can a collection agency force me to do monthly payments even if i cant afford the payments?

I believe my guarantor is Great Lakes and my loan (in default) is now handled by DCS. My question is this: I've read on several sites that I may request loan rehabilitation based on 9 payments of an amount that is "affordable and reasonable." When I speak to DCS they demand that I pay an amount far and above what I'm able to pay. I've established hardship for the purpose of lowering the amount that would be garnished from my paycheck and plan to make voluntary payments but can't I request a lower payment to rehabilitate my loan?

I had to deal with them today, and alot of others that weren't so nice, but I was pleasantly surprised when they were willing to work out a settlement and the girl that was helping me was actually really nice. It was the only one of my creditors that didn't give me a hassle today....

I have been reading the posts on this forum and decided to send letters to the PDL's instructing them to stop ACH debits. The part I'm not sure of is the overpayment of previous fees, what I actually have to pay, etc for LA. I have had several previous loans and have overpaid fees requried by LA. Has anyone ever received the over paid fees back? I thought about giving them options in the letter. For example: I have about 200 in principal left on one loan to a licenced lender outside of LA. Lets say from previous loans I have overpaid in fees according to LA law by $1000.

Does the debt consolidation program really work. and What happens if i plan them and they dont pay my loan compaines

I have paid Pay Day Loan Yes over 800 dollars for a 300 dollar loan.

If the debt owed was presented to me far over 30 days ago, can I still validate -- well, perhaps that's not the right question, I know I can but is there any use? Can I still relieve myself of responsibility if they don't answer within 30 days? As far as a cease and desist letter, can I write that at any time as well? What if from now on I don't want any more calls I want ALL communication done through mail, do I have to have a reason for this? Do they have to comply, and if they are obligated to comply, what if they dont? Also, one more question.
