I am now dealing with them. I get nasty voicemails all the time and when I did speak with someone who was a "lawyer from New York" she would make demands of stuff that I couldn't do. So I agreed with her just to shut her up. She threatens to sue but I have no job, no money no house and no vehicle. I will file bankruptcy if I have to but I will send some small checks to them and they can either deal with it or wait until later when I have the full balance. I will deal with collect america through the mail. I'm not dealing with that lawyer. She can do what she needs to do.

for those who are having to deal with the horrible pepole who work for Collect America there are two websites that will help you greatly in getting them off your back and determining if you debt is even valid. One has information about how bad Collect America is and how to get them to cease and desist in contacting you and the other one will tell you how to get the information to determine if your debt is even valid and your rights under the Fair Debt Collection Practices Act

they will settle, and they will settle well, but you have to be persistant. they also do sue. they harrass there collectors for lawsuits leads. and they leave hardly any leeway for the collector they hire to help the consumer. they dont use law firms. they use traditional collection agencies and based on the law if they normally sue, they can use it as a threat if they intend to do so. this loophole makes it possible for them to mislead consumers into thinking there , old credit card account, is with a law firm. but it isnt. when i was threatening legal action and working for these slugs, i never met one legal representative.

the public unfairly critisize bill collectors. its the banks that dictate the practices collection agencies use, via trickle down tactics. bill collector are just well paid people trying to make a living. they dont take the job home. some colllectors are forced and brainwashed into thier styles of collections. dont blame the little guy. remember it is the banks that want the bankruptcy code rewritten, not the debt collection industry. we make more money by being nice anyway. I am filing for bankruptcy. I added Collect America's account to my list of unsecured creditors. Guess what? They had a false address on my credit report! The court sent the 341 notice to:

1291 Broadway STE 3850
Denver, CO 80202-3025

Obviously, the mail was sent back. Now I have to try to find the correct address. Does anyone know why they put this address on my credit report? Is this a common practice? Why do they do it? Can they they get away with it?

I work for Collect America...

1. The credit card companies are crooked and use preditory pracitices to encourage people to run up debt.

2. If you people weren't so stupid, greedy, and immoral you wouldn't have to worry about running up all the debt and getting calls from collection agencies. You pathetic people whine about the credit card companies and the collection agencies being mean to you. If you had read your contracts you would know it was all going to happen to you. You didn't read your contracts, you were blinded by greed in trying to define yourself with material posessions and supplimenting your pathetic paychecks with someone else's money. Learn to live within your means, and if you don't like your means then go to school and get better jobs. Otherwise shut up and accept that you did this to yourselves.

3. The attorney offices that Collect America hires are real and you will be sued if you don't pay. That's about all there is to it. I, personally, am supervising over a thousand suits every two months. And there are five more people doing the same thing in this one office.

4. File bankruptsy or shut up. You all threaten to do it and never do. If you don't want to lay in the bed that YOU made, file bankruptsy. But you better hurry, you have less than a month to file before the law changes and it'll be damn-near impossible to get a chapter seven.

You people whine about everything and use stuff that happens after the fact to justify your greed, dishonesty, and theft. Reguardless what the credit card companies and collection agencies do, you wouldn't have to worry about it if you'd just stop using the credit. Learn to live within your means and you'll never need credit. You are no less horrible than the bill collectors you hate, and possibly worse. And just so you know, I don't care if you have property or a job, I'll sue you anyways just because I think it's funny and it's a good revenge. You also shouldn't be opening credit if you don't have a job you morons. You all make me sick, the debtors, bill collectors, and creditors. All of you are disgusting.

i never recieved nothing from this company about any past due debt. i recently checked my credit again and now these greedy money hungry people are trying to collect money for i don't even no what for. they say its for some account opened in 2003, 2 years later they are going to put this on my account, i haven't moved i have been at the same address for the past six years. so if they sent anything i would have recieved it, i have never recieved anything from the original creditor demanding payment for defaulting. so whos really pocketing the money? you collect america employees should be ashamed to fradulently take money from people, you are the ones that make me sick, to think its funny to sue somebody for revenge you will get whats coming to you sooner or later, some people can't certain situations with the way this economy goes. what makes you stupid f@*ks think there going to have the money to pay if you sue them,your company beter be careful before there shut down for fraud.

