LVNV Funding LLC: What to do if you find them on your credit report

I noticed on my credit report that there is a company called LVNV Funding LLC for $3195. The address and phone number are PO Box 10584, Greenville SC 29603-0584 and the LVNV Funding LLC phone number listed is 866-464-1183.

When I enter the lvnv funding phone number, (866) 464-1183 on the BBB website, it comes up with a Houston, TX address.

Has anyone dealt with this company? Have you heard of lvnv funding complaints?

They aren't allowed to continue collection activity while it's being disputed however LVNV has a habit of farming it out to other agencies to confuse the average consumer leading them to believe that it's been sold again. It's illegal because you sent them a validation letter and they continue collection activity. You can sue them over this as Goldenbast did.

Dont feel bad I keep getting taken to court by LVNV Funding and then they dismiss the case in 2006 and then in 2008 they are trying to sue me again for 1096.33. They never clear up the accts and keep spending more money going after people after they clear you of any charges being owed.

i am new here, so if any mistakes are made..... please look past it. i have a few questions. i came from the myfico forums, but it is dead slow over there.

1. lvnv is reporting that i owe from an old, 2000/2001 account from citifinancial. citi is not anywhere on my reports, as all my old stuff has fallen off due to age. they have the account listed as 2003..... which is not right in any way.

i have sent 2 debt validation requests, both cmrrr, and both have gone unanswered. i sent EVERYTHING to the CRA's, who in turn said i didn't send enough ID. as if a DL w/ SS# isn't enough..... i sent the original letters, the cmrrr's, everything. they have all reopened the investigations, but i know nothing is going to be done.

2. lvnv is also reporting as open, factoring company account, 120++ days late on an old associates card back in 2000/2001.
what is the next move, as i want this stuff off my credit. small claims court? do i have enough documentation? what should i file under?

In item 2 of your post these are typical FCRA violations that LVNV are usually involved with. You can first send LVNV a debt validation letter (certified mail, return receipt requested) if you need a template you can find one via my signature link, be sure to send the enclosure. Give it about a month and if you don't hear anything back from them go ahead and dispute it with the bureaus. If they come back validated then you can request the bureaus to provide validation methods used. If they cannot then they themselves can be held accountable as well.

JCEMT is right, get those DV letters off to them. Also take notes, keep copies of everything that they send or you send. They are well known for not doing validation or full validation.

I have been dealing with them for over a year now. What usually happens is, that when you request DV, they turn it over to another of their many agencies, and you go through the same thing with them. I have gone through about 5 so far :lol:

The important thing is document, document, document!! I have a file about 3 inches thick of letters, phone calls, etc. I also send follow up DV letters about 45 days later with a copy of my first DV letter-I believe in leaving a paper trail, just in case!..Good Luck..karen

How long does debt stay on yur credit before it falls off. I have a debt from 2000 and lvnv is just now trying to sue me for the money. I thought debts fall off after 7 years.

This has been on my CR for months. This was Identity Theft. Now the lawyer group is sending me notices. I sent them info, police reports and fraud notices from other companies that were included in the IT. This is a JC Penney acct. The other companies have cleared their accounts as fraudulent. How do I handle this now? Do I resend the information to the lawyer group or try to deal with LVNV. I have never heard from them at all!

I had two chargeoffs acquired by LVNV. Both were GEMB accounts. For each account I agreed with LVNV to pay them off for a settlement amount. I spaced the settlement amount out over three months. After paying off both collection accounts, LVNV updated with the CRAs within 45 days that these accounts were paid for a settlement amount.

After this information was reported I went one step further and disputed the validity of these two accounts. Before the 30 days window of disputes was even up, LVNV completely removed these accounts from my report.

Despite being lumped into the category of "bloodsucking collections agency," LVNV has been the easiest collector that I have dealt with.

Now I just need to see if I can somehow get the original GEMB derogatories removed from my credit report.

I keep getting calls from Resurgent Capital stating that I owe LVNV Funding on 2 accounts. They always call but never leave a message. How can I stop them from calling me. I do not have $3500 to pay them.

When they call back, I would demand debt validation letters concerning the claimed debts be sent to you immediately, and for them to cease calling. LVNV purchases junk debt for extremely cheap prices from original creditors, and then hopes to turn a profit from collection. From what I understand, they will even have other third party collection agencies attempt settlement including Resurgent Capital and northland group. My two LVNV debt purchases (both GEMB) were handled by Northland.

