Right now Midland is in the middle of a class action suite that I am a part of, because they dont disclose theat they are recording the call. They are not a legit company. They are scammers who buy old out of staute of limitations and expect people to pay on them. Fu** these guys! DOn't give them money or waste your time calling them. They are vulgar and rude.

I have an account with midland. Weird, the account was originally a fingerhut account. Then midland took it and hired Phillips and Cohen to collect it. I posted about this a while back--a collection agency collecting for a collection agency. weird but I have two accounts that are doing this. The other was a MBNA account and it went into collections to Hilco receivables, and now Phillips and Cohen are collecting on it as well.

I have had calls from MCM, who has acted like they were KGB using hard tactics. A real joke to someone who has lost everything and been to jail. I tried to contact them, their address has changed in the past weeks. They want me to disclose more info than I prefer to, just to tell me what they want. I have found many, many complaints regarding Midland Credit Management online. The caller, obviously from INDIA uses names like Tom Jones, or Bill Smith... what a joke. I usually invite them over for some beef and tell them to call anytime. Fools.

Midland is such a rip-off. I too had an account with Ugly Duckling, and an ugly duck is exactly what I got. I ended up giving it back to Ugly Duckling, who was bought out by Drive Time. Originally, it was listed as a charge-off and they never persued payment of any king - mainly because my complaint about the vehicle was legit. Now, Midland is holding the receivable on that account. They hound me like a dog and they won't accept any certified mail. Makes you wonder...HMMM

And the only thing that can bring these crooks on the right track is debt validation. Ohh yes, dont forget to send the DV via certified mail with a RRR. Once you send a DV to them you can be sure that they wont contact you. Even if they contact you they wont give you a proper validation of the debt. In such circumstances it is very important to know the laws and to fight back.

What can I do... Midland Credit Managment sent a collection ("Settlement Opportunity") letter to me, but to a relative's address. The relative opened the letter (not expecting any mail for me - just blindly opened the envelope without looking at the name, innocent mistake). I do not live at that address! Now I'm thoroughly embarrassed because they have intimate knowledge of my financial difficulties!
Fight Midland
The way to stop Midland Credit Management is to send them a regular letter first. Request that they validate the receipt. Wait about thirty days and send them another letter again requesting the validation of the debt. They will never answer. The third letter send it via CMRRR (that is a Certified Mail Return Receipt Requested for those that wanted to know). This time state to them that you have requested in writing on two separate occasions that they validate the debt. Again..wait about 30 days. Make sure that all letters are dated the day you send them in the mail and keep copies of them. Once you get the Return Receipt back from the post office and have waited the last 30 days. (90 days from start) now it is time to talk to the credit bureaus. Send a letter via CMRRR to the credit bureau that shows a derogatory comment and request that the bureau remove the debt from your account that you have contacted Midland Credit Management on three separate occasions with no response. Enclose all copies of all three letters and also a copy of the Return Receipt. Within 30 days you should have a response back from the credit bureau that you notified that the debt has been removed from your account. Midland will never answer any of your letters. Do not call them, only write to them.

I received a letter today from Midland, at my home in Missouri. The first problem is, it was addressed to my grandmother, who lived her whole life in Illinois. It also had her name spelled wrong and middle initial wrong. The other BIG problem is she passed years ago. We don't even have the same last name so I have no clue how I was linked to this. Another issue I am having is I know my grandmother did not have any debts at the time of her death. My grandparents didn't take out loans. They built their own home without debt and even bought their cars with cash. They never had credit cards either. When I tried to call Midland they were very rude. Even hung up on me after I wouldn't tell them more infomation on her. I'm not giving out personal family info to someone I don't know!! I called back and asked to speak to a superviser. I ended up having to leave a message because one was not available...Has anyone else these kind of problems or have any advice on what I should do?

