I have 8 pay day loans from the internet in Florida. If I close my bank account and reopen a new one, is there any way they come after me on criminal charges?

I can tell you for sure the 500Fastcash is illegal. You only owe them $25.

I have had a couple of loans with them in the past. This time, after I had already paid over the principal amount, I closed my bank account and sent them an email stating since they were illegal in my state, and I had overpaid them I was not going to pay any more. I have since gone to their website and the account is marked as Paid in Full. I still get emails from them offering new loans!!! :shock:

OK, here is what I found on the companies:
PaydayOne - legal - you would need to work out an arrangement with them

Zip19 - illegal - do you have a current loan with them? If so you would need to pay back the amount borrowed only
United Cash Loans - illegal - they owe you $130
500fastcash - illegal, as stated above you owe $25
CAN - illegal - you owe $210
CashStar - illegal - you owe $210
VIPCash - ? - i'm leaning toward illegal, if so you owe $100

I also have payday loans in Florida and am looking for help I am in way over my head and do not know what to do. Here is a list of what my husband and I have:

The laws posted above for Florida DO NOT APPLY to internet lenders. Florida uses the Chapter 516 of the Florida Consumer Financial Act for small loans. It puts a 15 percent cap on them and requires them to be licensed regardless of their geographical location. The law was just amended recently but I can't get a reply from Sam Whited at the office as to its interpretation. However if they are not licensed they are not collectable. That applies to all small lenders. The laws posted above are designed for the storefronts who are strictly governed in Florida.

Florida statute 516 is called the Florida Consumer Finance Act and is the only law that is really applicable to Internet lending. It regulates loans under $25,000 and states that 18% per annum is the maximum interest rate that an UNLICENSED company can charge on any loan. It specifially states that any loan from an unlicensed company with a rate of interest higher than 18% is NOT ENFORCEABLE in Florida. That means that they cannot sue you to collect on the debt.

You can look up which companies are registered at http://www.flofr.com/ under "CF Businesses." I am also attaching the list to this post in excel.

Licensed companies may charge between 18% and 30% per annum, but there are only about 125 different companies that are licensed.

This law does NOT apply to companies operating under bank charters, etc.

I have about 7 internet payday loans. I live in Ohio and I just want to make sure that if I have paid the loans twice over in service fees can they sue me. I closed my bank acct because they were causing my acct to overdraft in numerous fees. They are calling me at work constantly. This lady from Fox Enterprises called today and said I took out a loan for $300 and owe $512. Is there anything I can do? This has really stressed me out. It's nice to know that I'm not alone!

Thanks for the info. I have already filed a complaint my AG regarding Fox Enterprises and Midland. What should I do now with the ones that owe me money. Should I provide this info to my AG office(the rep thats working on my complaint). Fox enterpises called me and said they represent Midland as well. The guy was calling form Glacial Star Group in NY. I asked him for their address and he was very hesitant in giving it to me. I told him they were legit why is he not wanting to give it to me. I told him I was working with a third party and they would be contacting them. He tried his best to get the 3rd party info from me. The address he gave me is

I would report them all to the FTC, attorney general and the BBB. I was able to get settlements/PIF's and in 1 case a refund through the BBB. I would also look up Glacier to make sure they are licensed to collect in your state. Some of the pdl companies will use an unlicensed/illegal collector to try & get the rest of their money.

First, I have about (5) PayDayLoans in Floridafrom 2007..all internet.
-Cashnet-(licensed)-$450-Already made arrangements
-Arrowhead-$500-made arrangements, I guess
-Shop Online-I cannot get anyone on the phone
I have absolutely NO clue about the other two because they changed names....

Now, for the past couple of days all these evil "Investigators" have called my parents home.
My main concern is from a company called Legal Jurisdiction Support Services LLC. They called my previous employer, spoke w/ one of my co-workers who advised them that I no longer work there. Then they told her if I do not call back I will publicly humiliate myself. She then asked if they were from collections and he smugly stated, "she wished ma'am". She must contact us immediately or legal action will follow.
I freak naturally. I call the number back and I speak w/ a young guy who tells me that a summons has gone out, and asked if I had firearms or large animals at my home. He then stated that the amount I owe is about $1600. I then asked who is this for? He finally states Arrowhead Investments. He was very concerned that I was upset and talked to the "lawyer" and now I owe only $586. They scared me so much that I paid $250 today and they will take the balance on 12/30.
After researching I found out that these tactics were in fact illegal , Arrowhead is not registered in Florida as well. They also said the collections agency for Arrowhead tried to reach me. Untrue. This was NOT even on my credit report.I called an attorney, and then called the company back to get an address. The line was disconnected. I tried another line and some woman answered. I told her about the disconnected lines.
I called the number back and magically they worked!!! I called her back for an address and she abruptly said " You are not getting out of this" and hung up!!
My questions are:
I have NO idea what I owe and to whom..I am scared because I do not want to be summoned or taken to jail.
I read in another forum that they cannot use the "bad check" charge if it is an ACH draft...is this true? How do I find out what other PDL companies say I "owe" money?...HELP PLEASE!!!

Have to PDL's One is with the dreaded Loan Point USA/Chieftan Fnd Inc. I don't even remember borrowing this one. I assume it is $300, I have paid $539.99!

The other is PayDayMax.com, $500.00, I have paid $325.15 so far.

Can you give me the info like you did the others , so I can move forward on getting rid of them please! You guys have been a God send.... I have been reading this site for a few days!

I took out a payday loan over the internet from BMG Marketing Group and now have change their name to JHS Marketing the loan was for $250 dollars and i had to close my account due to overdraft charges and now they say i owe $402.50 and they are going to turn me over to Clark County Nevada and take me to court can they do that and i only missed two payments and they have been refinancing every two weeks since January. Pleas help they called my job.

Hi i live in florida and i remember applying for a payday loan online but i never got any money from anyone and now i am receiving calls from payday loans that i owe 600 to 800 dollars and i am for sure that i never got any money from them what can i do? and they also threaten me to send me to jail if i didnt pay them back immediately. I forgot who the "lenders" were but next time they call me ill ask.

Hi I received a call from a person stating they are coming to serve me at my home in Florida regarding a payday loan, they did not have my correct address nor my e-mail address. I did take a few out in 07 but I honestly don't remember form whom, I lost my job, my home and was about 6 months pregnant at the time with my first so, memory really wasnt too clear then, I slepted a lot and was really ill. Either way, what are the Florida laws on this loan company and the collections company that purchased it. Please help me i am curious to know because they are very sneaky and obviously not in Florida. Below is a copy of the letter they sent me and correspondances there of.
