I had gotten some payday loans, and i was unable to repay them as quickly as the loan companys would like. The intrest rate is 600% or more!
Ellis and Crosby says they are lawyers ( when they are just a collection agency) and they have been threatning to pick me up within an hour, if i cant pay right away. ELLIS and Crosby thinks i am a HABITUAL offender because the loan comapnys are screwing me. But what they dont realize is that these loan companys are charging extra if you dont pay ontime. My orginal amount was $200, Ellis and Crosby racked it up to $560, just so they could file a suit aginst me. Its like they are doing it on purpose. GOOD THING I WORK FOR A LAWYER, and i have been informed.
THERE IS NO DEBT COLLECTION PRISON!
Ellis and Crosby has threatned to make me loose my job, and talk to my boss about it. In texas they cannot garnish wages without a court order. And they have totally violated a law.

Joe you are absolutely right. Those who have no sense of responsibility, looking for a free ride with no intent of ever paying anything will definitely have tough times in their future. I myself won't favor them and will consider them to be ignorant.

But, not all can be put in that deck. I believe, if not all, but 95% of the people over here in this forum feel the responsibility to pay their past debt. I myself am visiting this forum since quite a few months and I know the tendency of the people here. That is why I have such a strong voice to say this.

Joe,
You have some very valid points and I hope I didn't come off harsh on on my last post. It's just like you've said, sometimes mistakes are made and people are willing to own up to them. Then people like Ellis come in and abuse people. I had no problem paying what I owed...it was truely by mistake that it ended up in default anyhow. And before I could even get in contact with the loan company they had already sold it to Ellis. When the "Investigator" called me I felt pretty violated, and to my own ignorance I didn't know the laws. I just don't want to see more good people who are owning up to their mistakes be abused by people like Ellis and sorts. Thanks for your comments they are really appreciated:)

You didn't read what Dale wrote. He has no problem paying what he loaned and whatever NSF's he incurred. But the high interest is what Crosby is charging. That is what he meant by waiting...

The company Ted Ellis Crosby & Associates (Investigators) are currently
in trouble for their unethcial collecting and high interest rates on
loans.

Most people understand they've made the mistake by not having the money
there when the payday loan companies came around to collect.

These payday loan companies scam their clients by taking the money out
on payday, but at 4:00am when the money wasn't going to be there till
8:00am. So now, not only do they probably have 2 hits (what most
paydays do) but they also have negative now.

The payday loan people will tell them they can only pay by Western
Union, but will attempt to collect this debt again (even though they
said they could only pay Western Union.) They'll attempt to collect on
this debt again if the loan isn't paid.

Now remember each time they (the payday people) get these NSF's they
will attach a $25 NSF to the bill. So at most a $200 loan would only be
$350. That's $200 for the loan, $25 per each $100 borrowed, and the $25
x 4.

So why is it, when Mr. Ted Ellis Crosby can collect well over $1000 on a
loan that is only 60 days delinquent.

I find it personally to be unethical and so do several other people,
when they get these calls at work saying that they will arrested.

I am sure the personal banks of these individuals are well aware of the
problems, and aren't after the member of the credit union/bank.

It is not legal to threaten with arrest, and definately not fair to be
charing super, super high interest rates.

These people are not avoid their debts. They will definitely pay the
$200 loan they took out. But they don't have the $1000 to avoid arrest
to be paid in 2 hours.

That is why, everyone at Ted Ellis Crosby...Kara, Tammy, Aaron Free,
Dick Greenburg, Jessica Hawthorn, Annete Tamoni, Steven Nill...that is
why they are all under investigation.

Ted Crosby is going to court over this.

Please remember that some of us did have ok experiences with this company, like myself and have no desire to become part of a lawsuit. The posts are troubling, and though I don't agree that anyone should be treated ith disrespect, the CA's whoever they may be deserve to have all experiences, good and bad discussed. It is my hope that we remember that there are 2 sides to every story and that everyone deserves the benifit of the doubt at least once.

GUest we always welcome to hear all sides of the story. The reason we post on here is so that consumers can be more aware of what type of CA's are out there. This particular one has a lot of negative feedback and people need to be aware of the different tactics used so that are not verbally abused or insulted in anyway.

Your forum is full of info to help consumers as that is admirable, all I am saying is that the root of the problem is financial mismanagement. No One deserves to be treated in a disrespectful manner, but as well personal responsibilty is so important in resolving financial difficulties. These calls are not appropriate, but hopefully these experiences will teach people to slow down and get a grip on their financial situation.

Dear TAXMAN

It's not illegal to be in debt. However threatening people with arrest, and harassing them is illegal.

That's all I'm saying.

And yes, when that time comes when someone gets that phone call...there will be several complaints made against that company, and another lawsuit against an unfair collection company.

