PDL/Bank Help

Some company named STCAdavance took a total of $148 in random amounts of my account, i have no idea who they are. I also took a pdl with Impact Cash, but shortly after, sent a C&D letter to them, but still withdrew $75.00 from my account. This is illegal, correct? (Im in North Carolina, and pdl's are prohibited in this state). I went to my credit union today, and they put a credit only hold on my account. Unfortuantely, my account is now negative over $200 because of this, and bills that i had tried to pay have bounced, so i have NSF charges on top of it, and I cant open a new account until it is positive. They said that I have to fill out a police report and such to get the ball rolling. I just want to be sure that I am doing this correctly, and even more so, that i am not doing anything illegal! I had to sign a document at the bank with the 4 charges that I didnt authorize (3 with STCadvance and 1 with Impact Cash) them to take money out of my account. I just want to be sure I am doing things correctly!


The Electronic Funds Transfer Act gives consumers the right to revoke authorization on reoccuring transactions. Since the transactions were not reoccuring, I don't know if you will be able to get the funds back. It's really 50/50. You said you sent them a C&D letter - Did you mean a letter to revoke authorization to debit your account?

Filling out a police report is not a good idea. What are you going to say? I took out some payday loans, now I don't want the money paid back? If you had been paying on this loan for quite some time, then maybe I could see it working, but as is, I would say do not file a police report. What your bank was probably thinking was that there was ID theft involved. Nothing criminal has occured here.

Correct, i sent them a letter telling them that i revoked them to debit my account.
I didnt feel comfortable going to do a police report either, but since I told the bank that I sent a C&D letter and that I also didnt know who STCAdvance was, that they wanted to file it as fraud. So now what do I do?

I accidentally hit the reply button before I was finished typing :roll: . But yes, i have had other pdl's taken out. One with arrowhead, but i am working with them on a payment plan. WideWorldCash was sent a C&D letter last month, and I set up a block (which i know sometimes doesnt do much), but they have been well paid off now for a long time (I paid them over 1300 in fees alone). But I havent heard anything from them since complaints to my AG and BBB.

Hmm . . . . It's a hard one. If the company can prove that the transactions are legit, the bank can come after you for the money (if they credit it back to you).

But if they aren't going to do anything without a police report, I'm not sure what to tell you. I wouldn't file a police report unless you are 100% sure that it is fraud, and that this company isn't in any way connected to a company you did loan from.

Try asking your bank for the phone number of the processor that sent the ACH to begin with. I've mentioned before it will most likely be InterceptEFT 800-378-3328 or ACHCommerce (Moneygram Int'l) 423-238-5184. Ask for the processing department. They will be able to verify through your account if they represent the pdl. They will also be able to revoke authorization and possibly reverse transactions. If neither one of those companies has info, request the processor info from your bank.

I don't mean the 800# on the bank statement. That is an arbitrary number pre-selected when an account is setup with the processor. Just like the characters that appear on the statement. We're not talking about the same things.

They may or may not be able to help you. If not, very specifically ask your bank for the "name and phone number of the ACH processor that initiated the debits to your account...not the company it was done on behalf of (the PDL)"

hello, i have had the same problem as these other people have, stcadvance have been taking random amounts out of my account, and it keeps putting me negative and its become a vicious cycle that i want to be over. Can you tell me what my next step is? I live in missouri and the original amount of the loan was 200. I have paid almost triple that. please advise my next step, thanks