Collect America attorneys have nothing that stands in court. They do sue - and if you respond to the court, they fold, every single time. If you ignore the suit they win by default - this is the only way they can win. The judge over my case even chastised the attorney for C.A. in his ruling. Defend yourself (and how's Harrison Ross Byck - world's stupidest attorney and close personal friend to Attorney's General everywhere)

Who ever is complaining about a collection agency giving them a hard time, needs to own up to the fact that they are the ones in the wrong, not the collection agency. If you would have paid your bills on time and at least tried to negotiate with the original debtor, you never would have had them calling you in the first place. Don't complain because you overextended youreself and tried to ignore your own repsonsibility. I realized hardships happen and things can sometimes happen, but there are a lot of ways to get help form other sources. By the time your debt got to collect america, don't deny the fact that you knew it was coming for a while. Quit wining and own up to your responsibilities!

I think a lot of people come on here and miss the point of why everyone is here. A lot of us are here because we know that we are in debt and we know that we owe money, however the point is some of these collection agencies are breaking the law.

Because a person did not pay a creditor is no reason for them to be harassed by a third party collection agency. Some of the original creditors are unwilling to work with the debtor.

But whatever the case, I think we are all here to get help, seek advice and get out of debt. A lot of us come here and we share our experiences, so that others can learn from them. I think everyone that comes here is responsible, because they want to get out of debt without being harassed or threatened.

My husband had a large debt and was contacted by Vengroff, Williams & Associates,Inc. It was actually a very positive experience, the collection rep really cared about my husbands situation, actually helped him vicariously, get a dormant business back up and running and truly helped my husband and I resolve this debt and improve our lives. This man was special.

That's true John Smith. Not all of them are bad. There are certain collection agencies that hold satisfactory report with BBB. It makes me remember of the debate we had a few weeks back and there we had a discussion on the same fact.

Actually whenever we get a collection call, we get panicky, as the experience with collection agencies is not satisfactory on an average. If we hold our nerve and handle the situations carefully, lots of trouble will be eliminated right away.

I am a fraud victim, collect America will not take their claim off my Experian report even though I have talked to them and sent them my police fraud report many times. I guess they are hoping to make my life so miserable I pay a dept that is not mine. Scott Lowery (and I use the term freely)Law should be investigated. I am planning on writing to the N.Y. D.A.

Nina,

You can contact D.A. of your state. It's baseless to pay the debt that is not at all yours. Have you contacted Experian? Send them a letter to dispute this particular entry. They are supposed to make an investigation and they will rectify your report if the account is reported incorrectly.

For the time being, add a statement to your credit report that you dispute that entry. Credit bureau will be sending this statement along with your report in the coming days.

The problem is that debtors are looking for some way out of paying there bill. I agree having been in the business for 10 years that we have some shady operations out there. But that shouldn't be a loop whole every time some debtor decides they don't want to pay their bill. I have been in the business for 10, years and owned and agency with over 35 collectors, and we never had any issues with the law. Period. If you pay your bills you wont have a problem.

This is not true always. Anyone might have some real trouble to pay the amount; it doesn't mean that he is looking for some way out. If someone tries to pass up his debts, nobody out here would support him.

But that does not justify the unfair debt collection practices! collection agencies should follow the rules stated under fdcpa, which they rarely do.

Obviously there are good collection agencies as well. Check the debate we had few weeks back-

We just received word from our lawyers that the address 1999 Broadway suite 2150 Denver, Co is NOT correct. I am trying alternative addresses.

