My loans
mycashnow 538 internet based I've already paid 500+ towards this loan and I haven't even made a dent in the principle... I still owe 538 dollars:(
paydayloans 500 internet based which is now over 600 bucks

I'm located in New york

any help or insight is greatly appreciated... I'd like to fix this before my next draft cycle:(
i was thinking about just signing up with a consolidation company...

Neequa
state: new york

neequa, hi! :D Just to let you know, I see you reside in New York. Neither one of these pdls are going to be legal to lend to you, okay? I'm going to post your state pdl law just so you can see it. However, let me ask you, have you considered doing anything with your bank account (close/block) so these illegal companies can no longer debit? I can post some information for you to read regarding that, too.

Hi Cannr, thank you so much for your response. I was completely ignorant to fact that they were illegal to lend in my state...Can't say that i'm suprised though. I am going to read over this info you gave.. Also in regards to my account.. i didn't close my account but i did re-route my direct deposit to another account.... I get my check and all my money is gone. I've been trying to pay them back but geesh i have a infant to feed and the interest on these loans is a killer....

i don't even know where to begin...

neequa, when are your debits scheduled to hit your account next? We can see if you have time to close your bank account or if we need to put a hard debit block on it to prevent these guys from debiting you any more. The first step is to get the bank account to the point to where they can not debit & you won't get any bank fees. We have to get the account "safe".

Cannr, they are scheduled to debit my account on the 30th of this month... (wednesday)i can call my bank and try.

neequa, try to get a HARD DEBIT BLOCK on that account. NO debits will go through. Not even your stuff, so you'll want to open a new account somewhere else so that you will have a "working" bank account. It might be too late to actually totally close the account, as the pdl debits are probably already pending. If they're pending, they'll force the account back open and you'd be hit with the pdl debits and bank fees. If at all possible, can you go to the bank and speak with the branch manager? You need to get a hard debit block on this now. Customer service can't help you, the tellers can't help you, the branch manager is the way to go.

neequa, once you go to your bank, let us know what happened. Try to not leave that bank until there is at LEAST a hard debit block on that account. Once we know your account is "safe" from the pdls, we can send some letters out to them, okay? We just need to do the bank thing first!

Hi Cannr,
i went into my bank and she explained that the best way to ensure no debits could be made would be to close the account and open a new one. I did that so that's the end of them debiting me.... step one done.

neequa, did they assure you that the account would not be forced open? I'm paranoid of this happening. So, you have a new account, correct? And they won't be "linked" in any way? I told you, I'm paranoid! If you feel as though your bank account is safe, we're going to move on to step two, okay? This is going to be sending letters to your pdls. I need to know the amount you borrowed from each one (principle amount only) and how much you have paid back TOTAL to date. Can you do that for me? We can see where you stand regarding them. I can post a letter for you to use as a "guide" (you'll have to change it to fit your needs) for you to send to the pdls. Also, once the letters are done, you're going to need to file complaints with the BBB, the FTC, and your state AG. Okay? First, let me know if you feel confident regarding your bank account. And, then post the dollar amounts regarding your pdls. We'll move forward! Congratulations on getting the first step done! :D

Good morning Cannr, yes she said that there is no way they can link the two accounts unless i give them the new account number which she told me not to do. She was very helpful and she explained that if i kept the other account even though there was a block on it... it wasn't guaranteed that they would be able to stop the debits.

Here's the infor from the loans
MYCASHNOW: LOAN $600 PAID TO DATE $702.84 BALANCE DUE $563.57

PAYDAYLOAN: LOAN $550 PAID TO DATE $137.50 BALANCE 845.00

sheesh do they make money... smh.

Neequa, since they guys are not licensed to lend to you, every penny you paid them goes towards the principle amount of the loan, okay? So, actually, here are the numbers:

my cash now
Borrowed: 600.00
Paid: 702.84
OVERPAID: 102.84

Pay Day Loan
Borrowed: 550.00
Paid: 137.50
OWE: 412.50

So, you have one that you've overpaid. And I'm sorry to say, but My Cash Now will probably not refund you any money; however, always ask. And you have one that owe towards the principle on. So... are you ready to send out a couple of letters and file some complaints against these people? :D

I was having the same problem with Interim Cash. I live in the state of Michigan and borrowed $200 and to date have paid $250. I closed my bank account and now of course they are calling me at crazy hours. They called me on Monday morning at 3:58 a.m. I have sent them a cease and desist letter via certified mail and I have also emailed this cease and desist letter. Today I got an email from them saying that I have agreed to let them debit me on May 2nd!!!! Does anyone have a fax number for Interim Cash so that I can also fax this letter to them???

Okay, neequa. I can post a letter for you to use. You're going to have to change it to fit each particular pdl. Change the wording for the one overpaid one to reflect the dollar amounts and demand a paid in full and a refund of xxxx dollars. Change the wording for the one that you still owe towards the principle amount to reflect you will ONLY be paying xxxx dollars. Okay? I'll post the letter. If you have any questions, just post!!

It's me again. Thank you for the Interim Cash info. Should I call them and tell them that I did NOT agree to allow them to debit me further? Or should I leave it as is since my bank acct is closed??

You can send them a letter revoking debit authorization. This way, you'll have something in writing. Also, include on there to only communicate with you via email or USPS - no telephone calls permitted. Since your bank account is closed, you're good. But just send them a letter. Use both addresses that were posted, just to be on the safe side.

Neequa, if you typed in an address or if you used one of the addresses they have on file, the bbb web site will send you to the website for the bbb of the address you entered. File a complaint wherever they send you...if the address is incorrect, you can file again. I used part of my pdl letter for the bbb, not all of it becuase they limit the space when you file on line. I used the original letter when I filed with the AG as documentation that I sent letters. There is no reason to write a new letter if you do not have to.

The New York attorney general sometimes will help, but most times will not. I am in New york and the 7 loans I had are all done with. It seems that once these pdls hear that you are in New york, they tend to Vanish.I dont think that it will be all that hard especially since you only have the two loans. filing may be a waste of time. All I did was send them letters saying I was in NY, loans are illegal, I paid the principle back and that eneded it for me.

kashan, that may very well be the case, i sent the letters the day before yesterday... before i was receiving 8+ calls a day.... since the letters went out i have not received 1 call from either... I'm just nervous that they will somehow find their way onto my credit report.

Mornin cannr, they sure didn't, but the number they called me from was thier regular number just a different extension.... and then this morning i received this letter via email from mycashnow
We have received information from your bank that the bank account has been frozen in which you authorized to be debited in order to repay your legally binding loan obligation. Therefore, we must require that you render your payment in the amount of $601.27 via western union quick collect or moneygram immediately. This payment reflects your balance as of May 2nd 2008.

We are aware of many variables that may cause an account to be frozen. This situation can be rectified immediately by sending your payment to us today using the following information:

If you are unable to pay $601.27 for the entire balance on the loan, then we must require a minimum payment of $200.42 to place the account on legal hold.

If this account is referred for further review and forwarded to our outside firm for additional collection efforts, it will commence activity on the account to be done to the fullest extent the law in order to protect our interest in this matter. At that point, you will be responsible for all additional fees associated with costs involved for the collection of this debt.

Please call us immediately to avoid other action and charges to you.

I would highly suggest you call 1-866-645-1661 to resolve this matter immediately. This is the only way for you to resolve this very serious situation, which you have initiated. Your failure to do so may result in the above mention action being taken.