I agree that many among us earn their living by working at the collection agencies and what they have to do is for their job's sakes. You many be in particular an honest guy and deal with the customers with respect, but, however, its impossible to ignore all these complains those you may find across these forums against the CAs.
I would rather expect you to help out the people in problem with your firm other than shouting in its favor. If you can get these problems fixed, things will fall into place automatically. Good Luck!!

This company, MCM, has been calling - no letters - and harrassing us for several months, sometimes as early as 8am, always asking to speak to (our son). The caller, a "Nathan J*nes" (who is NOT a native English speaker) was rude and/or hung up when I asked for more information. Finally, today I asked his name, his phone number (called ID is "unavailable") and to speak to his supervisor. Our son is under the age of 21 and Mr. J*nes vehemently demanded I prove it. I asked repeatedly to speak to his supervisor to which he insisted I did not need to do so.....eventually a man by the name of "John Smith" (also not a native English speaker but at least pleasant) identified himself as a supervisor.
Come to find out, they wanted our son's biological father, a man who has *never* been at this address or phone number and whom we have not seen in fifteen years. I reiterated that if J*nes had been less rude and more professional, this matter would've been cleared months ago. Allegedly our number will be removed from their records, but in the light of so much harassment and aggravation, I believe I shall start writing letters concerning this company's unprofessionalism.
Sounds as if our son needs to check his fledgling credit report (which should be perfect!) and make sure these idiots haven't 'mistakenly' tainted it with their short-sighted zeal.

I came home last Saturday to find a business card of a process server with a note to call to arrange a delivery. I called the number and the guy said I was being served a judgment from Midland Credit Management for FNCB. FNCB was paid several years ago after they filed bankruptcy in 2003. I never received a statement from them after they sent the notice that credit card would no longer be valid after the date they named in the notice. So I paid online as long as the website worked. I have never received any correspondence from MCM prior to this contact on a judgment being filed against me. Can I still send them a validation letter? I haven't received the service of process yet, the process server is supposed to come back later in this week, so I have no idea what the judgment states yet. Has anyone else run into this situation with Midland Credit Management?

This company is like leaches. They come out of no wear can hard to get off except if you burn them. I have them on my credit too. I sent DV letter, I got a letter back from them saying/. Please call so we can resolve this matter and help you with paying the debt, bla ,bla ,bla. I want to send them another DV letter but I have to wait until the 30 days are up. What the point of sending the 3rd letter to them if they have not sent you the proof and account info of the debt on the second certified letter. After I send the second letter can I send the 3rd letter to the Bureau to get them removed?

I recieved an offer from another credit company for my son's account that was overdue and it was a good offer and I paid it. That was over a month ago and I never recieved anymore statements. Now all of a sudden mcm is calling every morning for three days now wanting to talk to my son and when I tell them that he is not here they hang up before telling me anything else. This morning I got more information out of them and they said that it was regarding a bill for his cell phone and I said I paid that bill with another collection company. They said they never got it and that the statues of limitation were up and that I had one hour to make up my mind to accept their offer. In a panic I paid them by credit card check over the phone. They wouldn't let me send them a check. I know I've now paid for this bill twice. I'm hoping this is the end of it. I never knew that the same bill could end up in two different collection agencies and that they could both collect on it.

Mcm called and said that july 31 is the statute of limitations for the bill they are trying to collect. This bill is like 10 or 12 years old. I have not reicieved any bill for this bill or any communications till this last week. Then they are calling every morning and now they are telling me that I have 1 and a half hours to except their offer, and that I have to pay them via the phone right now. I asked them to send me a bill for this ammount and that I would semd them a check and they said they couldn't do that because them it would be past the statute of limitations. I can't believe that the statute of limitaions has been for so many years. I feel I am being highly pressured to pay this bill without having a statement for my proof.
Please answer me as soon as possible.

IF the SOL is due to expire on July 31, don't do anything. I believe they are pressuring you to pay BEFORE the SOL runs out for THEIR benefit, not yours!
Besides, I wouldn't pay any one a dime before they validate the debt.