To the "debt collectors" or employees of this company- let me tell you a story. My husband worked for an energy company in Houston. We owned a 4000 sq ft home and had great credit. When greedy Enron's bad press hit, my hubby's company had to let his whole section go. We paid our bills for a year, even though he was unemployeed. We paid our mortgage. I even spent my inheritance from my mother- over $50,000- to keep up payments as we didn't want to be "deadbeats", as so eloquently listed above. Then- the $ was gone. Our home was foreclosed on and our car was stolen. We buried our baby boy in April 2003, buried my Mother in September 2003, and lost two more babies in 2004. Our lives were already hell and we were being driven crazy by creditors. People who we'd PAID even though we were eating mac and cheese everynight! Now, just as my husband has a good new job, we file bankruptcy. And THIS company is using false addresses or playing jokes? We're trying to rebuild OUR LIVES! Bankruptcy/credit problems are an everyday occurrence. It happens to rich, poor, and us- middle class. I'll bet we make more in a year now than most of the people working for Collect America, but our credit is gone so we pay almost 2000 a month in rent for a house we should be owning! We didn't lay about and eat bon-bons! We used every frigging cent we had to pay off creditors, but it was never enough! Because of Enron, there were so many houses for sale in our area of Houston that 4 in our neighborhood ALONE were foreclosed on! Just remember- not everyone gets to be a credit problem b/c of laziness! I spoke to every creditor we had, but their bag of tricks was too much. Sending our account to 5 different credit agencies, or lawyers- just be honest and tell us what to expect. I cooperated and paid as much as I could before we went broke. Now we pay double the rent we should and more for a car loan than someone with NO job! We live paycheck to paycheck and HAD to file bankruptcy. Even w/o the creditor payments (which we kept up until we were OUT of money)we are 1 paycheck from the street! And we're considered UPPER middle class! Sorry- but there is no excuse for lumping all people into one classification as deadbeats. And furthermore- if people get into credit problems, it is often the fault of the credit card companies who try to hook everyone. I take my punishment and so does my husband. We've been punished enough. This bankruptcy was supposed to be a new chapter in our lives. Not if Collect America has its way! be upfront and publish the correct address for this company- do something right for a change!

The lawyer that founded it, Phillip Scott Lowery, was fined $1.6M for harrasment and DIS-BARRED in the mid-90s. Some perspective, huh?

The collection agencies pay for the debt then try to collect on it. The debt may not have been "sent."

Be sure to check out budhibbs site as well as they often have nothing to stand on -- especially if you have filed bankruptcy and discharged that debt.

D.B. Cooper, I find it hard to believe you are employed at all, let alone employed by Collect America. You "supervise" lawsuits? What the hell does that mean? Either you are a lawyer, in which case you litigate, not supervise, lawsuits, or you are an administrative assistant, which means the only thing you supervise is a Xerox machine. But even a janitor who works at a collection agency knows how to spell Bankruptcy.

The money owed to original creditor is not owed to YOU. Not all people are trying to shaft the Credit Card companies, many are honest working people like yourself who have been thrust into circumstances that make day to day living - IMPOSSIBLE with out some relief. It is a GREAT prejudice on your part to assume otherwise. If you ever find yourself in a financially devistating situation - I hope you will find people who care- unlike yourself (MR OR MS PERFECT). My husband paid off his chargeoff debt years ago. Collect America updated Equifax and Trans Union but failed to update Experian. We have disputed through Experian three times only to be told we must dispute through Collect America. We have sent numerous letters, left numerous phone messages (we can never get to a person. "All agents busy, please leave a message") and have never received a single response. Such an easy fix on Collect America's end would have major impact on us but they are missing in action.

My mother put my name and social security number down on a credit app. So I would have the use of her card. Unfortunitly, I never had the card to use. She eventually fell behind on payments and the charges snowballed, sending the account to collections. Now they are garnishing from my paycheck to pay the bill I am affraid to file fraud because I do not want to send my own mother to jail for her huge mistake. What can I do?

Perhaps your mother signed for a voluntary wage assignment. You can verify it from the papers provided by your creditor. You can cancel this by sending them a revocation letter.

You have not mentioned in your post whether your mother is capable of paying her bills or she is dependent on you. Anyway, you have few options in your hand-

Contact the collection agency and ask them to stop taking money from your paycheck. Ask them to validate the debt and then make suitable payment arrangements.

Or, you can contact with your creditor directly and inquire if they can accept the payments. Don't forget to make written agreement before paying to your creditor or collector.

If you feel the whole process very complicated and troublesome, consolidate it. credit card debt consolidation is a good option and brings lost of benefits in your way.

We are currently being threatened by these individuals who apparently don't do their homework. I am an accountant and when I asked for all of the legal proof not a spec was provided, just more harrassing phone calls. Harrassment only works for collectors that have only intimidation going for them and not any proof. Collect America lacks professionalism by all means.

It's good to see that you are standing your ground and asking for validation before dishing out cash for something you're not fully aware of. Since you have asked for validation, and are only receiving harassing calls, have you thought about making a complaint and taking it further?