People realize they've made their mistakes and aren't hiding from paying. But by putting fear in people...do you think that'll make them pay any quicker? Making it where people have to leave work and are afraid to go to their own home? That's what the employees of Ted Ellis Crosby & Associates did?

Financial responsibility....that's what this website is designed for. To help people get out of debt. Not to teach people on how to hide from collection companies.

NOT VERY MUCH

How can anybody, and I mean anybody defend this collection agency? I was hit by them in early July but knew it was going to happen because I read up on them on this site. (I went through FSM, and they won't work with me at all so you tell me who I should pay?) They told me good luck, they were filing an avadavit in my county and would not tell me why... I gave it right back to them... and then sent a C&D letter and haven't heard a word since. They make me sick with everything they have done... I think FSM should be sued to... they had to know who they were working with....

Candy since you don't know what you are talking about please don't reply. I was "hit" by them, I was paying FSM on time and because my Credit Union made a mistake and did not put my paycheck in on time, they immiediately sent me to collections (within 1 day) with no explanation. Think before you talk....

CANDY:

Most of these payday loan companies make their money by hitting the accounts of the individuals account at 4am. What people don't realize is that they could have said Monday (the day after payday) is their actual payday. They didn't realize they would be taking the money back 5 hours before their paycheck was deposited.

And then when this is explained to the payday people, they tell them they can only be paid by Western Union. Well...if the paycheck is all they have, and they were hit twice (payday people split the repayment 2 times to try and get at least 1/2 their money back)...then they now have NSF. So then they can't pay it back for 2 weeks, or one week.

The person borrowing the money then thinks they have to repay it back by Western Union...but actually the Payday people will try go for the money again come next payday.

It's all a big game with the payday companies.

I would say voice it somewhere else. You don't know the reasons why the loan was taken, maybe it was for responsibility for your sick child and you didn't have money for their medicine so you went to the last place you ever wanted to go.....

Maybe you should go join Ellis

Candy

Guest is just trying to say mistakes happen. And in some cases not
always their fault. As I mentioned the payday loan companies challenge
the borrower by attempting to take back their funds at super early
morning hours.

And seeing how the loan wasn't paid back it went to Ted Ellis Crosby &
Associates. This collection agency/law firm is practicing unethical
behavior and collection tactics by threatening to put people in jail.

The responsibility was already declared when Guest said:

Quote:

(I went through FSM, and they won't work with me at all so you
tell me who I should pay?)

I think we should cut guest some slack when they said they weren't happy with the way FSM conducted their business.

When people who have low credit scores default, they get offered credit cards with high interest rates. They'll probably also have to pay a large down payment on an a lease for a car or an apartment.

When people who have superb credit keep doing what they are doing, then they get a lower interest rate credit card, zero down on a car, offers such as 90 days same cash...
AND GUESS WHO SUFFERS WHEN PEOPLE LIKE SOME OF YOU DEFAULT ON LOANS?
It is all based on the individual. How someone acts with their credit score has no affect on you whatsoever.

If your credit score is low, perhaps this forum can help you bring it up. We're all here to help each other.

Candy O, learn how to spell. I as well work in the finance industry.

Ellis and these payday loan people don't always operate within the legal limits of law. I have documention of a loan that was paid in full per the terms & conditions of the loan; however, this company turned over my mother's account to a third party collection agency when she closed her account.

Sure you think you are above it, when's the last time you spoke to your parents? How much do they know about on-line loans? How about your brother or sister? Let these people speak without your 2 cents, prejudicial assumptions about people. If you have something to say, great say it, but don't judge others.

Let's all remember the reason why we are here, to help each other with our debt problems and get answers to questions so that we can work through them. Ellis Crosby & Associates is the REAL problem here. Granted, they would not have even contacted us had we not defaulted on some kind of a loan, however, instead of attempting to collect the debt in a honest and truthful manner, they choose to humiliate, lie, itimidate and harrass people. That is just uncalled for not to mention ILLEGAL.