The debt validation letters they need to send by law must outline which original creditor this debt may have been purchased from. Validation letters should be your first step before any consideration of settlement. If the debt is valid they will likely accept monthly payments on a discounted rate in order to settle this debt.

If so you could attempt to have any accepted settlement amount be marked Paid in Full on your credit report. Then again, this is all down the road after you get those validation letters.

My credit report shows a balance of 1,510.00 but it also says "Potentially Negative Closed". I called the compnay and they show no record of me owing them anything ever. Not even closed accounts.. whats going on?

I recently have found out that lvnv has a lawsuit against me for a debit that i had no idea existed. I also had no idea that there was even a court case against me since I was never served does anyone have a similar problem with them or advice on how to handle them without going to court?

LVNV opened a small claims case against me. I disputed the amount that I owed and we were assigned a court date. I showed up at court and was given a paper saying that LVNV had withdrawn the case. Their attorney said that LVNV was going to continue collecting the debt but the case was withdrawn. This does not seem fair that they can just withdraw the case and say that I still owe them. I took time off from work and was in court ready to argue the case. Does anyone know if LVNV is still allowed to try to collect after withdrawing the case? Any advice?

I received a notice of a debt due to LVNV Funding (Previous Creditor - Hsbc Bank Nevada Natio/Good Guys) from northland group Inc. in the amount of $2,526.71 offerring to settle for $1642.36. I have no idea what the billing is for and I have never done business with either creditor. What shoud I do?

I checked my account today and found that LVNV funding has frozen my checking account. What are the steps to get this account "unfrozen" I do not recall receiving an official "judgement" notice, however I have received two letters from bankruptcy lawyers stating that LVNV has filed a judgement against me. Is it possible to simply contact LVNV, work out a payment plan and have my bank account "unfrozen" I greatly appreciate any help anyone here can provide. Thank you.

LVNV Funding purposely messed up there phone number so people could not call them so if you want to call them and harass them you can do so at 866-861-8182! They are on my credit report 4 times, have never sent me any information but now they are suing me! So I am doing my research and with any luck my husband and I can be the super heros that take out fake companies like LVNV Funding so they can not prey on the innocent and poor!!!

lvnv funding has taken me to court for a credit which i never had, i denied this debt to the judge.the judge will have a trial 2/3/2009.for me to prove do i owe this debt.i sent this company a certified letter asking them to send me some proof in writing that i owe this debt, that been a month ago and i haven't heard from them unil this day.please can anybody tell me what else i can do before i go back to court? thanks.

I'm confused. I owed Sears-Sears Gold Mastercard some money. I got behind on payments because I was having marital difficulties. They have charged off my account. Just recently I received a letter in the mail stating LVNV Funding, LLC has purchased my account and they have placed this account in this agency for collection. I called them on Tues. Jan. 20 and asked them how much I owe. Mr. Haynes said it was $2,977.97 but would settle for $2,500. So I made a post-dated check for the 30th and I told him I would try to get the money but would not garantee it. He said that if I couldn't get the money to go ahead and call him back and tell them not cash the check. I stopped the check on Jan. 29. On Wednesday, Jan. 21 I received another letters saying the settlement was for $1,340.09. I don't have this money now. I asked them to put me on a monthly payment plan. They refused. What can I do? Please help.

Should I have to pay a credit card debt that was in my spouses name only and my spouse passed away. My spouse had no will or no money left .Would I be responsible?

Nobody...the estate would be responsible. Secured debts would be primary (house, real estate, vehicle) then unsecured creditors. If there is no estate, send that info along with a copy of the death certificate to the creditors. Rinse and repeat.....DebtCC

I got my credit report today, and I saw 2 negative entries on the report.

One from GAP which shows an amount incremented to $230 from $41 which had
a creditor's statement: Purchased by another lender
Status: Transferred,closed/Account charged off . $230 written off.
and the last date was apr 2008.


Second entry was from LVNV funding LLC.
The address : PO BOX 10497
GREENVILLE, SC 29603

Original Creditor: GE CAPITAL THE GAP
Status: Collection account. $262 past due as of Jan 2009. Status Details: This account is scheduled to continue on record
until Jan 2014.

