ok..i need help i am soo stressed out.. i had a credit card with associates that i opened in 99 i stopped making payments in 01 since, i was pregnant and didnt work..in late 05 i started making payments to midland credit management of 50 a month on a 1600 debt..i defaulted in one payment and then they transfered my acoount to nelson watson and associates they contacted me on dec. and they told me that i needed to make a payment for the whole amount or they would take further legal actions against me..so i agreed with them to make payment on the 20th of dec and 20th of january of 50 dollars until, i obtain my tax refund to pay them off..now the problem is that i wont have the money until the 2nd of march and NOW theres problems they want their money or else they are telling me that they will take me to court..what is the statuate of trying to collect on debt? i live in florida..they are making it seem like i dont want to make payments and being difficult..they even told me that it was my fault that i dont have the money since i should of filed my taxes diffrently....HELP WHAT SHOULD I DO???


I fell behind on some payments to Capital One due to lofty court costs and attorney's fees during a child custody case that lasted almost 2 years. Capital One turned me over to Nelson, Watson & Associates, who relentlessly called me, my wife, her parents, and then my ex-wife trying to obtain personal information about me. They shared my credit information with my ex wife, who then called my employer to shame me by telling my boss that I was a loser who couldn't pay my bills. (I won custody by the way, and she was retaliating.) Nelson, Watson & Associates DENIED ever calling a third party. They are liars and use unfair and illegal business practices to try and get what they want. I work 70+ hours a week, am a divorced father who just got my 2 young children out of an abusive household with their mother and step father, and am trying to make a good life for us all. I'm no deadbeat dad, or a bad person...nor am I a criminal. I have made payment arrangements with Capital One that I can afford given the circumstances, but they continue to call their "dogs" out after me. I've filed a complaint with the FTC and will file a civil lawsuit if this continues.

Can a civil law suit be filed against Nelson Watson Associates by any of these folks if there are repeated offenses on the part of Nelson Watson...it appears from this site and several others that they continue to take measures that seem to violate the protection rights of the people they try to collect from.

My view: I'm more than happy to deal with any creditor that I owe and will work with that creditor. But if the creditor won't work with me, the deal is off. As for collection agencies or junk debt buyers, I owe them nothing. I had no dealings with them in the first place and will never deal with them in the last place. And it doesn't matter if the current law allows any kind of "assignment" because my position is that I have to be a part of the agreement to assign MY account to anyone else; I have to agree that my personal information and social security is scattered to the four winds. I'd never agree to that. Play hardball if you play at all with the bottom feeders. Most often they're toothless.

Its a shame that such threatening techniques and lies are used to scare people in times of serious financial despair. I think the credit card companys and other institutions of this kind deserve to have there ass beaten. They throw credit up the limit to everyone with convenience checks telling clients..." Take a vacation, buy that gift you always wanted, pay for home improvement, ect., and try anything to get you to use the credit and once trouble comes with paying your bill because you are out of a job like about 10% of the country is they want to put the screws to you if you don't pay up. Lets see would I rather eat, have clothes on my back and shelter to protect me on unemployment checks or pau some asshole creditor that could care less. I think the priorities are clear what most of us would do with the lean income we have without jobs. Besides all this...what was Obamas Bailout package for the credit company about? Didn't they get their money from the government to pull them out of the hole? And isn't it us the taxpayers who are the ones giving the money to the Gov't to bail out these companys.? What's the deal??

Here's my experience with Nelson watson associates (NWA) / capital one credit card ... First of all I had a capital one account with a balance 2400. I contacted capital one when I knew that I couldn't make the payments 9+ months ago (they said that there's nothing that they could do to lower my interest, or even close the account and setup monthly payments at a lower interest rate). So for the past 9 months they haven't got any money. After 9 months of constant calls to my home and work (of which I ignored) and getting back ahead with a few medical bills and figured I could start paying them again, which by now they sent the amount to NWA. And when I spoke to NWA they demanded that I needed to pay the full amount. Over the course of a few hour conversation and "making it sound like" they were filing court papers and the best they could do was 3 monthly payments, which of course I didn't have. So I was like whatever file with the courts and I'll worry about payment then. So this last weekend I got a letter from capital one saying they'll work with me and setup payments at 0% ... I'm like ok I'll call the number, which is forwared to NWA when I call it. First I talked to a nice lady, then after she got my information transferred me to the a-hole of NWA. He had the same song and dance as before "you need to pay or else" (and he had a lot of "or else's"). Then I said I got a letter from capital one saying 0% interest and pay over time, then he changed his tone and was very reluctant to say the least to set anything up. So after 9 months of working/not working with CapOne/NWA in the end I got what I wanted, lower interest rate 0% and monthly payments that will pay off the balance in a few years. Don't know why they couldn't give me that option 9 months ago (would have saved them time and got them some money and not f'd up my credit score). Also the last person that I talked to at NWA was probably the rudest person that I've ever talked to on the phone, dushbag.