What is in a validation letter? MCM sent me a letter that has the signature of a cell phone company's Senior Manager that looks like it was phisically copied, cut, and pasted on an Arbitration claim. I'm not sure if I should pay MCM any money at all. I have until 8/06/08 to pay them. What should I do?

I have been rec'ing calls from MCM for the last month. My wife started asking them questions and as soon as she did, they would hang up. The bill they are trying to collect on is 10 years old. This morning when they called, she informed them we were going to the Attorney General and again, they hung up. We rec'd two more calls this afternoon. The last time, she said she was me and needed the street address to mail in the payment. They refused, said we could do it over the phone. She told them she would not make any payments over the phone and if they wanted their money, it would be delievered by certified mail. They then wanted her to verify who she was by giving them my SS# and birthdate. When she refused to give them that over the phone, they hung up. This is ridiculous and they shouldn't even be allowed to be a legal company. I have turned this over to my lawyer to handle.

Just want to say thank you for the very helpful information of safety precautions. I received a call from MCM this morning and I know I owe debt to the company they mentioned. Instead of giving her my account info right away to clear this debt, I decided to take time to check them out first, came to your site and because of your helpful information decided to verify first that the company they say I owe is on my credit report and verify the summons letter they say they sent me before paying them any money. I must say, though the operator was eager to offer me several options of payments, she was very pleasant in doing so. Thank you.

I've read everyone's comments and talked to a friend about it online. My husband got a letter today from MCM that says they want money for some old verizon bill from like 6-7 years ago. Now to be fair my husband never did pay that bill off, he was a stupid teenager and I dont want to have to go through a long story so I'll leave it at that. My friend suggests ignoring them because if verizon wanted it paid they would have done it themselves and way sooner.
Now he was sure the bill was like 600+ dollars from verizon but MCM lists it at 538 (not including fees they will add on for nonpayment). They of course give him tons of options on paying, few installments here or just one large lump sum to never hear from them again! Oh but mind you, only if you pay via check or credit card! I dont plan on paying them; as from what I've read that doesnt even fix things half the time.
I'm sure, from looking at the comments, that this is already on his credit. But my friend says that if his credit was already splotched by Verizon the first time around and I shouldnt worry.

to answer your last question.no buying a debt doesn't re-start the SOL.beware of MCM,as stated on posts before they are a complete bottomfeeder.get everything in writing before paying.what state are you in?the SOL might be near on this and they are trying to get money on it before it is past the SOL.just an FYI,while buying a debt doesn't re-start the SOL.making a payment on it does.

What state are you in? There are 17 states where a payment does not re-start SOL unless the consumer acknowledges the debt and makes a written promise to pay.

My husband swears that he had that cell phone OVER 6 years ago. So that means the SOL is up and that they are trying to get free money right?
If that's the case what do I do now? Send them the CCRRR 3 times? Then inform the credit bureaus when (from what it sounds like) they dont respond or respond with letters asking ME to proove that I owe the debt? I already know to keep all correspondance with them through letters only- as it seems that once they get your phone number they'll harass teh crap outta you via phone.

is it on your credit report?i would send DV and C&D letters to MCM asap.then dispute the entries if they are on your credit report.check your state laws in regards to recording calls.try not to talk to them until they validate.which should never.

Hello, its me again- So I talked to friends and family today, a friend told me that my husband is still going to have to pay the bill anyhow even if its past the SOL. She said that due to the fact its a valid debt they might be able to provide the DV. And that should have what on it exactly? The arbitors name (Verizon) and proof that this will take care of the old debt?
Also, when I talked to my mom she said that my husband was a minor when he got this phone (he couldnt have been more than 17 at the time) so does that factor in at all? She says to ignore it, but I still think the DV CMRRR is the best route. Any ideas?

if a debt is past the SOL it is still owed,but the CA that bought it will have a hard time validating.i would wait before paying anything to a JDB.send that DV letter out.i almost guarantee they can't validate it.