I just recently was served court papers saying that CACV was suing me for a debt that happened 3 years ago. I never heard from the original creditor about this debt. I recently pulled my credit report and found Collect America on it. A couple of weeks later I received phone calls from a law office saying that they were representing CACV and that they demanded payment in full. I was not able to take the phone calls from them due to medical problems, so my fiancee contacted them on my behalf. This law firm was rude and they demanded the payment of 1500.oo, plus interest, plus their attorney's fee. My fiancee explained the situation, which was that at this time all I could do was to make monthly payments to them because I was not working due to my medical condition. They refused. They said that why don't I borrow the money from family/friends. I told them that I didn't want to do that, that I would make payments. I just filed my answer at the court. It was very hard, since this was my first time doing that. I just think that if they want to collect a debt they should be willing to work with the debtor instead of insulting them. I know that I owe this debt and was willing to give them monthly payments but they are not willing to work with me at all. I'm waiting know to see when I get my court date and have to face these lawyers.

I am sorry to hear about your situation. The accounts get transferred from one CA to another. You should deal with only that company that holds your account info. When a CA asks for a payment, the details of the debt account should be given in writing. This is called debt validation and the collectors are bound to follow it.

You can work out arrangements with the original creditor after explaining these problems. They will perhaps, pull the account from the CA hired for the purpose.

Collect America has the rights to report in your credit file only if it has a legitimate purpose. They must not hit your file with negative information unless they have your info. If they were not authorized for this collection, you can dispute with the bureaus and get the item removed from your file.

They pulled my husband's credit and now claim to have no idea who we are (we filed a complaint with the BBB). We have no delinquent accounts, nor have we EVER had a delinquent account.

They are a bunch of jokers.

bully for you,and your perfect credit, but let me say this, hope and pray that you never loose you wonderful job and are forced to feed your family with your credit card until you get another one. It is so easy to judge people and write them off. Your must be one of the blessed for whom nothing goes wrong. Very few of us are driving around in escalades, very few of us get to go on vacations, put braces on our kids teeth, or even just have expendable emergency cash. And just remember this if it were not for us the dreggs of society, racking up all this dept YOU WOULD NOT HAVE a JOB. I hope that you never have the suffocating feeling of being so far in dept that your children have no lunch money, your husband is in dispair, and you wonder if one day he is going to snap and end it all for all of us. When people like you call and treat us like the scum of the earth and give us no way out, thats when weak people snap. So anyway you carry on looking down from on high but remember you could so easily be inthe same position and be receiving a phone call from some just as hard assed as you seem to be.

My husband and I worked out a "settlement" agreement with Mrs. Johnson at Collect America. I was to make two payments of a certain amount and then we would be settled. After I made the first payment, I called and talked with Mr. Truesdale and was told that Mrs. Johnson no longer worked there and never had the authority to make a settlement agreement and that all I had done was make a payment toward my account. Don't they record these conversations. Isn't that their problem if their employee makes arrangements with someone and they decide that person is not authorized to do so or fires them?

cacv took agreed on a specific amount to settle a $9900 credit card. I paid them $4500 of this and now they are suing for 19.494. I am suing them for breach of contract. Contact your fair debt attorney in your state before you pay a penny. They are scum!

The actions you described are typical for Denver atty Phillip Scott Lowery. I would file a complaint against him with the Colorado Supreme Court Bureau of Attorney Regulation. His attorney registration number is 15130. Also file complaints with the Federal Trade Commission and the American Collectors Association. Scotts new law office address is 4500 Cherry Creek Drive South, Suite 700, Denver, CO 80246. Scott recently sold CACV aka Collect America Collection Vehicle for $350 million to KRG Capital. Scott still plays a very active roll at Collect America even after the sale. He and his wife Texie Robins Lowery recently purchased a new home located at 201 Gore Creek Drive, Vail, Colorado 81657. You may reach Scott at home by calling (970) 476-0399. His father is Denver atty Phill E. Lowery. I know you will find this hard to believe but, Scotts daddy has a disciplanary record on file with the Atty Regulation Bureau of the Colorado Supreme Court. Now imagine that! sure, people get into situations that can create difficult times. why run to credit card companies? no body put a gun to your heads. i promise you that you people had other options, yet you RAN for that avail credit to bail you out. i don't understand why people think they should be entitled to NOT be harrassed for owing money. like you need a 4000 sq ft. house, 3 cars and 4 different sets of prada purses. get real. like the guy said earlier in this post. LIVE WITHIN YOUR MEANS. read you the contracts you sign, and when the time comes to pay the piper, don't whine.

perhaps i should refraise this...

if you owed ME 5 grand for over 3 years... you'd be lucky to not owe more in hospital bills once i got my hands on you. feel lucky that all you get is threatening and harrassing phone calls.