My question is I am not sure if these are legitimate.I called up GAP card, and they gave me GE capital number.
I can call up GE Capital, and ask them if these are legitimate or not. But if they are, then do I have to pay money to LVNV ?
Secondly, I dont want to deal with LVNV, instead I can pay off to GE CAPITAL. But if I do that, then will it get off from my credit report?
Also how is it going to infliuence my credit history in long run, if I pay off now.

I had a Sears card with about $4,000 on it at the time of my divorce in 2003. I never piad anything on it and now I am getting letters and phone calls regarding this debt that i owe. I am also involved in a civil court claim with this company over this debt. They were unable to serve me papers on this and the court dismissed it without prejiduce. Am I free and clear of these hounds now or am I still in trouble with them and the court.

Send both companies listed debt validation letters. You can find sample letters on the do it yourself link. It looks like GE Cap might be the current holder and LVNV is collecting upon it. If they properly validate, then you have a few options. You can offer a pay for delete, which is you pay it on condition that they remove the account. If GE accepts, LVNV will have to remove theirs as well. You can also offer a settlement, but beware???.any remaining balance will get you a 1099 if over $600, which means you will have to claim it and pay taxes on it.

Oh yes, they can sue you. What you will need to do is file a motion for discovery, where you demand they produce al the documentation proving their claims, also use this documentation to determine if the account is out of SOL. Also answer that summons, but don???t admit to anything remotely about the debt..either deny it, or answer along the lines of: without sufficient documentation to agree or disagree.

Lvnv guest:

They can attempt to serve you again. If it was dismissed with prejudice, then they could not sue you again. Check your state???s SOL law and see if this is a time-barred debt, it looks like it is over 5 years old and some states have a SOL of 3-4 years while others have longer. Check. If they do sue you again, just do not admit to anything about he debt and make them prove it up with documentation during discovery.

I had this bill with sears, and disputed it in 2001, I paid a collection agency two pymts of 250 which i thought was unfair. I cant remember who it was., this was in 2002. I have not heard or been contacted until just recently this later part of 2008 by this nasty lady advising me i owe all this monies, i told her to stop harassing me. Now all of a sunden I get this summons from this law firm Fosters & Garbus saying I owe 1642. 00. I am so upset and now they wont stop calling me. They said I made a pymt in 2005 and i said i never did, and status of limitations is pass. I just dont have any proof to my pymt.

I defaulted on a sears acct in 2002 due to loosing my job I have been in school triing to acquire a career in the medical field and just getting by. back in june me and lvnvfunding attorneys came to a settlement on a old walmart account. the original account was for $1300 we settled for $1100. one week later after paying the attorneys a different collection agency started contacting me saying that i owed them $1500.I disputed them over the phone. I sent them a copy of the attorneys settlement .one month later resurgents capital sent me a letter saying that i owed them $1700 on the same account.could i take any legal action

Answer the summons. Basically if you can???t prove you paid it off I would go the rout of denying the debt and making them prove it. In the discovery part you want to see the last statement and if the amount they are suing for is different then the amount listed on the statement (except the attorney and court costs) then you also ask to see a signed copy of your agreement/contract that lists how much in interest and fees they can tact on. If they say you made a payment, then also ask to see proof of these payments. If they provide the statement then that will prove that it is SOL and you can immediately motion to dismiss based on the fact it is a time barred debt. If they can???t produce anything, then you motion to dismiss based on no evidence of your obligation to pay. If they try to submit any affidavit, you object to it on the grounds that it is hearsay and you have the right to question the signer of the document.

Therichards:
I am a little confused???are they asking for those documents or are they using those documents against you? If they are asking for them, object to it and reply that there is no reason for them to see such highly personal information. You also want to sent them a set of demands during discovery, like a advised above..you want to see all documentation on this alleged debt.

Resurgent is LVNV. Send them a copy of the settlement. Check your credit reports and make sure it is listed as settled and that no other company is listing it. With a copy of the settlement send them a total cease & desist, telling them that you want no further contact with them as that account has already been settled. If they still contact you, then you can sue them.

Carol Kelly:
Somewhere near the end of your credit report it lists the addresses of all your creditors, find the one you want and send them a debt validation letter.

Aliyah Robinson:
This is not LVNV we help people deal with companies like that here. You should send them a debt validation letter before you start any payment arrangement to make sure everything is on the up and up.
