.
