National Enterprise Systems: How to deal with this debt collector

HEllo and thank you for this valuable resource!

I'm having some trouble with National Enterprise Systems.

They have been calling several times a day for weeks. I have had some shouting matches with them and they have threatened to call every single morning, first thing "so we're the first thing you think of when you wake up."

So when I did get a contact there and discuss my debt, she threatened "legal proceedings" if they don't get a resolution immediately.

I was scared and gave her my bank info for an initial payment after the holiday. Now I think that was a very bad idea (read somewhere that they will often take more than was agreed), and am scared about what they might do.

They keep calling constantly. When I try to get this particular contact on the phone, she is always busy.

What should I be doing here?

This company called my home everyday for over a week looking for my one of my children who had moved out 4 years ago. When my daughter called them they were rude and tried to intimidate her. Turns out they were looking for someone with the same name but a different date of birth and ssn. They were fishing. And they told her that they obtained my phone number from a credit card company that I do business with.
While they claim that they are deleting my phone number from their records I am going to contact the attorney general of my state. This was harassment.

I started receiving phone calls from NES last week. I was told that I have a student loan that is in default for the amount of $19,000. I was told that if I make a payment of $2,000 immediately and set up payment arrangements on the remainder of the balance that they would forgive 40% of the debt. The problem I have is that I have received absolutely nothing from NES about this account. The loan in question was still showing in deferment as of August. Now they are telling me that the student loan is in collections because it is over 180 days past due.
am barely making my house payment and feeding my family right now. She said that she did not care if I lose my house and that I must be doing alright because I have a house.

I am not sure where to go from here. Any help you can give me would be great. Thank you

i got them with help of a lawyer if you live in california you should contact this guys their so good , they got me sum money from this suckers .

Oh it most certainly IS. And for that you can thank our government who bailed out my mortgage company, who capitalized on that free money instead of being open to any kind of loan re-negotiations, re-financing, modifications, etc. Because of this, I am bankrupting and you will never collect a penny from me. EVER. Just like I will never see any kind of assistance or willingness to negotiate my situation from our government, or anybody else for that matter. Like them now, I don't care. And if you don't like that, too bad, because quite frankly, their attitude, though calloused and immoral, enables me to sleep at night. And it's nice.
So. As far as I and many consumers go, you're wasting your time.

What state are you in? The SOL makes a big difference. As far as credit reporting, they can report it correctly for up to 7.6 years and then it has to be removed.

unfortunately if you didn't get it in writing that the collector won't sell the balance.alot of collectors do just that.if you got a letter from NES get a DV letter out asap.send it certified mail return receipt.

Great thread. I just received a call from NES, this is for me, please call 18005679990 regarding important something or other. I did not answer because Unknown number came up, I never answer those, did not call back. I called TFS to see if they sent my debt to collection agency, they said it went to NES. Nice. I had my car voluntarily repo'd, Lost job in June, unemployed since. I live in WA state, owe approximately $10000 on it. My question is, should I call back? I mean, am I legally bound to call back?

I was told on 12/23/2009 if I payed $4000.00 on a student loan that Sally Mae had agreeed to the settlement. now they are telling me [NIS] that i owe $800.00 more , because Sally Mae didnt accept that settlement even thou thats what Brian Gray , the NIS represenitive had said, and im sure is on tape since they claim our conversations are recorded,we have been back and forth for two weeks over this matter so today I've had enough and called and stopped payment on the $4000.00 that i did pay them.!!!!!

I have recieved a call from NES and they are telling me that I have to pay the full amount of the dept up front that they dont take payment plans. I told them I couldnt pay the whole amount and if I could I wouldnt be in this mess. Then she said that she could maybe but not sure to make it a 4 month plan. I would have to pay more then what I even make. Is this true do they not take payment planes?