Nah.Not me.I'm not going to any court at any time and i don't have to so stated by 2 different legal councils.
Told both law firms i have NO money,out of work for 2 years.Lawyers said i can either go bankruptcy OR do nothing but send cease and desist letters to anyone who bothers me on the phone.
I am what is called...judgement proof in that i have NOTHING to give...NOTHING.
So...any creditor can do nothing to me.Sure they TRY to scare me but i tell them it won't work,i don't care about my cerdit and don't want any,ever and i know there is NOTHING legally they can do and i just say which lawyer outfit do you want to talk to and they shut up.
Credit ranking means NADDA to me anymore and i will never have any use for a credit card.
Even if i get a letter saying i need to go to court i don't have to since i have nothing to give then all they will do is write off the amount just like a bankruptcy would do anyway...duh.They can't arrest you for owing money since if that was the case then millions of ppl would be locked up!
MOST collection folks are either..ex-cons,ppl that cannot get real jobs and such and hope all their hype of upsetting ppl works so...BE/STAY calm ppl. They all record the call(so they say) but if YOU tell them YOU are recording their call they hang up,now what's all that about!? YUP..Caught ya!If YOUR calm and record them,then if THEY start yelling etc then YOU have them by the nuts!
SEARCH for laws etc online and do some homework so when they next call YOU have the upper hand.
SEND a cease and desist letter via mail certified/return reciept then they MUST stop calling you completely.
Works on any collection agency and if doesn't work then YOU have all the right to sue them!
I did that with a company that wanted about $300.00,i have nadda and they don't care about that they just want their $ so YOU must NOT care about them either.
IF you do owe then get a validation letter of the alleged account wchich will show you if YOU are the real person owing any $.
Do the online searching and gather information BEFORE getting upset then follow what you have to do.
LOG. DOCUMENT. PHOTOCOPY.LIST CALLING TIMES THEY CALL YOU AND WHO CALLED.DATES. and so forth.
YES! Collection companies have way to much of leeway to say things and they prey on ppl so..DON'T listen to them if they become abusive,stay calm and get names,times etc.
AND REMEMBER...RECORD THEM AND TELL THEM SINCE THEY ARE DOING IT TO YOU THEN YOU ARE DOING IT TO THEM.
Don't think they don't mess with any tapes they have on hand...i'd bet they mess with most of them to their favor since their reputations are ultra poor in so called customer service.
There is a ton of information on the web so...do the homework and gain the upper hand.
IF your like me and flat busted,no job etc and don't care about having credit then don't worry there's nothing they can do(least in my state),IF you do owe then find out what the "original" amount is,who it's owed to and contact them to make payments,they must take payments from you,you don't have to use a collector outfit.
It's NOT our fault we owe someone since the economy crapped out but we get stuck anyway.
Bankruptcy is a solid viable place to turn to,yes it is! Sure it is on your record BUT within a year or sooner you can have a credit card again since you cannot file again for a LONG long time.IT is NOT the end all of the end for ppl going bankruptcy,just be careful of what a law firm may charge ya.Mine would be 1200.00 or possibly free since i have NOTHING,nothing to even sell for money and i wouldn't give any to a collection group,i'd pay the original creditor and nobody else if i had any $.
BE CALM,GATHER INFORMATION,LEARN-LEARN WHAT THEY CAN/CANNOT SAY-DO AND SUCH THEN GO FIGHT BACK AND PLEASE DO THE CEASE AND DESIST LETTERS PPL.After a cease letter they cannot call you at home,friends,work,or anywhere!
IF you can afford it then try to lifelock thing,where you pay (i know it's money from ya) to LOCK YOUR credit file from ANYONE looking at it without YOUR permission.Yah,ya have to pay a small fee to unfreeze it so YOU can look but it's worth the money to LOCK everyone out of YOUR life.Its' been on cnn and clark howard's site.

Me? I'm done with credit and don't even care one damn bit.Yah i get upset if they call but i try to relax and just tell them i'm judgement proof so bye-bye and my cease-desist letter is on it's way!

OH,if a creditor replies here DON'T believe them,it's just like a phone call from them and what do they do? You can figure that out yourselves.REMEMBER: the collector get's a "comission" per $$ brought in meaning MOST that call you want you to pay since THEY get a bit of the pie too! That's part of why they act they way they do on the phone,they want money too.Tell them to get a real job of which i doubt they could.
Me? I'l find work and once i do i'm going bankruptcy so....NO $ to any of them...yea!

i was reading these posts for helpful info. I have a credit card with capital one. this is my only high balanced credit card. i am now dealing with Nelson Watson ans Associates and i do not appreciate they way they treat me or even talk to me. Courtney is the main one Ive been dealing with. she harasses me and my friends/family. somehow she pulled records from my nest friend and called her. i threatened them with the fact that they do not have permission to do so and they backed off. im sick of dealing with them! i have payed over half the balance in January and they made me schedule 4 more payments throughout march and April. i there any way i can avoid speaking/dealing with them and talk to Capital one or someone else??? im cooperative but im sick of them.
