Just received a letter from Richard J Boudreau and Associates llc re: being retained by LVNV Funding which evidently bought my debt from Chase Manhattan Bank. Naturally, they want a settlement etc. Looked them up on line and it appears that they are not a reputable company. also if I am thinking correctly, I do not have to deal with them since they are not the original creditor. Is this correct? should I send them a cease and de___ letter. They called at work today and left their name for me to call also and have called 3 times at home.


Richard J Boudreau and Associates llc are a bottom feeder JDB, send them a DV letter along with a limited C&D letter advising them to stop calling your work and home and to contact you by US mail only.

DO NOT ADD any "limited C&D" to anyone collecting for LVNV. LVNV considers any limitation of contact as a full cease comm. Add that all calls to your employer place your employment in jeopardy and at the bottom state:

you should send a limited c&d in most cases.however,in LVNV'S case you should be careful how it's worded.they have taken people to court in response to C&D letters.so now i'm saying it as well guest how about that?

Again, I'm not posting my opinion. I am posting my experience. I don't know how to make it any clearer other than to post the actual words of LVNV/Resurgent's response. I cut and pasted it straight from the e-mail received from the BBB. Most, if not all, of your posts are one sentence answers that don't take all the facts into consideration. In my opinion, following your advice w/o taking all factors into consideration is dangerous. We're here to help people. Your advice is incomplete does not accomplish that goal.

Nascar, I am speaking from experience as well, I have sent several C&D letters to CA's that were calling my cell phone, my relatives, neighbors, friends, etc. The calls were stopped after they received the letters. I believe that each case is different and needs to be handled differently each time. I agree that we ALL are here to help those seeking help. I don't provide the long answers to some of the post here, hoping that you guys can provide the long answers or the OP can do more research and study the fdcpa. When I came here several years ago, I didn't know squat and was run over by an attorney that was able to get a judgement on me. I am now prepared to fight any and all lawsuits that will be filed against me, thanks to this forum. I may not win, but they will know that I will not lay down and let them walk on me again. If I offend you by my posting the short answers, I apologize to you. Keep up the good work that you do and just remember to please be less critical towards others that are only trying to help someone that needs it. Did I forget to mention that I am a disabled person that has had several strokes and almost blind? Could be the reason for the short answers? I always read your post because you are very helpful, so continue to do so. "PEACE"

Guest, I've been there too. My ignorance a few years ago resulted in my wife having 2 judgements awarded agaisnt her. I had to take the blame on that because I naively trusted a 1 sentence answer on a forum much like this of "You're in Texas, they can't do anything to you". To my chagrin and embarassment, that was not exactly true. I'm a lot better informed and experienced now, 5 years later. You stated that I'm a newb to the board but trust me when I say to you that, while being relatively new to the board, I am in no way a newb to the process. I think my posts prove that. I, like you, would hope that people will put forth a little more effort in their research. Everything I've learned is out there, I just had to make the effort to find it. Of course, not everyone has access to PACER and Lexis-Nexis and the like, but if you do some digging, its there. When I started my whole credit repair process, it was entirely self serving. Once I realized how wide spread the abuse from collectors was and the percentage of the population that had no idea what their rights were, lets just say that I have become a closet consumer advocate. It has become my passion and more than a hobby. My wife doesn't understand my obsession so I have to turn to the people of these forums. Anyway...."Peace"

Unc, I have had several strokes including 2 severe one that have erased most of my memory, I was a registered member and once had a log-in name, but I can't remember it or anything that happened in the past. Not asking for any credit for seniority, only patience. Maybe I should discontinue my posting altogether.

I'm in a kind of similar situation, except I've (unwisely) been paying Richard Boudreau et al a monthly installment on my debt. December was to be my last month and final payment, but today I received a call from their office telling me I actually owe them another $860. What she said exactly was "someone made a mistake and miscalculated your total." They want to arrange payments for another three months. Naturally I'm pretty upset about this (and wish I found this site this time last year, haha). I'm not really sure where to start; the CA is claiming the $860 as "assigned interest from the client." The only documentation I have of this amount is a letter from them, upon which I suspect they could have entered in just about any arbitrary amount. any advice/help/suggestions are greatly appreciated.

I have several unsecured credit cards that I have not paid on in a long time. I pulled my credit report and it shows on majority of them that they are charged off, collection,Transferred or closed, Purchased by another lender, etc. There was a time when I could not pay any of these but now I would like to pay something on my credit cards. Would you say not to do this or to pay only the one's that say purchased by another lender or transferred or in collection. I have looked at debt settlement and the DMP and everybody is telling me to stay away from these kind of companies just needing to know what I should do.

Any help would be greatly appreciated.

Have you checked the statute of limitation of these debts? If not, then please check whether these accounts have passed their SOL.

If the accounts are charged off then your credit score has already been damaged.

I've been getting lots of home calls from them as well. Received a letter asking for settlement for a client LVNV Funding, LLC and some original creditor called Hips, both of which I've never heard of or have not had any business with. I've been suspicious of them because the only creditor that I would owe the approximate amount to would be Sears. So, I called Sears and they sold my debt to an entirely different company. So, I have decided not to respond to Boudreau and try to find the company through Sears.

