For as long as I have been here it has been commonplace for advice to people writing Cease Communication letters to tell a collector to communicate by USPS only! Soaplady, who worked in the collection industry, at one time, pointed out to me that this is not correct! It is all or nothing! Communicate or don't, period! I went back and read through the FDCPA and she is correct! Even a sample letter that was circulating around stated "communication by mail only!" This is wrong info so lets not use it anymore! I am not saying everyone did but it was common!

I'm in New York State and I'm filing for chapter 7 in 6 months. I have some credit card debt that is gambling related via cash advances. It's around $1,100 spread out over 3 cards. One card was for $500.00 and the other two were for $300.00 a piece. Actually $900.00 I used to gamble and the other $200.00 I used to get a gift card for someone I know who like the casino I go to. I made payments on the cards for about 4 months after the advances. Do you think these advances will cause me problems in my bankruptcy?

Is it better and faster for me to pay off old collections on my credit report myself or use a debt consolidation service. Will using a service affect my chances of getting aprroved for a home loan?

I had a loan with Payday One for $700 and paid over $800 and still owed $692 (how crazy is THAT). Anyway, once I closed my bank account and sent the letter letting them know that I knew they were illegal and had over paid, and demanded a PIF-- I got it! My current balance is ZERO. Let's hope the others go that easily (I suspect they won't). - Maura
