National Enterprise Systems: How to deal with this debt collector

HEllo and thank you for this valuable resource!

I'm having some trouble with National Enterprise Systems.

They have been calling several times a day for weeks. I have had some shouting matches with them and they have threatened to call every single morning, first thing "so we're the first thing you think of when you wake up."

So when I did get a contact there and discuss my debt, she threatened "legal proceedings" if they don't get a resolution immediately.

I was scared and gave her my bank info for an initial payment after the holiday. Now I think that was a very bad idea (read somewhere that they will often take more than was agreed), and am scared about what they might do.

They keep calling constantly. When I try to get this particular contact on the phone, she is always busy.

What should I be doing here?

threatening calls say i have to pay by the end of day. i don't have the money. told me no one would be in their office after 3 pm. threatening to put a lein on house, take wages. what can i do. :cry:

Don't send them anything or even talk to them. There is currently a fraud investigation against the company and numerous intent of lawsuits pending.
Any claim to the contrary is a plant by NES. Don't be Fooled!

For 6 months these ppl called me 20 times a day, no kidding. I did answer the phone only once and they screamed at me and said they were suing me w/o telling me who they were. They accused me of defrauding BOA and demanded payment in full at that moment. They told me to call a friend or family so I could put almost 4300.00 on one of there credit cards. Then they negotiated it down to 2400.00 when I told them all my f/f were in the same boat as I. I was crying and worried sick. They talked me into giving them a postdated check, which after I had cancelled the check 3 days later cause I couldn't get the money togther. They called and left 15 messages on my home phone and cell phone each. Which I saved every one of them. It was a peaceful 3 days. 4 months later I get a certified letter in the mail from an attorney. It was to take me to the magistrate for the 4300.00. I did not respond to it but I showed up at the specified time and date, which they did not, so they delayed it another 2 weeks, and I showed up again and they didn't show up and they favored in me and told me that this debt is now cleared unless they appeal it within 30 days. I filed a complaint against them on the ftc and actually heard back from them on the complaint. They said that there is nothing they can do about them and moniter them through the complaints and if they get enough then they investigate them. I thought, wow, they give us rights but don't do anything about them. Any bets on them appealing? Or is this another one of their scare tactics

After a day of harassment , I called NES to offer them a deal on my sister's behalf (this is her debt that NES is after) . The offer was less than 10% of the debt due . I told him that I had used all of my resources , friends & family , and that was what I can pay in one full lump sum . He was irate ! He said it was ridiculous , proceeded to belittle me , and then amused me with a "reasonable" payment plan . I said no , can't do sir . Then he told me to hold and I was greeted with his "supervisor" . I explained myself again and offered the same when I spoke to him . "Supervisor" was just as rude and told me I was crazy for trying to pay less than 10% of the debt owe and I told him , "Look , I can't do it , I can only offer X2 (I changed the amt to a couple hundred dollars less than what I had originally said) and he interrupted with , "Hey hey now , you said X at the beginning of this conversation." And I played dumb and said , "Oh , yeah . I guess I did . And that is all I'm going to be able to pay because again , I have already asked my friends and family and I highly doubt they will lend me any more money." So then he asked me if I was sure .. and I said I'm positive and then he said he'll submit the "paper work" and get back to me in a couple of hours to see if it has been approved . That was yesterday at 1pm .. I'm still waiting for my phone call .

My question is .. if they do accept the proposal .. what kinda of documentation should I ask them to send me to make sure that they can not come back in the future and try to collect the same debt from my sister ... also , after she pays , what happens to her credit ?!

I also have to mention that they too used the same illegal scare tactics on my sister : take her to court , take her car , garnish her paychecks , harassing her at work , then harassed me on my cell phone . After I found this site and read up on fdcpa I recited what I knew and they backed off for the night .

I got a call today from a lady at NES and she stated that because I am married to my husband and he can't pay the bill then I am going to be sued. Then she asked can I borrow the money to pay the lump sum. I told her if I could borrow the money to pay the lump sum, then I could have borrowed the money to continue to pay the bill. I told her the bill is not current because I am no longer employed. I believe if I have to choose between my kids eating and the heat bill versus a credit card bill, that is a no brainer. I told her when I get a job the bill will be paid, she told me well you're going to be sued and have to pay the lawyers. At that point I had gotten pist, I told her she is just doing her job with her scare tactics and she can't get money I don't have and she can't sue me for what I don't have. The whole situation could have been handled better and I think these people should be trained better than they are. There is no need to be rude, people want to pay their bills, at least I do and I did. I have fallen on hard times. She proceeded to tell me that she can't believe that their isn't anyone I can borrow the money from. I told her hello we are ressession, she said that isn't her problem I will be getting sued. I hung up on her. I have every intension on paying my bills, but I will not be bullied.

Yeah, we did, we owe a debt but familiarize yourself with the Fair Debt Collection Practices Act which are Federal Laws. I had a nice lady named cheryl, tell me that its okay by the Ohio Attorney General for them to call me 3 times a day everyday, thats not legal, thats harrassement. I draw the line at 1 time

but it doesnt matter where you draw the line as far as the law and the courts go. it matters where THEY draw the line. You would have a very hard time trying to win harassment case against them by saying "they called me three times every day". Even the fdcpa wording tells a different story than that--the FDCPA says that it is illegal for them to cause your phone to ring repeatedly when their intention is to harass or annoy....3 times a day is trying to collect, not trying to annoy you.