I have no idea why, but, apparently this 'law firm' just took posession of my child support case. I was working with supportkids and was beginning to get payments for the first time since 2003. Is this legal? No one at supportkids will talk to me. I am just told to contact them for information.

I hope these guys are ruthless. If they aren't, I will never see my money. I'm going to be calling their office today. If I don't get satisfactory answers, I'll be getting an attorney and just have him arrested on federal charges and be done with it.

Child Support IS considered a debt and can accrue interest just like any other debt if not paid. I have the same question about SupportKids selling their accounts to this Boudreau firm...my fiance was paying through SupportKids and now they have shut down and have said they have sold the accounts to this Boudreau firm, I need to know if we HAVE to pay these people for the support or do we have any other recourse, we want to pay the support but I am very leary of paying through some debt collector, especially when they aren't even located anywhere near where either of the parents in this case reside.

This forum does in fact contain a great deal of buzz about Richard J Boudreau & Associates, LLC, which apparently seems to be the new owners of many thousands of child support debts formerly being collected by another collection agency called SUPPORTKIDS. I too received an email with little to no information and am a little concerned about what the future holds for income that is greatly needed. I am sure the other people in this forum asking about the connection between the two collections agency's are just as concerned as I am and I have decided to do as much research on this company as I possibly can. No harm intended for your forum, just people trying to find out information that is most likely very important.

I am on the other side of this - took me 15 years to start getting the court ordered child support coming in - this debt will carry into my ex's ESTATE but whatever, he made his choice not to pay a mere $200 per month. If I were you, I would have my fiance contact the attorney generals office for child support in your county and see what they have to say...I am still doing research on this company and I don't like anything that I have seen so far. I didn't enter into any written agreement with them and I need to find out more information before moving forward.

But that is what the person was trying to tell you. SupportKids "transferred" all their cases to this RJB & Associates. Many parents haven't received the checks supportkids received. Now the ncp's are not getting credit for any payments and kids are not receiving their support. RJB took over SK and they are a collection agency. The person was asking a legitimate question in regards to dealing with these people.

To be more specific: child support is not a debt as defined by the FDCPA.

The point is, we cannot help you here. You need to go to your local District Attorney's Dept. of Family Support.

I do not believe for one second that they are not doing everything possible to get you your child support. I know how aggressive they are, not only have I worked for them (in the payment investigation department) but I have known people who have to pay child support and they are merciless to collect it. I even knew a person who had a nervous breakdown and ended up in a mental hospital and STILL had to pay all their back child support. They will even not allow you to have a Passport or even request that you be extradited if you are in another country, if you owe over a certain amount of child support.

I also do not believe for one second that they would turn over child support to a collection agency when it is a legal matter. It is possible though, the IRS is turning over some back tax accounts to outside collection agencies, so anything is possible. But you (or the person who owes) would have *NO* rights or protections under the FDCPA for either child support or taxes owed.

CONTACT YOUR FAMILY SUPPORT DIVISION.

Richard J. Boudreau & Associates, LLC is an attorney office that does collections. As for the child support enforcement, your case was not "sold" to them. SupportKids basically defaulted on a loan agreement and the cases were used as collateral. I have not had any problems yet with RBJ (knock on wood). They answered my calls and questions. I have even received my check from them, on time in fact. The people complaining seem to be the ones they are collecting from. RBJ probably are very overwhelmed right now because this happened so quickly. I would just be patient when trying to reach them. It probably caught them off guard too.

Ok so I was going through supportkids, my mom set it up but Ive been doing all the work. Like the last person said they defaulted on a loan and turned all work over to LLC. Now there trying to get information to all the people concerned and sending packets to fill out. Doesnt take but a minute and they already paid for the shipping label. Now concerning with checks I have not recieved one yet, but in the packet you can set up direct deposit which you couldnt do with Supportkids. So thats a plus. The BBB says they give them a rating of F but thats on the collection side. In my opinion I would say try it out for a month or so, and if your not satisfied then go through the state.

Richard J Boudreau & Assoc. is a collection agency but yes they bought child supports cases from SupportKids in April 2009. It is considered a debt because they now own the the contract you signed with SupportKids and the are collecting on the amount owed on that contract. Most people whose contracts were sold to richard J boudreau & Assoc. are not happy. Go to topix support kids. They are friendly and very helpful. Unlike that last post here that I just read.

Wow. I have checked this out a bit. It seemed odd to me that one would use a collection agency (which is bound by the FDCPA) to collect past due child support. I guess that there are some states and counties that have ineffectual district attorneys. It is appalling to me that some states/counties are so incompetent that people have to hire a private firm. Wow.

And again, it ISN'T a debt as defined by the FDCPA (it is NOT a line of credit handed to someone based on an ascertained ability to pay or a simple Transaction). On top of that, since 1998 with the passage of the Deadbeat Parents Punishment Act, it is a Federal FELONY - i.e. it is a Crime!

I have 2 checks out there somewhere and a new payment scheduled to be taken tomorrow. Everytime I call Boudreau they tell me to wait or either they want to charge ME to put a stop payment on it. I received my check dated 03 June on the 26th and I checked and it only took 3 days after they remailed it. I am getting frustrated and I am beginning to believe all the negative stories about this company. I will be calling them to set up direct deposit!