As a former employee of NES I want to clarify that this company will take any settlement offer. For example if you have an account with Bank of America they say they will only accept 50% settlement offer. That is garbage. They will take anything. They can accept offers all the down to 30%, but if it is under 40% it has to be approved by Bank of America..which all the time it is.
They are a bunch of hungry hounds there. You can talk to them and they say that "This settlement offer will not be good next week, you have to set it up today"..GARBAGE! You can call up at anytime and they will take your money. They are hungry money hounds and they are in it for your money. They push for you to set up payments by the 20th of each month because that is the closing date for commission checks. That is another thing..NES employees get nearly around 22% to 34% commission on accounts..depending on what state you live in.
Another off subject topic about NES is the employees that are working there. From being a past employee there I have noticed the large amount of employees that go in the parking lot and smoke up there drugs, then come back in the building to collect. Kind of scary thinking that people who are under the influence of drugs are making phone calls to debtors and taking payments. Every employee that is hired by NES is "drug tested" which every employee that works there will tell you that those drug test results don't matter to NES. They will hire anyone at anytime! They have even hired individuals with criminal backgrounds. Only if the FDCPA and NES clients knew about this!

I recently got in touch with NES after they were bombarding me with calls. The have offered to cut the amount i owe in half. I do not know if they are legitimate and if I should give them my account information. I suppose I should call my credit card people to find out if they are really working with them or not... they were asking for my routing number.. what should I do? I need to know asap! Please help!

Actually...no I don't work for another bottom feeder..I am employed by a company that gives me a salary and where I can actually use the college degree that I have! And not sit on the phones like I did at NES and feel overqualified.
I could careless what happens to NES..I have no intentions on reporting them or taking further action. I thought other individuals on this site would like to hear what happens behind the walls of NES when the collectors are not on the phones.

that's great!!!!!!!!!!!again i also couldn't care less what goes on behind closed doors.just about all the time it's made up BS that a disgruntled ex-employee puts out.don't want to report it,then don't bring it here.

I made an agreement with NES that if I paid by a certain date that I could get a discount and my account would be settled in full.. I just check my acct with the other people and it states that i still have a large balance to be paid. I have a letter dated before I made the payment, who is at fault NES or the other company.

I received a phone call from Mike Miller at NES this week for a balance owed to Toyota Financial. My car was repo'd in January. He reduced the balance of $2200 to $1300. I thought this was a golden opportunity to pay my old car off and be done with it. I naively gave them my routing and checking account number. I don't have the money to pay the $1300 at all. I got nervous and agreed to it because I didn't know what else to do! I felt cornered and now I feel foolish and scared that I won't have money to pay for gas and food.

Now I'm reading all of these posts in this forum and am feeling dizzy and sick to my stomach. It's 3/18/10 and they're supposed to withdraw the funds on 3/26/10. I'm so stressed out and don't know what to do.

Is closing my account and opening another one so they don't get any money illegal? This is what my bank and some friends have advised. I'm nervous about doing this.

Do I send them a debt validation letter certified? I'm so uneducated about this and don't want to talk to anyone there because I don't know my rights.

Someone, anyone.. please help!

I JUST got a second call from this company; YOU KNOW them, as they said and threatened exactly what you said. I don't know the account #, they say that the credit card company is threatening to sue me. The lady (debateable) on the phone demanded my phone number at home, I told her I didn't have one. She asked what did I do during the months I was off work. She said to get my dad (where I stayed) to put my balance on his card, then I could pay off his card. She demanded his phone number! She went from hateful to RUDE when I wouldn't give her a phone number, saying, "Well, how am I going to call you if you won't give me a phone number?" I said, "You won't." She became angrier and angrier. I "smelled a rat" at that, so I asked for information about the company, other questions. She said I had until 4 PM today to do something about my delinquent account and started to hang up! I almost missed her, but she heard me and came back to the phone. I said, "You want to give me a phone number to call?" She said, "Oh, a phone number." She gave it to me and hung up. I intend to do something about these people! The bank I owe? I'm going to CALL THEM and work it out. To heck with that ol' bitty!!!
Do you have any other advice? I'm going to check out everything you say in the article about "dealing" with this company, to include recording them. I believe she just broke the law.... Thanks for this site, I sure do need it today!!!