All of you have had problems with them

So, it's Friday and I am sitting at my desk minding my own business, when I get a call from our favorite collection agency Ellis Crosby & Associates! Spoke with Amber Williams, who informed me that they were ready to download court papers to my county to have me served with warrants concerning bad check and "conversion" charges. She said the company name was "Cash Options," who I swear I have never heard of, and I told her so. I told her I would call her right back on my cell phone so I could speak freely....and called Summer Saladino at the FL Attorney General's office for advice, since I have already filed an affidavit regarding 2 other contacts I have had with this company. She said to mention to them that I was in contact with her concerning their company. So, I called Ms. Williams back and after she spoke her piece, I told her that I would require written validation of this debt before I could discuss any repayment arrangements with her, and of course she got all snotty and how we could just keep this simple, blah blah, but I stood my ground  I just kept my cool and kept informing her of my rights under fdcpa and she kept talking and saying nothing of substance, and finally she gave up and said she would transfer me to their "legal" department, and I said that would be great, thanks, in my most cheerful voice! Got transferred to Robert Wood, who was much more reasonable....after I told him I was familiar with my rights under FDCPA and my contact with Summer, he said he will ensure that I receive written validation and I said I would call them back after I receive it. Further, since I am being told I owe $515, and of course do not have it right now, I asked if they would be willing to work out a payment arrangement if indeed this is a legitimate debt, and he said sure! SO....thanks, Summer, for the advice, and thank you to all for listening and advising...when I think back to how shaken up I was when they first contacted me in April, to how confidently I was able to deal with them today, I am humbled and grateful for you all and for this website. Blessings, Melissa :)

I think that constantly talking about these folks is scaring people. The reality is that some folks had a bad experience, some had a fine experience. It is like that in all walks of life. I paid my debt. I'm letting it go, learning from it, and not obsessing about it. I was treated fine by this company. I acted respectfully and intelligently, I was treated relativley the same way. I hope that the outcome is one that is fair to all, the consumers and the agency. Please remember the point is to pay your debt and do it as quickly as you can. I will excuse myself from these forums in the future and say I have learned alot of lessons.

I wish I would have had a good experience dealing with these folks the first time they contacted me....but they threatened, bullied, and generally abused me verbally until I sent them the money they demanded....I WAS scared and uninformed as to my rights. Because I did take out payday loans, and then had problems with repayment, I almost felt like I deserved this illegal treatment, sort of like a penance, I guess (should get a shrink, I think!). However, this forum has given me the knowledge, strength, and advice to deal with them in a much more constructive manner. It has also made me aware that I am NOT deserving of harrassment just because I have debted. None of us are perfect, this happens to be my character flaw. ANYWAY....sorry to bend your ear, just needed to vent. Ellis Crosby still is stinky, but I don't have to let them get to me, and because of this forum, I know that....thanks! Blessings, Melissa

Just trying to say there are two sides to each story and each desrves to be heard. Each of us desrves the right to our opinion. It is very good to be informed and hopefully we will all learn something valuable in the end.Best of luck to all of you. Both consumer and agent.

I think we here agree guest, that both sides need to be heard. But we are not classifying every CA as ignorant or harassing. It just seems that we are being classified AS dead beats! No matter how it is looked at. Which is not the case. But there is actually a third side to the story-- the truth!!!! :)

I received a call from Shannon Moore. She said I had 2 hrs. (till noon) to pay or first thing monday morning I would have files chard against me. She said they were a litigation office not a collection agency. Help!!!

Freaking out,
They pretty much did the same thing to my mother. In fact they are a collection agency; however due to the pending litigation against them they were stripped of their collection rights. Shannon is careful to not identify her agency as a collection agency, that would worsen the case against them.

Call the Florida's hotline, leave a message and wait for the attorney general's office to return your call. Tell them everything you know, give specific details. The more detail you have the better the case against them.

Ellis crossed the line when they threaten to arrest people. There practices have been unlawful and this is way they are under investigation by the state of Florida (where they operate out of). Do not pay them anything at this point. When the case is turned over to a legitimate collection agency, then offer to set up payments with them to pay your debt off. If you pay Ellis, they will not give you a receipt telling you that your debt is paid and could potentially sell your debt to another collection agency who will then start hounding you to pay your debt (which you have already paid 1 with Ellis, but have no records to prove such). Ellis will probably just say all they collected from you is interest & service fees not the original debt.

Tell them to stop calling you at home & work, request them to only contact you by mail. Make sure they have your mailing address and ask them to mail you a debt validation letter. Stay strong when you speak with them. Don't let your emotions take control and treat them with respect as you would want to be treated. Shannon Moore spoke to be very politely and I got allot of information from her that I was able to turn over to the attorney general's office. Her actions/threats are just that. Inform her to do her job, if she needs to file paperwork against you then so be it (legally all she can do is to report it on your credit report, she can't have you arrested for anything). You, on the other hand must report it to an agency. Preferably the attorney general's office, the BBB, etc. Let those agencies assist you in resolving the situation. Remember you still owe the debt, this doesn't excuse it, but until it is being handled by a legitimate collection agency...don't pay anything to them. Hope this helps you out. I got a friend of mine give me some advice prior to calling Shannon on my mother's behalf. I knew what I thought was legal, per the law, just wanted someone else's opinion of what was legal & not from someone who knew the laws.

This is an excellent site to get advice. The moderators are very knowledgeable regarding the law as well.
