Hello,

I received a court summons from a local attorney on behalf of a collections agency (LVNV Funding LLC) who purchased a debt from an original creditor. I was SHOCKED to be served with a summons yesterday. I have been working hard over the past 6 months to pay off debts and build my credit and a court judgment would ruin all of my progress. My husband is deployed in Afghanistan for a year, so I am already extremely stressed. Now this is making me feel physically ill.

What are my options at keeping this from going to court? Should I offer to make payments? If so should I contact the attorney or the company suing me? Or both?

Any advice is greatly appreciated.


You answer the complaint by saying you can neither confirm nor deny because of lack of validation. LVNV has purchased your debt but they do NOT have the documentation to prove it. Paying them will not help your credit since the original creditor has already charged the debt off.

They hope that you will not show up for court or answer the complaint so they can get a default judgment against you. That is the only way they get their judgments.
